Questions: Pursuant to ITB Clause 4.3(a), tenderers with shared controlling shareholders shall be deemed to have a conflict of interest, warranting disqualification from the bidding process.

Please clarify whether two bidders submitting bidding documents signed by different authorized signatories - each holding distinct Powers of Attorney granted by separate legal representatives from different subsidiaries within the same corporate group - would be considered to have a conflict of interest that warrants disqualification.


Response: It is advisable to follow the ITB Clause 4.3(a) to 4.3(i).


No. 2

Questions: How about the companies who did not attend the site visit do they still can submit the bids?


Response: Site visit is not mandatory. Please refer to ITB 7.2 of Section 2-Bid Data Sheet.

No. 3

Questions: We would like to confirm whether it is still possible to replace the company that will cooperate with the Dom Dailololi company for the tender New Construction of Municipal Market In Lautem, Municipality of Lauten

Response: Please refer to ITB 4.1 and ITB 11.5 of Section 1-Instruction to Bidders.

Questões : Nos termos da IAC 4.3 (a), os concorrentes com acionistas controladores em comum serão considerados como apresentado conflito de interesses, garantido a sua desqualificação do processo de concurso.

Solicitamos esclarecimento sobre se dois concorrentes que apresentem documentos de concurso assinados por signatários autorizados diferentes – cada um com diferentes Procurações concedidas por representantes legais distintos de diferentes filiais do mesmo grupo empresarial – são considerados como apresentando conflito de interesses que leve à desqualificação.

Respostas: É aconselhável seguir as alíneas (a) a (i) da cláusula 4.3 das IAC.

Questões: Sobre empresas que não tenham participado na visita ao terreno. Podem apresentar proposta na mesma?

Respostas: A visita ao terreno não é obrigatória. Remetemos para a IAC 7.2 da Secção2 – Ficha Técnica da Proposta.

Nº. 3

Questões: Gostaríamos de confirmar se é possível a susbtituição da empresa que irá cooperar com a empresa Dom Dailololi para o concurso da Construção do Novo Mercado Municipal em Lautem.

Respostas: Remetemos para as IAC 4.1 e 11.5 da Secção 1-Instruções aos Concorrentes.
