The Regulation (Eu) 2016/679, Of The European Parliament And Of The Council, Of April 27, 2016, Regarding The Protection Of Natural Persons In Respect Of The Processing Of Personal Data And The Free Movement Of These Data And Which Repeals Directive 95/46/Ec (Hereinafter Rgpd), Of Application From May 25, 2018, Establishes, In Article 37.1.1.1.1.1, Appoint A Data Protection Delegate (Hereinafter Dpd) For Various Authorities And Bodies, Taking Into Account Its Organizational Structure. However, Art. 34 Of Organic Law 3/2018, Of December 5, On The Protection Of Personal Data And Guarantees Of Digital Rights (Hereinafter Lopdgdd) States That Those Responsible And In Charge Of The Processing Must Designate A Data Protection Delegate In The Cases Provided For In Article 37.1 Of The Gdpr And, In Any Case, When It Comes To The Entities Referred To In The Said Precept. The Dpd Has, Among Others, The Following Functions In Accordance With Art. 39 Rgpd: - Inform And Advise The Person In Charge Of The Treatment And Workers Who Deal With The Treatment On The Obligations Imposed By The Regulation And Other Data Protection Provisions. - To Supervise The Compliance With The Provisions Of The Data Protection Regulations And The Policies Of The Person In Charge Or In Charge Of The Processing In The Field, Including The Allocation Of Responsibilities, The Awareness And Training Of The Staff Participating In The Operations Of The Corresponding Treatment And Audits. - Advise And Carry Out The Impact Assessment Related To Data Protection And Supervise Its Application. - Cooperate With The Control Authority And Communicate The Incidents That May Occur. - Act As A Point Of Contact Of The Control Authority For Issues Related To Treatment.
