The Employer reserves the right to decide whether a bidder may or may not be awarded the contract for the current tender based on previous performance in projects awarded by the Timorese Government, subject to the performance evaluation report by ADN - as the supervisory entity for public projects (paragraph a) from Article 5 in the Decree-Law no. 60/2020, November 25th, which creates ADN I.P.) – which will include the economic risks, the contract’s goals and the satisfaction of needs and public interest. In case of a negative performance, the bid will be excluded during the preliminary analysis, according to Article 5 in conjunction with Article 62(5) and paragraph e) from Article 65(10) of the Legal Regime for Procurement, Public Contracts and its infractions, approved by the Decree-Law no. 22/2022, May 11th, amended by Decree-Law no. 14/2023, April 12th.
