Abstract:   Technical Assistance for the Mixed Credit Financed Water Supply Companies in Vietnam. II.1.6) Description/object of the contract: National and international

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required: Not applicable.
III.1.2) Main terms of financing and payment and/or reference to the
relevant provisions: Advance payment against bank guarantee of 20% of
fees and 40% of reimbursable expenses. Quarterly progress payments
according to time and reimbursable expenses spent with deduction for
advance payments.
III.1.3) Legal form to be taken by the grouping of suppliers,
contractors or service providers to whom the contract is awarded: A joint
venture is upon award required to sign a joint venture agreement meeting
the requirements of the Contracting Authority.

III.2) Conditions for participation
III.2.1) Information concerning the personal situation of the
contractor, supplier or service provider and information and formalities
necessary for the evaluation of the minimum economic, financial and
technical capacity required: Candidates shall be eligible for tendering
and award of larger contracts by Danida. Conditions hereof include.
(a) that the candidate is established as consultants in his country of
origin (if the candidate is an intended joint venture, each member);
(b) if the candidate is an association as a joint venture, consortium or
other unincorporated grouping of two or more entities, here called a
"joint venture"(JV);
(i) the application shall be signed by all members;
(ii) the members shall attach to the qualification application a letter
of intent to form a JV signed by all members, including a definition of
the roles and percentage input in monetary terms of each member of the JV
(the requirements to this letter of intent are given in "Guidelines for
preparation of the qualification information" see VI.4 (ii) below");
(iii) the information related to the candidate's eligibility, legal
position, economic and financial standing, and technical capability and
the conditions (c), (d), and (f) below, shall be furnished by each member
of the JV and the conditions met by each member of the JV;
(c) that none of the grounds for exclusion as specified in Article 29 of
the Service Directive paragraphs (a), (b), or (c) applies to the
candidate, and that the Contracting Authority finds no grounds for
exclusion as specified in these Article, paragraph (g);
(d) the candidate's statement of having a formulated code of ethics and
business integrity management system based on e.g. the OECD
Anti-Corruption Instruments;
(e) the candidate's statement that he is affected by no potential
conflict of interest, that he has no particular link with other parties
which may be involved in the project or programme, and that he will
inform the contracting authority immediately should such situation arise,
and proof of meeting these conditions shall be provided by candidate.
III.2.1.1) Legal position - means of proof required: Registration
certificate showing place and date of establishment, and authorisation or
enrolment in professional organisation or trade register if required in
the candidates country of establishment.
III.2.1.2) Economic and financial capacity - means of proof required:
(a) Cover of current professional liability insurance. A minimum of DKK 5
million independent of other damages is required.
(b) Appropriate statement from banks or presentation of the candidate's
balance sheet or extracts, showing access to or available liquid assets
or line of credit, free of other commitments and independent of any
advance payment, meeting the requirements of the assignment. A minimum of
3 000 000 DKK is required.
(c) A statement of the candidate's annual turnover overall and in respect
of the services in question for the previous three FY. A minimum of 8 000
000 DKK in respect of the services in question is required.
III.2.1.3) Technical capacity - means of proof required: (a) List of
candidate's own full time managerial staff (partners, general technical
management and other home office management) supported by curricula
vitae, adequate for carrying out the assignment (minimum management
having considerable relevant experience technically and managerially).
(b) List of assignments of similar size, nature and complexity, and
preferably from the geographical region of the assignment, all during the
past three years, where the major part is carried out by the Candidate,
showing experience from a number of assignments (minimum: experience from
two to three such assignments) - if a joint venture this requirement
applies to each member within the type of services to be provided by him.
(c) Not applicable.
(d) Statement of the average annual manpower resources during the last
three years with numbers of professionals in various categories necessary
for carrying out the assignment (minimum: own full time man power
resources for the team leader and other key personnel including back-up
well in excess of those directly required) - if a joint venture this
requirement applies to each member within the type of services to be
provided by him.
(e) Not applicable.
(f) Quality certification or an established quality management and
quality assurance system necessary for carrying out the assignment
(minimum: an EN ISO 9001 certification or similar or an acceptable
operating quality assurance and management system).
(g) Not applicable.
(h) Proportion of the total contract value intended sub-contracted plus -
if experience and services of a sub-contractor are essential to the
technical capability: the type and share of the services to be provided
by the sub-contractor his experience from similar assignments and his
manpower resources (maximum: 40 % of the total contract value to be
sub-contracted).
