Abstract:   UK-OLDHAM: Oldham & Rochdale Housing Market Renewal Pathfinder. In June 2002 the government announced the creation of nine sub-regional partnerships, which have been designed to restructure failing and weak housing markets in the North and the Midlands. The Oldham and Rochdale Housing Market Revewal Pathfinder was one of these partnerships bidding for 602 500 000 GBP of market renewal resouces over 15 years. This is our once-in-a-lifetime chance to make a significant improvement to our boroughs over this period, providing benefits to local people that will last generations. To that end Oldham and Rochdale Councils wish to enter into one or more long-term strategic framework partnerships with consortia having all the skills to develop and deliver significant improvement programmes for potentially the next 5 to 8 years, through a single, but joint procurement process using the EU Negotiated Procedure. We are inviting consortia to bid for a range of physical work in three neighbourhoods, namely East Central Rochdale in the Borough of Rochdale and Werneth and Derker in Oldham. Detailed Neighbourhood Plans have been prepared for these neighbourhoods. Consortia may bid for one or more neighbourhood(s) and are invited to indicate their preference. We are seeking companies or consortia who will deliver new build and refurbishment of housing, demolition, related environmental and highways improvements and liaison with residents and communities. In addition, there will be opportunities for commercial new build and refurbishment, related environmental and highways work and a range of other work. It's an exciting initiative because of the size of the contracts, their length, nature and the range of other potential development and construction work going on in both boroughs. Initial ODPM HMR funding of 53 500 000m has been secured for the two year period commencing 1st April 04. The contracts with the preferred consortia will start on 1st April 05. Funding has been set aside nationally for the period 4/06 to 3/08 and we expect a decision on the amount for Oldham and Rochdale in the autumn of 2005. The Councils will enter into multi year framework style contracts for the services in the scope of this opportunity, typically for 5 years with an option to extend for a further 3 years, subject to satisfactory annual evaluations of performance, and, subject to the ODPM's approval of further tranches of funding. It is not possible at present to say how many contract awards may be made. However many contracts are ultimately required, they will be clearly separated for each purpose identified through the procurement process as a whole, but, all of those contracts will be related to the framework arrangements as a whole. In addition, there is significant potential for a range of complementary funding from English Partnerships, the NWDA, the Housing Corporation and the private sector. Having secured the initial resources, both Councils wish to build further on the benefits gained by embracing the principles of the Re-thinking Construction/Constructing Excellence initiatives. Proposals are invited from respondents who can demonstrate the multi-disciplinary skills necessary to implement comprehensive housing and regeneration programmes for the identified intervention neighbourhoods. Respondents will be expected to provide evidence of a successful track record in respect of delivering the key elements of the above works and services and be able to show an appreciation of the social issues attached to this type of engagement, as well as construction and management expertise. Whilst the quality of service delivery offered by a potential partner is of critical importance, it is equally important that any partners procured hereby are able to share the two Councils' values and vision. The building blocks for change have now been put in place to secure this transformational agenda. Both Oldham and Rochdale are already at the forefront of developing and delivering innovative strategies focused on delivering economic and urban renewal. II.2) Quantity or scope of the contract
II.2.1) Total quantity or scope: Development partners for the three
areas will be expected to assist Oldham and Rochdale Councils in:
- Developing quality private and/ or social housing in a range of values
and styles to both encourage local people to stay and to entice new
residents to the area;
- Refurbishment works including gaining consent from home owners for the
works to be done;
- Working with the councils to advise on the spatial plans we are
developing for specific neighbourhoods of both boroughs - you will have
key responsibilities in terms of urban design which both boroughs see as
a critical tool in transforming our neighbourhoods. Furthermore, as the
procurement process proceeds respondents will need to be able to
demonstrate their ability to deliver high quality sustainable
development, for example, those which have achieved high scores under
BREEAM, EcoHomes and NHER.
- Establishing the scale, phasing and scope of redevelopment sites within
the priority intervention areas;
- Progressing developments concurrently in each area;
- Managing property under direction of Oldham and Rochdale Councils -
maintaining, securing and/or demolishing as required;
- Acquisition of land, site preparation and clearance as required;
- Consultation and engagement with home owners and the community, using
the in-house neighbourhood teams where appropriate;
- Landscaping works /Environmental Works - hard and soft landscapes;
- Infrastructure Improvements to roads/footpaths/cycle paths;
- Other building construction work;
- Architectural, engineering, landscape architectural services,
construction, construction project management and related technical
consultancy services;

Consortia will need to be forward looking and to demonstrate expertise
and ability of HMR aims and objectives and the critical role they will
play in facilitating delivery and understanding the impact of the HMR
programmes.
In view of the very extensive wider regeneration programme covering the
two boroughs, it is expected that the consortia will actively participate
in the economic and social regeneration of the locality. Accordingly,
contract performance conditions may relate to social and environmental
considerations.
Any contract awarded will include structured positive actions which
contribute to the contract's objectives in relation to regeneration of
the two Boroughs, through the creation of sustainable employment and
promotion of community cohesion within it.
This framework contract's potential value is unlikely to be less than 10
000 000 GBP per annum in total across the three initial neighbourhoods.
It may quickly accelerate to 50 000 000 GBP per annum in total across
both boroughs.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required: A performance bond or parent
company guarantee or equivalent may be required for any contractual
obligations.

III.2.1) Information concerning the personal situation of the
contractor, supplier or service provider and information and formalities
necessary for the evaluation of the minimum economic, financial and
technical capacity required: The councils and other contracting
organisations intend to operate a pre-qualification stage to assist in
selecting applicants to be invited to proceed to the next stage of the
competition. An information pack and pre-qualification questionnaire will
be sent to each applicant submitting an expression of interest.
Candidates will be evaluated in accordance with criteria for selection
set out at Articles 45 of the Directive of the European Parliament and of
the council on the co-ordination of procedures for the award of public
works contracts, public supply contracts and public service contracts
approved in Brussels on 9 December 2003 and in accordance with their
financial and economic standing, ability and technical capacity.

the exigencies of the existing, secured HMR funding from government, so
that the wholesale benefits can be secured for citizens of both boroughs
as soon as possible.
Though no candidates have been selected, a large number of potential
respondents know of this opportunity and its required timescales.

Both Boroughs have advertised previously for Strategic Service Delivery
Partnerships under two separate procurement exercises - the relationship
between this procurement and each Council's SSDP proposals are explained
in this procurement's Information Memorandum.
The following "Zoned" RSLs of the two boroughs are named as contracting
organisations: SELHAL, MANCHESTER METHODIST, CONTOUR, PORTICO, NORTHERN
COUNTIES, VILLAGES, WEST PENNINE, THE REGENDA HOUSING GROUP, ST VINCENTS
HOUSING ASSOCIATION. ROCHDALE BOROUGHWIDE HOMES, an arms length housing
management company, which is wholly owned by Rochdale Borough Council is
also a contracting organisation to this notice. These contracting
organisations have chosen to participate in this procurement for
framework style arrangements to enable them, when appropriate, to use the
framework contracts hereby procured.
The RSLs will use these frameworks as the first point of recourse when
seeking proposals for development opportunities within the HMR
neighbourhoods for which they have approved Annual Development Programme
(ADP) allocations from the Housing Corporation.
In addition, and in recognition of British Government's recent acceptance
that RSLs do come within the ambit of the EU Procurement regime, these
zoned RSLs within the two boroughs are minded to use frameworks procured
hereby for other work in the two boroughs - that is work outside the
initial HMR neighbourhoods.
When RSLs make use of these frameworks they will contract with the
successful consortia independently from the two Councils.
Land acquisition will be dealt with in the main at the Invitation to
Negotiate (ITN) stage. The ITN will set out the terms on which the
Councils (and RSLs) and the selected consortia will deal with land and
property assets in the form of a land collaboration agreement. It will be
documented that there will be instances where it is appropriate for the
Consortia procured by the Councils to take on responsibility for site
acquisition.
A key objective of the Pathfinder is involvement of residents in decision
making, setting standards and the selecting and monitoring of consortia.
Another key objective is to capitalise on the economies of scale arising
from this partnered procurement and to maximise the continuity of
sequential and incremental work through the consortia, especially in
relation to training, employment and development/ capacity building for
local SMEs.
The two Councils, but not the RSLs, are currently exploring the
possibility that their body of contracts arising from this procurement
will be covered by a project wide "umbrella" of insurance cover.
Though under this Negotiated Procedure Notice no candidates have already
been selected, extensive contact has been made with major potential
providers from construction and development sectors of the construction
industry to ensure market awareness and that these requirements are both
understood on advertisement and viable.
Since the main contracting authorities for this notice are Public
Authorities under the Freedom of Information Act 2000, all information
received in response to it will be dealt with in accordance with that
Act's requirements.
Any contract awarded will include structured positive actions which
contribute to the contract's objectives in relation to regeneration of
the two Boroughs, the creation of sustainable employment and promotion of
community cohesion within it.
All dates, periods, timetables and the financial scope given in this
notice, are provisional and the Contracting Organisations reserve the
right to amend these. Oldham and Rochdale Council, and the other named
participants to this contract notice, reserve the right not to proceed
with any part or the whole of this procurement at any stage of the
process.
