Abstract:   UK-Oldham: Strategic Service Delivery Partnership - (SSDP). Oldham Metropolitan Borough Council is keen to improve the services it commissions for or otherwise provides to its residents, customers and businesses. To that end Oldham Council wishes to enter into one or more long term strategic partnerships with private sector partners in relation to certain Council services and processes. It is looking to procure both a Partner (or Partners) and one or more service contracts. The contract documentation for this procurement lists a large body of services which it is willing to see form part of contractual partnerships via incremental growth over time. Whilst the quality of service delivery offered by a potential partner is of critical importance, it is equally important that any partners procured hereby are able to share the Council's values and Vision. Oldham Council is keen that both itself, as a direct employer, and its service providers, especially under for major contracts, have workforces which represent the demographic make-up of the borough and contribute fully to the borough's regeneration through the creation of sustainable employment and communities as part of its wider drive for Community Cohesion. As part of overall actions to create employment and to secure regeneration, it's keen to make the most of monies offered to the borough by Government especially through the Housing Market Renewal regime (jointly with Rochdale Council and one of nine pilots nationallly), New Deal for Communities, and for Sure Start Children's Centres. It therefore wishes to make economies of scale in procurement of one or more Strategic Service Delivery Partnerships for this body of mainstream Council services. The other organisations named as contracting authorities are subject to the EU Procurement regime to varying degrees, but would wish to participate by buying services when appropriate through the arrangements hereby procured. anticipated as potentially falling within the scope of a partnership
which may be developed incrementally - the services are listed in no
particular order for priority:

within this notice give an indication of the services which might be
brought into the arrangements over the life of the contract(s)
~Relevent ICT provision, and commissioning for any or all of the above,
including technology refreshment for services within the ambit of the
contract but prior to the extension of any incremental change process.
The scope will continue to be further developed and refined as the
procurement develops. But respondants should be clear about the intention
for this contract to be very extensive in scope by awarding incremental
growth in exchange for excellent performance. In essence, the Council is
looking for strategic service delivery partners who are able to
complement it as it seeks a mixed economy where services are delivered by
the most appropriate provider. The contract's potential value is unlikely
to be less than 10 000 000 GBP per annum for "office based" services and
10 000 000 GBP per annum for construction. If the proposition for
incremental partnership proves practicable, these figures might rise
(though not be limited to) 75 000 000 GBP per annum of 'office-based'
services and 50 000 000 GBP per annum of construction programmes.
II.2.2) Options. Description and time when they may be exercised: Oldham
Metropolitan Borough Council envisages retaining an option to renew any
immediately binding contract for five years beyond an initial term.

from the award of the contract.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) Conditions relating to the contract

parent-company guarantee or equivalent may be required for any
contractual obligations.

III.2.1) Information concerning the personal situation of the
contractor, supplier or service provider and information and formalities
necessary for the evaluation of the minimum economic, financial and
technical capacity required: The council intends to operate a
pre-qualification stage to assist in selecting applicants to be invited
to proceed to the next stage of the competition. An information pack and
pre-qualification questionnaire will be sent to each applicant submitting
an expression of interest.
Candidates will be evaluated in accordance with criteria for selection
set out at Articles 45 of the Directive of the European Parliament and of
the council on the co-ordination of procedures for the award of public
works contracts, public supply contracts and public service contracts
approved in Brussels on 9 December 2003 and in accordance with their
financial and economic standing, ability and technical capacity.

VI.4) Additional information: This procurement is being run in parallel
with a seperate procurement by Rochdale Metropolitan Borough Council for
a Strategic Service Delivery Partnership (OJEU) Number - [2004/S
120-101476].
As in that Procurement, the 'other Council', in this case Rochdale
Metropolitan Borough Council, has been named as an additional contracting
authority in this notice in order to retain the flexibility to accomodate
future joint service delivery.
As referred to in section I.1 the other contracting organisations in this
procurement are: Oldham Metropolitan Borough Council on behalf of, and as
Accountable Body for, the Board of Hathershaw and Fitton Hill New Deal
for Communities; First Choice Homes Oldham Ltd - company number 04385522,
an Arm's Length Management Organisation for housing and a company wholly
owned by Oldham Metropolitan Borough Council which provides housing
management and related services to Oldham Council and others under
contract; Oldham Community Leisure Ltd - company number IP29372R, an
independent company which provides leisure services to Oldham
Metropolitan Borough under a contract; Oldham Metropolitan Borough
Council on behalf of, and as Accountable Body for, the Governing Bodies
of the State Funded Schools in the Borough; and Oldham Education,
Business and Guidance Services (OEBGS) - company number 2563094 - a
company functioning mainly in the borough of Oldham to provide
educational, career guidance services and other services under contract
to government and others.
In view of the very extensive wider regeneration programme covering the
Borough, it is expected that the Partnership(s), and their financial and
operational performance management framework, procured hereby will be the
normal arrangements for new build work and refurbishment work, especially
of: office accommodation or other operational buildings for use by the
partnership or outside of it by the council and its other public sector
partners; programmes and specific projects especially under the Housing
Market Renewal Pathfinder Pilot; New Deal for Communities and Sure Start
Children's Centres.
Though the joint Oldham/ Rochdale Housing Market Renewal Pathfinder
Pilot, and the Hathershaw/ Fitton Hill New Deal for Communities each has
a governance body which determines the allocation of spending programmes,
Oldham Council is the formal Accountable Body for both.
The Council would seek to identify, as the procurement develops, when, as
part of the wider regeneration programme such works may partly or wholly
be undertaken by another party and not the Strategic Service Delivery
Partner(s).
Oldham Metropolitan Borough Council envisages that a proportion of its
requirements could be delivered jointly to Rochdale Metropolitan Borough
Council by a contractor appointed pursuant to this call for competition.
Although this is not a joint procurement for services, candidates may be
assessed on their ability to deliver services across both contracting
authorities as part of the pre-qualification exercise. Tenders may also
be evaluated in terms of joint working proposals for Oldham Metropolitan
Borough Council and Rochdale Metropolitan Borough Council.
It is possible that several contract awards may be made, including
contracts with each Council individually and contracts with both
Council's jointly. Therefore the scope of any ultimate contract with
Oldham Metropolitan Borough Council alone may well be smaller than the
full range of services outlined in this notice.
Unlike the Rochdale procurement, here in Oldham a number of the Council's
other partners (FCHO, OCLL, OEBGS, Schools' Governing Bodies) within the
borough wished to go through the procurement process with Oldham Council
to ascertain whether they also and at the same time could buy similar
services, or to identify a body of operational and financial performance
management arrangements to proceed from without the need for them to
undertake a series of future individual procurements.
"The Oldham Partnership", the Local Strategic Partnership in the Borough
under the Local Government Act 2003, is a partnership of 10 thematic sub
partnerships where Oldham Council meets with many of its partners to
improve the Borough carrying through the "Community Strategy". Whilst
public sector bodies corporate other than those named as contracting
authorities are not full participants in this notice, a climate is
beginning to develop within the Borough which might subsequently extend
the scope of this contract outside the boundaries of direct Council
services to offer, for example, public access to information across
organisations or to use common procedures and processes. The references
within this notice to the Council's objective of procuring both a
development partner and a service contract structure capable of
incremental growth are particularly relevant in this respect.
Though under this Negotiated Procedure Notice no candidates have already
been selected, extensive contact has been made with major potential
providers from both the office based professional service and
construction development sector to ensure that these requirements are
both understood on advertisement and viable. The services are being
procured by one notice to explore possible economies of scale.
This notice, and OJEC Notice [2004/S 120-101476] precede for issue a
separate and subsequent notice, expected to be published jointly by
Oldham and Rochdale Metropolitan Borough Councils in August or September
2004 under the Accelerated Negotiated Procedure. That notice will invite
expressions of interest to perform work within the initial waves of our
joint Housing Market Renewal Pathfinder from 2005 onwards until the scope
of the two Boroughs Strategic Service Delivery Partnerships are fixed and
operational.
Potential candidates wishing to work on HMR activity in Oldham and
Rochdale in the long term will need to reply to both this notice, and to
the Accelerated Procedure Notice to be published later in the year. Every
attempt will be made to use a common pre-qualification procedure between
the two procurements.
The Council has considered the Office of the Deputy Prime Minister
Circular 03/2003 the UK Government's Code of Practice on Work force
Matters issued to Local Government and considers that those protections
for staff in the event of a staff transfer will be obligatory. Any
transferring staff must be offered entry into the Local Government
Pension Scheme or an equivalent set of Pension Arrangements.
Interested service providers' attention is drawn to the requirements of
the Transfer of Undertakings (Protection of Employment) Regulations 1981
and the Acquired Rights Directive.
Since the main contracting authority for this notice is a Public
Authority under the Freedom of Information Act 2000, all information
received in response to it will be dealt with in accordance with that
Act's requirements.
Any contract awarded will include structured positive actions which
contribute to the contract's objectives in relation to regeneration of
the Borough, the creation of sustainable employment and promotion of
community cohesion within it.
All dates, periods, timetables and the financial scope given in this
notice, especially those relating to the opening of tenders, are
provisional and the Council reserves the right to amend these.
Oldham Council, and the other named participants to this contract notice
reserve the right not to proceed with any part or the whole of this
procurement at any stage of the process.
