Abstract:
Title attributed to the contract by the contracting authority: Education and Library Board Strategic Partnership. The aim of the project is to establish a strategic partnering contract through which the Authority and the preferred private sector contractor will service, manage and modernise the entire estate controlled by the Authority. The aim is to create environments where the teaching and learning experience is positive and progressive and make a significant contribution to the promotion of community access and involvement and the delivery of life-long learning for all of the people of Belfast. The estate controlled currently by the Authority consists of 17 nursery schools, 45 primary schools, 10 post primary schools, 11 special schools, 37 youth clubs, 21 libraries, 2 teacher resource centres, 2 outdoor education centres and headquarters facilities. It is envisaged that this will be achieved through a series of long-term arrangements awarded during the partnering contract period using a Design, Build, Finance, Operate and Maintain (DBFOM) approach and/or a Design, Build, Operate and Maintain (DBOM) approach. The first tranche of services and works is to be awarded on an exclusive basis to the preferred private sector contractor and this tranche may include ten schemes to be delivered using the DBFOM approach and one scheme to be delivered using the DBOM approach. Additional information on the first tranche of services and works will be set out in the Project Information Memorandum. It is envisaged, but not guaranteed, that subsequent tranches of services and works will be rolled out (subject to benchmarking and regular market testing of the supply chain) over the partnering contract period on a non-exclusive basis to the preferred private sector contractor and will cover potentially the remainder of the estate controlled by the Authority. The services and works procured under the DBFOM and DBOM models may include: demolition and/or refurbishment of existing buildings, design and construction of new accommodation, the provision of sports facilities, community facilities and recreational areas, buildings and grounds maintenance. They may also include the supply and maintenance of furniture and equipment, and the provision of a range of facilities management services such as caretaking, waste management, security, energy management, cleaning and catering. In addition, the preferred private sector contractor may take responsibility for the management, planning and delivery of estates maintenance services such as buildings maintenance, grounds maintenance, waste management, energy management, and security to the controlled estate for an initial period of up to seven years (subject to the expiry of existing arrangements) with an option to extend the service period for up to a further three years (the Estates Management Contract). This may include the provision of some or all of these services to the maintained estate (subject to the statutory responsibilities of the Authority). There are approximately 80 schools in the maintained estate. The Estates Management Contract is likely to be structured as a call off arrangement in terms of time and materials and as part of this arrangement, the preferred private sector contractor may also be required to provide ancillary services to the controlled estate. II.2.1) Total quantity or scope: The estimated capital value of the
schemes within the first tranche of work (including professional fees but
excluding value added tax) is in the region of 125 000 000 GBP in
aggregate.
The potential estimated capital value of the possible schemes within any
subsequent tranches of work over the remainder of the partnering contract
period (including professional fees but excluding value added tax) may
amount to a maximum of 500 000 000 GBP in aggregate.
The estimated annual value of the estates maintenance services to be
delivered under the Estates Management Contract is in the region of 19
000 000 GBP in aggregate. This total amount consists of 4 000 000 GBP in
relation to minor works, 11 000 000 GBP in relation to planned
maintenance, and 4 000 000 GBP in relation to reactive maintenance.
The estimated annual value of the ancillary services that may be
delivered under the Estates Management Contract is in the region of 16
000 000 GBP in aggregate.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required: The Authority reserves the
right to require deposits, guarantees, bonds or other forms of
appropriate financial security. Any such requirements will be detailed in
the Invitation to Negotiate.
III.1.2) Main terms of financing and payment and/or reference to the
relevant provisions: The DBFOM arrangements will be financed by third
parties on a limited recourse basis and the payments made by the
Authority will be based on a performance related unitary charge. The DBOM
arrangements will be financed by the public sector and again the payments
made by the Authority will be linked to performance. Further details will
be provided in the Invitation to Negotiate.
III.1.3) Legal form to be taken by the grouping of suppliers,
contractors or service providers to whom the contract is awarded: The
Authority is seeking a private sector contractor that will take
responsibility for the project as a whole and where necessary manage a
supply chain of subcontractors and service providers. No special legal
form is prescribed, but the Authority reserves the right to require one
organisation to have primary contractual liability for the project and/or
to require that one or more organisations undertake joint and several
liability.

VI.4) Additional information: A Project Briefing Day will be held in the
Belfast Education and Library Board on Friday 14.5.2004, commencing at
10.00 am. The briefing day will consist of a series of formal
presentations, together with details of the arrangements for visiting
each of the sites included within the first tranche of works and
services. Organisations wishing to attend the briefing day are required
to contact Mr.Stephen Boyle (at the address set out in Section I.1 above)
before 5,00pm on Monday 10.5.2004 so that registration details can be
taken and a location map supplied- Organisations unable to attend the
briefing day may obtain copies of the briefing day materials by writing
to Mr.Stephen Boyle (at the address set out in Section I.1 above).
The Project was announced by the Economy and Finance Minister in February
2003 and is an important part of the Strategic Investment Programme. The
project is being supported formally by the Strategic Investment Board and
the Department of Education. The Outline Business Case for the project
has been approved by the Department of Education, the Strategic
Investment Board and the Department of Finance and Personnel.
It is anticipated that the strategic partnering contract will be awarded
in December 2005. The strategic partnering contract will be for an
initial period of 7 years with the option to extend for up to a further 3
years. The DBFOM and DBOM project contracts, and the Estates Management
Contract, to be rolled-out under the strategic partnering contract, will
be long term arrangements under which works and services will be
delivered in respect of those projects, for periods of up to 30 years in
respect of the DBFOM and DBOM contracts, and up to 10 years in respect of
the Estates Management Contract.
The Authority reserves the right not to award any contract, or to award
some or all of the strategic partnering, DBFOM, DBOM and Estates
Management Contracts.
