SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s)
A framework of pre-qualified and suitably experienced contractors to
enable participating local authorities and other organisations to instruct
design and construction activities in relation to schools and any other
public buildings. The contracts allocated under the framework may include
refurbishment and/or new build, and may involve single site projects, or
groups of sites, including groups involving more than one authority. The
framework will be divided into lots, to achieve a range of contractor
sizes and abilities in keeping with the anticipated range of projects.
Continuous improvement, collaboration and measurement by key performance
indicators are likely to be features of the framework.
The participating Authorities and other organisations are committed to
contributing to the social, economic and environmental well-being of the
wider community. Accordingly, while the requirement may not be mandatory,
the successful contractors will be expected to consider opportunities to
recruit and train long term economically inactive persons as part of the
workforce delivering this project. Specific requirements will be detailed
within the mini tender documents which will also state whether the
requirement is core or non core.
The participating Authorities are:
Blaenau Gwent County Borough Council, Bridgend County Borough Council,
Caerphilly County Borough Council, Cardiff Council, Merthyr Tydfil County
Borough Council. Monmouthshire County Council, Newport City Council,
Rhondda Cynon Taf County Borough Council, Torfaen County Borough Council,
and the Vale of Glamorgan County Borough Council. In addition the Roman
Catholic Arch Diocese of Cardiff, The Monmouth Diocesan Trust and The
Church in Wales Diocese of Llandaff will also have the opportunity to
utilise the arrangement.
Tenderers should note that although the lead authority for the purposes of
this procurement is Rhondda Cynon Taf CBC, other contracting organisations
(as defined in Regulation 3 of the Public Contracts Regulations 2006) in
Wales, such as government departments, agencies, local and emergency
authorities (police and fire), educational establishments, may choose to
use the framework agreement, without creating an obligation on them to do
so. In that event, the contractual relationship will be between the
individual contracting authority using the framework agreement and any
successful contractor.

II.2.1) Total quantity or scope
A series of Framework Agreements (5no.) will be awarded for South East
Wales Schools and Public Buildings Contractor Framework (SEWSCAP). Total
estimated spend across all 5 Lots is 400 000 000 GBP.
Candidates must specify in their PQQ responses which Lots they wish to be
selected to bid for. Contractors will be appointed to a maximum of four
Lots. The Lots are as follows (NB the values stated relate to values of
individual projects, not total value awarded under each Lot. The
authorities reserve the right to award any value of projects under a Lot
within the overall 400 000 000 GBP estimated scope, or no projects at
all):
Lot 1: Minimum Value: 1 500 000 GBP, Maximum Value: 3 000 000 GBP -
maximum number of Contractors: 10.
Lot 2: Minimum Value: 3 000 000 GBP, Maximum Value: 5 000 000 GBP -
maximum number of Contractors: 6.
Lot 3: Minimum Value: 5 000 000 GBP, Maximum Value: 10 000 000 GBP -
maximum number of Contractors: 5.
Lot 4: Minimum Value: 10 000 000 GBP, Maximum Value: 25 000 000 GBP -
maximum number of Contractors: 5.
Lot 5: Minimum Value: 25 000 000 GBP, Maximum Value: 100 000 000 GBP -
maximum number of Contractors: 5.
Please be advised that all Lots will include all refurbishment and build
options and could include Volumetric content if deemed appropriate.

organisations reserve the right to let contracts under the framework for

The procurement process will be conducted via the Alito Procurement Portal
and any organisation wishing to express an interest in tendering must do
so via this portal. Registration on the Alito Procurement Portal is free
and guidance is available by e-mailing the following address:

This is a restricted process and successful organisations will be
shortlisted from the pre qualification stage and invited to participate at
Tender stage.
A PQQ must be completed and returned with the request to participate.
The PQQ document can be downloaded via the Alito website. This document
and any supporting attachments must be submitted back through the Alito
System.
The deadline date for return of the PQQ is 6.10.2010 (12:00). The
contracting authority will not accept PQQs after this date.
The deadline for the tender return will be advised accordingly.
In order to streamline this pre qualification stage, interested parties
may use their Constructionline accreditation to demonstrate appropriate
elements of the pre qualification criteria as set out in the PQQ.
Constructionline is the UK Government national pre qualification register
for construction contractors. Existing Constructionline members will only
need to supply their registration number and their notation value for each
area of interest and complete the supplementary questions on the PQQ. Non
- members of Constructionline will be required to complete the full
questionnaire.
All tender costs and liabilities incurred by bidders shall be the sole
responsibility of bidders.
The contracting authority reserves the right to award the contract in
whole or in part.

process and not award any contract.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals
Precise information on deadline(s) for lodging appeals: The Authority will
allow a minimum 10 calendar day standstill period between notifying the
award decision and awarding the contract. Unsuccessful tenderers and
applicants are entitled to receive reasons for the decision, including the
characteristics and relative advantages of the winning bid and the reasons
why the tenderer/applicant was unsuccessful. Should additional information
be required it should be requested of the addressee in section I.1.
Aggrieved parties who have been harmed or are at risk of harm by bre ach
of the procurement rules have the right to take action in the High Court
(England and Wales). Any such action is subject to strict time limits and
must be brought in accordance with the Public Contracts (Amendments)
Regulations 2009.
