The framework will last for a maximum 48 month (4 year) period. It will
carry with it no exclusivity or guarantees of works, but is expected to
form the main framework for the commissioning of planned maintenance and
minor and major works for the Council. Access to the framework will be
granted to all Council Services, all Hertfordshire state maintained
schools, North Herts District Council, Three Rivers District Council,
Broxbourne Borough Council, East Herts District Council, St. Albans
District Council, Hertsmere Borough Council, Stevenage Borough Council,
Welwyn Hatfield District Council, Dacorum Borough Council, Watford Borough
Council, Stevenage Housing Association and Hertfordshire Constabulary

SECTION VI: COMPLEMENTARY INFORMATION
VI.3) ADDITIONAL INFORMATION
The contracting authority considers that this contract may be suitable for
economic operators that are small or medium enterprises (SMEs). However,
any selection of tenderers will be based solely on the criteria set out
for the procurement, and the contract will be awarded on the basis of the
most economically advantageous tender.
Hertfordshire County Council (hereinafter referred to as the Council)
manages a diverse portfolio of property which supports the delivery of a
wide range of services to residents of Hertfordshire, including:
Children’s Services, Libraries, Fire and Rescue Service, Adult Care
provision and office accommodation. The Council also acts as the corporate
landlord for a large number of schools across the County. Including
schools across the County the property portfolio in June 2010 totalled
1,942 buildings with a cumulative value of £2.32bn.
The Council wishes to appoint a range of contractors to an agreed
framework covering a wide range of building and construction services. The
total amount of expenditure in 2009/10 against these types of works by the
Council and by schools was in the region of £16.3m.
The framework will last for a maximum 48 month (4 year) period. It will
carry with it no exclusivity or guarantees of works, but is expected to
form the main framework for the commissioning of planned maintenance and
minor and major works for the Council. Access to the framework will be
granted to all Council Services, all Hertfordshire state maintained
schools, North Herts District Council, Three Rivers District Council,
Broxbourne Borough Council, East Herts District Council, St. Albans
District Council, Hertsmere Borough Council, Stevenage Borough Council,

Each lot will cover a wide range of values of works, banded as follows:
— 0 GBP - 10 000 GBP,
— 10 000 GBP - 50 000 GBP,
— 50 000 GBP – 500 000 GBP.
Applicants are asked to indicate which bands in which lots they are
applying to deliver. Bids are not restricted to single bands and/or lots.
Works will be commissioned from the framework through mini competition.
Ongoing performance information will be collected. Successful applicants
will also be expected to remain active through engaging in
mini-competitions for works. The Council retains discretion to refresh
LOTS within the framework during its life.
The award criterion for this agreement will consist of a price/quality
split, price 70 % and quality 30 %, more detailed award criteria will be
provided within the tender documentation should you be successful through
to the tender stage.
Bidders day.
HCC will be holding a bidders day on the 20.9.2010 at County Hall,
Hertford, to present the aims of the Hertfordshire Property Procurement
Programme to potential participants. Interested parties may register for
this event by completing the online registration form available on the

Mandatory pass/fail questions.
Financial Details:
Applicants are advised that the Council will be carrying out a financial
assessment of all applicants, including an Experian check of their Audited
Accounts. Applicants that are deemed unsuitable as a result of this
financial assessment may not be taken forward to the tender stage.
Due to the current economic climate, Hertfordshire County Council reserves
the right to carry out additional financial checks on all organisations
tendering for this Contract at any time during the procurement process, to
ensure that they continue to meet the Council's requirements and remain
financially viable to perform the Contract.
Insurance details.
In relation to the insurance details section of the PQQ, the Council
requires for this contract a minimum per incident of:
Employers liability insurance: 10 000 000 GBP.
Public liability insurance: 5 000 000 GBP.
Professional indemnity insurance: 5 000 000 GBP – for asbestos analytical
works only.
Applicants must state that they either have these levels already or would
be willing to obtain these levels before being awarded any contract.
In addition to the details required above, the following sections within
the pre-qualification questionnaire also have a pass / fail result:

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals
Precise information on deadline(s) for lodging appeals: Hertfordshire
County Council will incorporate a minimum 10 calendar day standstill
period at the point information on the award of the contract is
communicated to tenderers.
If a complaint between the Council and the tenderer regarding the award of
a contract has not been successfully resolved the Public Contracts
Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have
been harmed or are at risk of harm by a breach of the rules to take action
in the High Court (England, Wales and Northern Ireland). Any such action
must be brought promptly (generally within 3 months). Where a contract has
not been entered into the Court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the Court may award damages
or declare the contract ineffective. Tenderers are advised to seek
independent legal advice in relation to remedies they can pursue under the
Public Contracts Regulations 2006 (SI 2006 No 5).
