Justification for a framework agreement, the duration of which exceeds 4
years: cost and complexity of such systems require a continuous and
relatively long follow-up of their implementation. Furthermore, if GSC
decides to extend SIEM to other networks, then interoperability will be
mandatory and impose longer duration. Therefore, the duration of the
contract can not be less than 5 years.

Supply of security information and event manager (SIEM) systems to
collect, consolidate, normalise and archive logs generated by different
equipment within the secured networks and non-secured networks of the
General Secretariat of the EU. The framework contract will also include
the installation, maintenance and training for the SIEM systems.

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:

whom the contract is to be awarded:
Participation is open to any natural person, corporate body or public
entity or grouping of these entities.
1. Groupings:
If a grouping is awarded the contract, it does not need to take a
particular legal form for contract performance.
However, all grouping members (i.e., lead company and all other partners)
must be jointly and severally liable vis-à-vis the contracting authority
and undertake jointly to perform the contract.
Groupings must state the name of the lead company (joint representative)
and the sole contact person, responsible for the follow-up of the
procurement procedure. They must also submit a copy of the documents
(proxy) authorising this company and its legal representative to submit a
request to participate, to tender or to sign a contract on behalf of the
grouping.
All members of the grouping must provide the documents indicated in points
III.2.1, III.2.2, III.2.3 and III.1.4.
2. Subcontracting:
Candidates who make use of the capacities of other entities in respect of
subcontracting must indicate in their request to participate the
proportion of the contract which will be subcontracted and the name of the
proposed subcontractor(s).
An undertaking from each subcontractor must be provided, clearly stating
their intention to collaborate with the candidate if awarded the contract
and mentioning the resources they will make available to the candidate for
contract performance.
Subcontractors must also provide the documents indicated in points
III.2.1, III.2.2, III.2.3 and III.1.4.
3. Information updating:
The contracting authority needs to be notified in the event of any change
in the partnership — grouping or subcontracting — conditions.
The Secretariat reserves the right to request, again, the documents
indicated in III.2.1, III.2.2, III.2.3, and III.1.4 at any time during the
procedure.
III.1.4) Other particular conditions to which the performance of the
contract is subject:

Description of particular conditions:
1. Working language: the usual working language for service provision
shall be English or French.
2. Personnel security clearances for installations and company personnel:
2.1 Personnel security clearance:
Personnel security clearances at the level of 'Secret UE', or the national
equivalent issued by a EU Member State's national security authority
(NSA)/designated security authority (DSA) or any other competent security
authority, shall be required for contractors or subcontractor's personnel
with access to information classified 'Confidentiel UE' and 'Secret UE'.
Contractors or subcontractor's personnel entering Class I or Class II
zones within the Council's premises shall have a PSC at the level of
'Secret UE'. Personnel security clearances must be valid when the contract
is signed. NATO personnel security clearances are not accepted.
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers:
Information and formalities necessary for evaluating if requirements are
met:
1. Exclusion conditions:
In accordance with Articles 93 and 94 of the Financial Regulation
applicable to the general budget of the European Union, candidates will be
excluded from participating in the contract if they:
(a) are bankrupt or being wound up, are having their affairs administered
by the courts, have entered into an arrangement with creditors, have
suspended business activities, are the subject of proceedings concerning
those matters, or are in any analogous situation arising from a similar
procedure under national laws or regulations;
(b) have been convicted of an offence concerning their professional
conduct by a judgment which has the force of 'res judicata';
(c) have been guilty of grave professional misconduct proven by any means
which the contracting authorities can justify;
(d) have not fulfilled their obligations to pay social security
contributions or taxes in accordance with the legal provisions of their
country of residence or with those of the country of the contracting
authority, or those of the country where the contract is to be carried
out;
(e) have been the subject of a judgment which has the force of 'res
judicata' for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Union's financial interests;
(f) are currently the subject of an administrative penalty (exclusion from
contracts financed from the budget of the European Union for a maximum
period of 10 years):
— either because they have been guilty, during another contract procedure,
of misrepresentation in furnishing the information required by the
contracting authority in order to take part in the contract in question,
or have not furnished said information,
— or because they have been declared to be in serious breach of contract
following another contract procedure.
In addition, candidates will be excluded from contract award if, at the
time of the procurement procedure for this contract, they:
(g) are in a situation where interests conflict;
(h) are guilty of misrepresentation in furnishing the information required
by the contracting authority in order to take part in the contract, or
have not furnished said information.

2. At the stage of the request to participate:
Candidates must enclose with their request to participate:
— a declaration on their honour, duly signed and dated by a legal
representative of the company (a document must be submitted proving this
person's powers of signature), clearly specifying that they are not in any
of the situations mentioned in points (a), (b), (c), (d), (e), (f), (g)
and (h).
The form for this solemn declaration is available on the Consilium
Tendering website (https://tendering.consilium.europa.eu/forms.aspx). For
candidates submitting their request to participate electronically, the
solemn declaration will be added automatically during electronic
submission,
— a copy of the certificate of enrolment on the professional or trade
register or a statement under oath or a certificate in accordance with
conditions laid down in the Member State in which they reside.
3. At the stage of the award:
The tenderer to whom the contract will be awarded must furnish the
evidence listed hereafter confirming his declaration on honour at the end
of the procedure (within 10 working days of notification of contract award
and before contract signature).
For points (a), (b), (d) and (e), the Secretariat will accept, as
sufficient proof that the tenderer is not in any of the situations
specified in points (a), (b) or (e), an extract from the judicial record
or, failing this, an equivalent document issued by a judicial or
administrative body in the country of origin or provenance, showing that
these requirements have been met. The Secretariat will accept, as
sufficient proof that the tenderer is not in the situation specified in
point (d), a certificate issued by the appropriate body in the country
concerned.
In accordance with national legislation in the country in which the
candidate resides, the aforementioned documents apply to legal entities
and/or natural persons including, should the Secretariat deem this
necessary, company directors or any person with powers of representation,
decision-making or control in relation to the tenderer.
III.2.2) Economic and financial capacity:
Information and formalities necessary for evaluating if requirements are
met:
Candidates must enclose with their request to participate dossier the
documents specified hereafter:
1. copy of the balance sheets and operating accounts, or other supporting
documents, for the past 3 financial years;
2. statement as to overall turnover and turnover for the services referred
to in this contract (supply of specific network security devices and
provision of the associated services), realised over the past 3 financial
years.
NB: the documents submitted must be recent, i.e., less than 6 months old
on publication of this notice.
Insufficient information or the absence of certain documents may lead to
the request to participate being rejected.
III.2.3) Technical capacity:
Information and formalities necessary for evaluating if requirements are
met:
Candidates must enclose with their request to participate dossier the
documents specified hereafter:
1. documents certifying professional standing and technical capability and
possession of relevant professional experience of at least 3 years for the
delivery of the type of supplies required and for the provision of the
type of services required;
2. a list of the most important contracts of a similar nature performed
over the last 3 years. For each reference, this list must contain
information on the client, public or private, the period of execution and
the value of the contract. Candidates must provide, for the most important
contracts mentioned as references, detailed information on the nature and
volume of services/supplies provided;
3. a statement on the candidate's average annual manpower and the number
of managerial staff over the past 3 years;
4. academic and professional qualifications (CVs) of persons to be
responsible for service provision, or of a representative group of persons
with similar qualifications to those who will be responsible for
performing the contract. This information concerns persons both
intervening on the Secretariat's site and elsewhere;
5. a description of the candidate's technical and logistical facilities,
and his measures for ensuring the quality of the supplies and services.
NB: the documents submitted must be recent, i.e., less than 6 months old
on publication of this notice.
Insufficient information or the absence of certain documents may lead to
the request to participate being rejected.

This is the third time sequentially that a procedure relating to this
procurement is launched.

1. General remarks:
The aim of this notice is to have interested parties submit requests to
participate (applications). Only those candidates selected on the basis of
the requirements in this notice shall be invited to tender and, thus, will
have been sent the documents relating to the invitation to tender. No
additional documentation is available for candidates at this stage of the
procedure.
There is no charge for taking part in this contract procedure. The
specifications will therefore be available free of charge to those
candidates invited to tender.
Participation in this contract gives neither the right to be awarded the
contract nor to receive any compensation for costs incurred.
The contracting authority is under no obligation to award a contract
subsequent to this notice.
2. Submission of requests:
Parties wishing to participate in this procedure are required to submit a
request to participate comprising all the documents specified in points
III.1.3, III.1.4 and III.2 before the time limit set in section IV.3.4.
The request to participate dossier will preferably also contain a table of
contents listing the documents it comprises.
The request to participate may be submitted electronically or in paper
format.
Unless the candidate or tenderer specifies otherwise, the authentic
version (from a document sent on paper and electronically, in so far as
the paper version is not the original one) shall be the electronic
version.
If several versions of a same document are sent, the authentic version
shall be the last version received.

j. receipt of a confirmation message and then the list of one-time
passwords (see below).
The printed form, duly signed and dated by a legal representative of the
company must be sent to the address in point I.1 above. It must be
accompanied by a copy of any official document (e.g. 'Moniteur', Official
Journal, trade register, etc.) to allow identification of the legal
entity, the address of the registered office and the registration number
with the national authorities, and a copy of the certificate of liability
to VAT, if applicable and if the VAT number does not appear on the
aforementioned official document. A document must be submitted proving
this person's powers of signature.
The application for registration will be dealt with as soon as possible
following receipt of these documents by the General Secretariat of the
Council.
Depending on the delivery time for registered post, it may take up to 2
weeks to receive the list of one-time passwords. Candidates are therefore
requested to complete the registration for the call as soon as possible in
order to receive their list of passwords before the final date for
delivery of requests to participate indicated in point IV.3.4.
NB: registration for the call, as above, does not exempt you from
submitting the full request to participate.
The registration, or any action other than submitting a full request to
participate, shall be considered null and void.
3.2. Electronic submission of requests to participate:
Once the request for registration has been approved, a list of one-time
passwords for the electronic submission will be sent to the candidate.
Candidates must enter a password from this list in order to submit their
request to participate on line.
Requests to participate may be sent in electronic form until 16:30 (local
time in Brussels) on the date indicated in point IV.3.4 of this notice.
