This notice covers lots previously advertised under 2 independent notices
as follows. The Lots are defined and the requirements for application are
detailed separately below.

Please note that lots C1.3, C3, D and F2 previously advertised under the
above notice are discontinued.
Lots A, B, C1.1, C1.2, C2, E1, E2, E3, F1 and G will continue.
Thames Water has established a Qualification System (the "Register") which
forms the basis for the award of contracts and/or framework agreements
covering a range of works and services. For the purpose of obtaining
places on the Register the works and services have been split into
indicative Lots listed as lots A to G below. The contracts and/or
framework agreements ultimately awarded may be for individual Lots or a
combination of one or more lots.
This notice is a request for expressions of interest for places on the
register. Applications may be made for one, several or all Lots. Thames
Water will consider how Lots may be combined (if at all) subject to
responses received from applicants and in particular where this is
considered to offer economic advantage. When responding to this Notice
applicants should therefore consider whether they believe there may be
such an advantage in combining lots and make their application
accordingly. Where an application is made for more than one Lot, the
places for the applicant on the Register will be allocated individually
for each lot applied for. For example if an application is made for lot A,
lot B and lot D (whether combined or not) the places will be allocated for
lot A, lot B and lot D individually.
The final decision on any combination of lots for the purpose of awarding
framework agreements and/or contracts will be at Thames Water’s sole
discretion. Thames Water reserves the right not to award framework
agreements and/or contracts for one or more lots. Companies may apply
individually and/or provide joint venture or consortium applications.
Companies applying individually should note that before the time of tender
there may be an opportunity for them to form a joint venture or consortium
with other companies who have qualified for a place on the register (see
section VI.2 below for further information).
Thames Water anticipates awarding framework agreements and contracts of up
to (but not limited to) 10 years duration.
Thames Water anticipates awarding some framework agreements and contracts
covering discrete parts of Thames Water’s operational area.
Thames Water will decide by which of several possible delivery routes a
particular project is delivered.
Organisations already working with Thames Water under any other
arrangement must still apply for registration to this qualification system
in order to participate in competitions for framework agreements and
contracts falling within the scope of this notice.
Lot n° A.
Network programme contracts. Design and construction of works on water
mains, sewers, pipelines, tunnels, reservoirs, small network pumping
stations, and the like. Includes programme management. Contracts and
framework agreements will be formed by competition/negotiation from within
this register. Contracts may range in size, including but not limited to
programmes of up to 350 individual work packages, total value of
individual contracts indicatively up to but not limited 350 000 000 GBP,
duration up to but not limited to 5 years. Total value of potential
contracts and framework agreements within a discrete part of Thames
Water’s operational area over a five year period is indicatively up to but
not limited to 1 000 000 000 GBP.
Lot n° B.
Process programme contracts. Design and construction of works on sewage
treatment works, water treatment works, pumping stations, reservoirs and
the like. Includes programme management. Contracts and framework
agreements will be formed by competition/negotiation from within this
register. Contracts may range in size, including but not limited to
programmes of up to 350 individual work packages, total value of
individual contracts indicatively up to but not limited to 350 000 000
GBP, duration up to but not limited to 5 years. Total value of potential
contracts and framework agreements within a discrete part of Thames
Water’s operational area over a five year period is indicatively up to but
not limited to 1 000 000 000 GBP.
Lot n° C1.1.
Network repair and maintenance (water). Repair and maintenance works on
clean water network assets and the like. Requires emergency (24 hours 7
days a week) response. Framework agreements will be formed by competition
from within this Register. Framework agreements may range in size,
indicatively from 10 000 000 GBP to 35 000 000 GBP per year.
Lot n° C1.2.
Network repair and maintenance (waste). Repair and maintenance works on
waste water network assets and the like. Requires emergency (24 hours 7
days a week) response. Framework agreements will be formed by competition
from within this register. Framework agreements may range in size,
indicatively from 5 000 000 GBP to 15 000 000 GBP per year.
Lot n° C2.
Developer services. Connection of new customers to the clean and waste
network including standard new connections, small diversions and
reinforcement, new water main and sewer laying, diversion or reinforcement
and the like. May include surveying, CCTV, issue resolution, repair or
relay of the customer’s supply pipe, and the like. May include design.
Framework Agreements and contracts will be formed by
competition/negotiation from within this Register. Framework Agreements
may range in size, indicatively from 5 000 000 GBP to 30 000 000 GBP per
year.
Lot n° E1.
Waste network blockages and cleaning. Sewer blockage clearance, manhole
cover replacement and minor sewer repairs, maintenance of sewer
ancillaries, flooding incident response and clear up, rodent control, and
the like. Requires emergency (24 hours 7 days a week) response. Sewer
cleaning and de-silting and the like. May include management of
contractors from lot E2. Framework agreements will be formed by
competition from within this Register. Framework agreements may range in
size, indicatively from 2 000 000 GBP to 20 000 000 GBP per year.
Lot n° E2.
Waste network blockages and cleaning (in anticipation of private sewers
coming within Thames Water's responsibility (currently anticipated to be
no earlier than April 2010) Thames Water is seeking applications from
network contractors for small scale works. It is possible that these
contractors will work together in consortia or as subcontractors to a
contractor in Lot E1 or E3). Sewer blockage clearance, manhole cover
replacement and minor sewer repairs, maintenance of sewer ancillaries,
flooding incident response and clear up, rodent control, and the like.
Requires emergency (24 hours 7 days a week) response. Sewer cleaning and
de-silting and the like. Framework agreements will be formed by
competition from within this register. Framework agreements may range in
size, indicatively from 0.1m GBP to 2 000 000 GBP per year.
Lot n° E3.
Waste network blockages and cleaning (managed service). Sewer blockage
clearance, manhole cover replacement and minor sewer repairs, maintenance
of sewer ancillaries, flooding incident response and clear up, rodent
control, and the like. Requires emergency (24 hours 7 days a week)
response. Sewer cleaning and de-silting and the like. May include
management of contractors from Lot E2. To provide a complete service based
on a service level agreement. Framework agreements will be formed by
competition from within this register. Framework agreements may range in
size, indicatively from 2 000 000 GBP to 40 000 000 GBP per year.
Lot n° F1.
Revenue metering. Surveying, installation or exchange of domestic, and
commercial meters and the like. May include one or more associated
services such as provision of meters, flow and pressure device data
logging and telemetry, investigation of revenue meter details to enable
customer accounts to be established, field work verifying customer data
and asset data, checking empty properties, and the like. Framework
agreements will be formed by competition from within this register.
Framework agreements may range in size, indicatively from 5 000 000 GBP to
30 000 000 GBP per year.
Lot n° G.
Support services. Design, programme management, consulting services,
customer service, plant and equipment providers, technology providers, and
the like. No framework agreements or contracts will be formed under this
lot but applicants gaining a place on the register having expressed an
interest in this lot will be able to participate in competitions for any
of the other lots as part of a consortium or joint venture formed with
other qualified companies on this register.

Please note that previously advertised Lots 1, 3, 4, 6, 7, 8, 9, 10, 12,
24 and 25 are discontinued.
Lots 2, 5, 11, 19, 20, 21, 22, 27, 28, and 29 will continue, and lot 30 is
added.
In the lot descriptions, agreements means commercial arrangements under
which individual contracts may be placed, TWUL will decide by which of
several possible delivery routes a particular project is delivered.
Lot no 2.
Process contracts. Construction works on sewage treatment works, water
treatment works, pumping stations, reservoirs and the like. Agreements and
contracts will be formed by competition from within this register.
Individual contracts may be of any value.
Lot no 5.
Network contracts. Construction works on pumping stations, water mains,
sewers, pipelines, tunnels, reservoirs and the like. Agreements and
contracts will be formed by competition from within this register.
Individual contracts may be of any value.
Lot no 11.
Customer side leakage. Surveying, issue resolution, repair or relay of the
customer’s supply pipe, and the like. Performance Partnering. Agreements
and contracts will be formed by competition from within this register.
Lot no 19.
Engineering consultancy. Engineering consultancy to support one or more of
other lots or the like. Agreements and contracts will be formed by
competition from within this register.
Lot no 20.
Leak detection consultancy. Leak detection and pressure management
consultancy to support one or more of the other Lots or the like.
Agreements and contracts will be formed by competition from this register.
Lot no 21.
Leak detection services. Field work involving open sounding, leak
correlation, noise logging, step testing and the like. Agreements and
contracts will be formed by competition from within this register.
Lot no 22.
Quantity surveying services. Estimating, cost management, and cost and
planning services to support other Lots and the like, Agreements and
contracts will be formed by competition from within this register.
Lot no 27.
Environmental consultancy. Environmental consultancy to support one or
more lots and similar services. Agreements and contracts will be formed by
competition from within this register.
Lot no 28.
Town planning consultancy. Town planning consultancy to support one or
more of the other Lots or similar services. Agreements and contracts will
be formed by competition from within this register.
Lot no 29.
Large pipe and fittings supply contracts. Supply of pipe and fittings for
water mains, sewers, pipelines and the like. Individual contracts may be
any size, indicatively greater than 250 000 GBP. Agreements and contracts
will be formed by competition from within this register.
Lot 30.
Programme management services. Programme management services to support
any aspect of the capital programme or similar services. Agreements and
contracts will be formed by competition from within this register. Please
note that for this lot, the deadline for the first round of competitions
for framework agreements and contracts, is 20.9.2010.
Applications are invited for any or all of the lots on the register.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS FOR PARTICIPATION
III.1.1) Qualification for the system
Conditions to be fulfilled by economic operators in view of their
qualification: For lots A - H (FA895 construction, operational & service
register, published 24.7.2008), applicants will be assessed for a place on
the register based on their answers to questions 1 to 9 below. Questions
1, 2, 3 and 9 are for information only and will not be scored. The
remaining questions are ranked in descending order of importance as
follows: 4, 5, 6, 7, 8 (4 being the highest ranking and 8 the lowest).
Some questions have several parts and every part of a question should be
answered. If a question or part of a question is not answered then no
score will be given for that question or part of a question. Responses
will be evaluated on the relevance to the Lots applied for and the
capability and capacity demonstrated. A minimum score for a place on the
Register will be set once all applications have been assessed in order to
ensure sufficient numbers of applicants on the register.
All applicants shall respond to 1-9 below where applicable.
1. Advise which Lot(s) your company/joint venture/consortium is applying
for. Max 1 side of A4;
2. Your organisation: State whether an individual application, or joint
venture application or consortium application. For a joint
venture/consortium state the roles of each member of the joint
venture/consortium. State the single named person responsible for this
application. Max 1 side of A4.
If you are applying as a joint venture or consortium the information
requested in questions 3 to 8 should be provided for each joint venture or
consortium member.
3. Provide the legal name of your organisation, address of your registered
office, and details of the locations you operate from. State whether your
company is part of a group or is affiliated in any way with other
companies; if so, provide details of the group company structure or other
company relationships. Provide details of any High Court or County Court
judgments, or similar European judgments decrees or awards, or other
prosecutions within the previous 3 years. Provide audited accounts for the
last 2 years;
4. Health safety and environment performance. Provide details of any
prosecutions, enforcement notices or other statutory notices served on you
at any time during the last 3 years by the Health and Safety Executive,
Environment Agency (or equivalent organisations if not a UK based bidder)
or under any other relevant or equivalent legislation (e.g. planning,
control of pollution, noise pollution, etc). Max 2 sides of A4;
5. Relevant experience. Describe your experience relevant to the Lots
applied for. Provide reference details of contracts undertaken in the last
2 years for requirements similar to those in the lots applied for. For
each contract, describe the parties, scope, value and duration. Max 4
sides of A4 per Lot applied for.
6. Resource levels. Describe the resource levels available within your
company, clearly distinguishing between directly employed/owned and
subcontracted/hired resources. Details provided should include human
resources as well as plant and machinery and other resources required to
undertake the Lots you are applying for. For human resources include a
description such as construction engineer, quantity surveyor, labourer.
For directly employed human resources advise base location. Max 2 sides of
A4;
7. Applicants for Lots A, B & C2 – Describe your experience and how you
have approached carrying out design on previous similar contracts. Max 1
side of A4;
8. Describe the planning tools your company uses. Confirm you are prepared
to use a different planning tool if so nominated by Thames Water. Max 1
side of A4;
9. Where applicants have applied for more than one Lot, provide details of
combination(s) of Lots you recommend, including details of any relevant
experiences, and the economic advantage of such combination(s). Details
should include estimates of economic advantage in financial, operational,
and any other terms. Max 4 sides of A4.
For lots 2 - 30 (FA584 construction, operational and services register,
originally published 17.10.2003), all applicants shall respond to 1-6
below in a maximum of 10 sides of A4.

in managing a varied multi-project capital works programme (Max 2 pages of

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) ONE OR MORE CONTRACTS COVERED BY THE QUALIFICATION SYSTEM ARE
RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY COMMUNITY FUNDS

VI.2) ADDITIONAL INFORMATION
Applications are invited for one or more lots. Thames Water will review
the applications for the various lots and may combine Lots with similar
attributes and applicants together. When combining lots, if an applicant
has expressed interest in a lot which is to be combined with Lots for
which he has not expressed interest, Thames Water may ask the applicant if
he wishes to express interest in the Lots being combined for which he had
not previously expressed an interest.
Responses to this notice will be evaluated. Successful applicants will be
placed on the Register. When a competition for a particular framework
agreement or contract is launched registered applicants will be taken
through a pre-qualification process prior to tender.
In relation to lots A - G, at the initial pre-qualification stage,
registered applicants may either pre-qualify individually or as part of a
consortium /joint venture with other registered applicants. There may be
an opportunity to form consortia / joint ventures during the
pre-qualification phase as set out. in 2 to 4 below.
It is currently envisaged that the pre-qualification process will be as
follows:
1. All registered applicants for the relevant lot or lots will be invited
to pre-qualify;
2. Applicants' responses to the pre-qualification documentation will then
be evaluated. A list of all applicants who have successfully pre-qualified
will then be circulated to those pre-qualified applicants;
3. Pre-qualified applicants will then be advised of how the lots are to be
combined (if at all) for the purpose of awarding the relevant framework
agreement or contract (where this has not previously been advised);
4. Where this has been previously advised pre-qualified applicants will
then be given a period of time to establish (if necessary) consortia or
joint ventures with other pre-qualified applicants and to inform Thames
Water where they have done so (including any changes to existing
consortia/joint ventures). Thames Water reserves the right but is not
bound to undertake a second stage pre-qualification exercise at this point
to evaluate the strength and capability of the joint ventures / consortia
and individual organisations prior to making the final decision on those
who will be invited to tender;
5. Thames Water will then issue the invitation to tender to those
applicants (including consortia/joint ventures) who have been successful
at the end of (4) above.
Applicants should note that this process might require references to be
provided and verified, attendances at meetings, talks and presentations at
no cost to Thames Water Utilities Limited.
The successful contractor(s) will be required to actively participate in
the achievement of social and/or environmental objectives. Accordingly
contract performance conditions may relate in particular to social,
environmental or other corporate social responsibility considerations.
Further details of these conditions will be set out in the contract
documents.
Any agreement resulting from this Notice may be modified to include
further similar requirements at any site under the management of Thames
Water Utilities Limited or its associated companies (subsidiaries, sister,
parent company) within the EU.
This Notice does not preclude Thames Water Utilities Limited or its
associated companies (subsidiaries, sister, parent companies etc) from
issuing other contract notices for specific requirements from time to
time.
Unless specifically stated otherwise, Thames Water Utilities Limited shall
not be responsible for any costs, charges or expenses incurred by
applicants and does not accept liability for any costs, charges or
expenses incurred by applicants, irrespective of the outcome of the
competition, or if the competition is cancelled or postponed.
Thames Water Utilities Limited reserves the right to terminate the
competition (or part of it), to change the basis of and the procedures for
the bidding process at any time, or to procure the project by alternative
means if it appears that the project can be more advantageously procured
by those alternative means. The most economically advantageous or any
tender will not automatically be accepted.
Thames Water Utilities Limited reserves the right to procure any of the
works, services or supplies referred to in this Notice separately.
Thames Water Utilities Limited reserves the right to procure repeat
requirements of a similar nature without a further call for competition
pursuant to Article 40(g) of the Utilities Directive 2004/17/EC.
There is no application form available for completion - companies are
required to respond directly to this Notice. Responses to the Notice
should consist of a maximum of the number of pages stated above of A4
paper. Accounts and copies of certificates should not be submitted in
paper form but should be included on the CD only. Applicants should submit
on a CD only. The envelope must be clearly marked with the Notice
reference number (FA895 or FA584).
Applicants should not include non-requested sales literature with their
applications. Companies who qualify to tender stage may be required to
demonstrate their services in practical trials or presentations at no cost
to Thames Water Utilities Limited. Applicants who fail to supply all of
the information requested in response to this Notice may risk elimination.
Candidates who cannot fully meet all criteria may risk elimination. The
contents of this Notice are sufficient for submissions of
pre-qualification data; all other communications are discouraged.
Applications must be clear and concise and contain all the information
requested in this notice. The format of applicants' responses must be such
that each point is restated and immediately followed by the applicant's
answer. Contracts will be made under UK Law.

VI.3.2) Lodging of appeals
Precise information on deadline(s) for lodging appeals: Thames Water
Utilities Limited will comply with Regulation 33A of the Utilities
Contracts Regulations, 2006.
Thames Water Utilities Limited, in conformity with Regulation 33A, will
not enter into the contract before whichever of the following occurs
first—(a) midnight at the end of the 15th day after the relevant sending
date; (b) midnight at the end of 10th day after the date on which the last
of the economic operators to receive such a notice receives it. The
relevant sending date means the date on which the Regulation 33A(1)
notices are sent to the relevant economic operators, and if the notices

relevant sending date is the date on which the last of the notices is
sent.
Any proceedings for breach of Thames Water Utilities Limited ’s duties
under Regulations 45A and 45B of the Utilities Contracts Regulations must
be brought in the High Court. Where no declaration of ineffectiveness is
sought, such proceedings must be brought promptly (generally within 3
months). Other time limits, prescribed by Regulation 45E apply where a
declaration of ineffectiveness is sought.
Where a contract has not been entered into the court may order the
settling aside of the award decision or order Thames Water Utilities
Limited to amend any document and may award damages. If the contract has
been entered into the Court may declare the contract ineffective, shorten
the contract term, order payment of a civil financial penalty and award
damages.
