II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope
The provision of generic domiciliary care in Stafford (secondary contract)
in accordance with the service specification provided in the tender
documentation and the terms as stated in the conditions of contract.
The contract will be for a period of 3 years commencing 1.4.2011 with the
option to extend for a period of 12 months plus a further 12 months (at
the sole discretion of the County Council).
The estimated value of the contract is based on the potential total
contract period of 5 years, therefore, the value will reduce if the
options to extend the period are not exercised.

description of these options: The initial period is 1.4.2011 to 31.3.2014
(with 2 x 12 month options to extend, therefore options may be taken up
for the period 1.4.2014 to 31.3.2015 and 1.4.2015 to 31.3.2016). The
options will be exercised at the sole discretion of the County Council.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them
Payments may be made following acceptance by the banking agents of the
County Council.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded
No special legal form is required by the grouping of providers but each
provider will be required to become jointly or severally responsible for
the contract before acceptance.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if requirements are
met: The requirements for minimum economic, financial and technical
capacity will be included in the tender documents.
Any tender may be rejected from a company/organisation who interalia:
(a) is bankrupt or is being wound up, where his affairs are being
administered by the court, where he has entered into an arrangement with
creditors, where he has suspended business activities or is in any
analogous situation arising from a similar procedure under national laws
and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding up or administration by the court or of an
arrangement with creditors or of any other similar proceedings under
national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata
in accordance with the legal provisions of the country of any offence
concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which he is established or with those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal
organisation, as defined in Article 2(1) of Council Joint Action
98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in
Article 3 of the Council Act of 26.5.1997 and Article 3(1) of Council
Joint Action 98/742/JHA respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10.6.1991 on prevention of
the use of the financial system for the purpose of money laundering.

III.2.2) Economic and financial capacity
Information and formalities necessary for evaluating if requirements are
met: Financial checks will be undertaken for economic operators using the
Councils current financial assessors n2check (www.n2check.com). Economic
operators will be assessed according to the level of risk stipulated by
n2checkEconomic. Any economic operator being given an above average risk
rating or poorer may be rejected.
Economic operators must not express an interest to supply a single
contract that has a Year 1 annual value exceeding 50 percent of their
previous annual turnover (from last audited accounts). The year 1 annual
value for this contract is 1 906 200 GBP.
Economic operators should hold as a minimum the following insurance levels
or be able to provide with their response, a written statement advising
that should they be awarded the contract they will have the required
levels of insurance in place for the commencement of the contract.
Public liability 5 000 000 GBP.
Employers liability 10 000 000 GBP.
Medical malpractice insurance 5 000 000 GBP.
III.2.3) Technical capacity
Information and formalities necessary for evaluating if requirements are
met:
Economic operators must provide the information requested in the
pre-qualification questionnaire.
Minimum level(s) of standards possibly required
Economic operators must be registered with the Care Quality Commission and
be rated as One Star Adequate or above, rating to be maintained or
improved during the period of the contract. Economic operators must comply
with the National Minimum Standards of the Care Standards Act 2000 and
subsequent relevant legislation. Any additional minimum requirements will
be stated in the pre-qualification questionnaire documents.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals
Precise information on deadline(s) for lodging appeals: The contracting
authority will incorporate a minimum 10 calendar day standstill period (or
15 days where non-electronic or fax methods are used) at the point that an
award decision notice is communicated to tenderers. The award decision
notice will specify the criteria for the award of the contract/framework
agreement, the reasons for the decision, including the characteristics and
relative advantages, the name and score of the successful tender; and will
specify when the standstill period is expected to end or the date before
which the contracting authority will not conclude the contract/framework
agreement. If an appeal regarding the award of a contract/framework
agreement has not been successfully resolved, the Public Contracts
(Amendment) Regulations 2009 provide for aggrieved parties who have been
harmed or are at risk of a breach of the rules to take action in the High
Court (England, Wales and Northern Ireland). Any such action must be
brought promptly (generally within 3 months). The Court may order the
setting aside of the award decision or may order the contracting authority
to amend any document and may award damages. If a framework agreement has
been entered into the Court may make a declaration of ineffectiveness or
may order that the duration of any relevant specific contract be shortened
and additionally may award damages. The time limit for seeking such a
declaration is generally 30 days from notification of the award (either by
award decision notification or contract award notice depending upon the
circumstances) or otherwise 6 months.
