One regional Consultant for O&M Spate Schemes
one National Consultant for O&M Spate Schemes

The Republic of Yemen has received a Grant from the International Development Association (IDA) to cover part of the cost of the Groundwater and Soil Conservation Project (GSCP) and intends to apply portion of the proceeds of the Grant for recruitment of One regional and one National Consultants For O&M Spate Schemes, whose Terms of Reference are given below:

The PCU intends to recruit a team of a regional (Arabic knowing) expert and a national expert for 3 months, to review all the relevant documents, and come up with practical suggestions of cost-sharing for O&M (in cash or in kind) within the framework of the provisions of Water law and other laws, how the O&M of spate schemes could be ensured by WUAs keeping in view Yemen's historic experience with spate irrigation management.

The framework will be based on extensive and documented discussion with the relevant government staff and relevant farmers’ representatives and the focus of the study should be on combining community and government activities, including technical guidance and joint investment (cost-sharing) (and avoid the problems of neglect, fungibility, manipulation, and moral hazard created by attempts to strictly separate user and government responsibilities). It should provide a framework within which government can encourage and support local investment in maintaining and improving irrigation.

The broad responsibilities of this team will include the following:

• Review all relevant documents, data, and articles on O&M of spate schemes in Yemen, including Water Law, its proposed Bye-laws, Cooperative Law, NGO Law for establishing WUA, Tripartite Agreements signed under GSCP for Spate schemes and also earlier agreements such as the water agreements in Lahej and Zabid under IIP,
• Review current government involvement in the O&M of spate irrigation schemes – including an analysis of budget actually spent and also of O&M staff costs.
• Review O&M practices (financing, cost/ labour contribution, work implementation at different levels in the system, links between contribution and actual work) prevalent on various schemes (e.g. IIP – documenting the experiences and performances with the Irrigation Council and experiences in Wadi Mawr ) and in provinces (for example the Lahej and Abyan Governorates which proposed levies for O&M of spate schemes), Traditional Practices of O&M of spate schemes (including non-improved systems), and current O&M situation of the spate schemes implemented in the past (e.g. schemes implemented under LWCP in Shabwa).
• Review experiences of farmers organization operating earth moving equipment;
• Recommend practical suggestions of cost-sharing for O&M (in cash or in kind) within the framework of the provisions of Water law and other laws indicated above, how the O&M of spate schemes could be ensured by WUAs.
• The team will also recommend which kind and size of spate schemes should be provided O&M support by the Government (including districts and governorates) and which by the WUAs – looking at the actual feasibility;
• What kind of support in terms of equipment and training would be required for the WUAs to ensure their O&M activities.
• How the traditional practices of O&M of Spate Structures built by the projects can be strengthened with or without establishment of formal WUAs (e.g. the beneficiary farmers generally maintain the canals which pass through their lands to irrigate these lands, but the practice of O&M of the spate structure in the wadi has practically gone into disuse) – looking also at (international experiences with making earth moving equipments available at reduced cost for instance .
• To examine, in consultation with NWRA, whether the water bye-laws would provide authority for the WUAs to levy fee for O&M or fine for defaulters.
• Although the Tripartite Agreements were signed with the beneficiaries for O&M of the schemes, the implementation of the agreements was very essential. The mission reiterated that even after the structure is built, it is crucial what kind of efforts can be made with the local authorities and farmers to ensure the O&M of these structures.
• To study the local traditional law of “Geberty” by which the O&M of the schemes was ensured

Period of Assignment: Three months

Qualifications: Regional Expert: MSc in Agriculture/Agriculture Economics
National Expert: BSc in Agriculture

Experience: Regional Expert: 5-10 years in Institutional Aspects and/or rural infrastructure O&M of Irrigation - preferably Spate Schemes
National Expert: 3-5 years in O&M of spate schemes

Other Duties: The consultants should interact with GSCP, NIP, NWRA, and Ministry of Local Administration, including inception, interim, and draft final presentations in English. Their duties shall include extensive tour of the Governorates for which transport and DSA will be provided by the project as per the rules
