This Invitation for Tenders follows the General Procurement Notice for
this project ref. 6103-GPN-40019, which was published in the Bank's
Procurement Opportunities (www.ebrd.com), published on 29th March 2010.
The self-governing City of Rustavi, Georgia, has received a loan from the
European Bank for Reconstruction and Development (the Bank) and grants
from BP and Swedish International Development Cooperation Agency SIDA for
a project aimed at improving municipal solid waste management situation
regards to disposal to a landfill site, to be constructed in accordance
with EC Council Directive 1999/31/EC of 26 April 1999 on the landfill of
waste, for the cities of Rustavi and Gardabani.
Rustavi is a city in the southeast of Georgia located approx. 25 km
southeast of the capital Tbilisi. It has a population of 116,000.
Gardabani is a town located approx. 40 km south of Georgia's capital
Tbilisi. It has a population of 20,000.
The Project Implementation Unit ("the PIU") established within the
municipality of Rustavi, hereinafter referred to as "the Employer",
intends using part of the proceeds of the Bank's loan and grants from BP
and SIDA towards the cost of the Rustavi Solid Waste Management Project.
The Employer now invites the sealed tenders from contractors for the
following contract to be funded from part the proceeds of the loan and the
grant: Construction of the new landfill site in Rustavi (including design
and construction of mechanical Waste Sorting Line and Baler)".
Tendering for the Project is open to contractors from any country. The
Project is expected to be implemented from October 2010 to April 2012
(incl. a Defects Notification Period from April 2011 till April 2012).
To be qualified for the award of a contract, tenderers must satisfy the
following minimum criteria:
• The tenderer must be a firm (a single firm or a joint venture,
consortium, or association joint venture, consortium, or association -
JVCA) duly registered at least since May 2005 as per the national law of
their country of residence and accordingly authorised to carry out the
Works specified under this contract. In case of a JVCA this shall apply
for all members of the JVCA
• The Annual Turnover (net of taxes and social security charges) of the
Tenderer as a whole must be at least 5.0 million Euro for each of the
years 2007, 2008 and 2009
• Sufficient liquid working capital for financing the works. The Tenderer,
in case of a JVCA the leading member, shall provide evidence of secured
financing of not less than 0.5 million Euro, in form of cash at hand,
secured irrevocable credit line granted by a reputable bank or other
acceptable form of funds
• The Tenderer, in case of a JVCA the leading member, shall have
successfully completed at least one project of similar nature and
complexity as the tendered Works within the last 5 years, where similar
nature and complexity is defined as construction of a landfill according
to EC Council Directive 1999/31/EC of 26 April 1999 on the landfill of
waste. As successfully completed is defined the issuance of a final
acceptance certificate OR
• The Tenderer as a whole shall have successfully completed at least two
projects in road construction with a minimum construction value of 2.5
million Euro within the last 7 years. Only the portion carried out by the
tenderer will be taken into consideration. In case of a JVCA, at least one
project shall have been implemented by the leading member. As successfully
completed is defined the issuance of a final acceptance certificate

Upon receipt of appropriate evidence of payment of the non-refundable fee,
the documents will promptly be dispatched by courier; however, no
liability can be accepted for their loss or late delivery. In addition,
the documents can be taken by hand at the address as given below after
presentation by the prospective tenderer of an appropriate evidence of
payment of the non-refundable fee. For ease of preparation of the tenders,
part of the documents will also be provided in electronic format. In the
event of discrepancy between electronic and hard copies of the documents,
the hard copy shall prevail.
All tenders must be accompanied by a tender security of 100,000 Euro.
Tender must be delivered to the address below at or before 17 September
2010 at 12:00 Rustavi time. Electronic tender shall not be permitted. Late
bids will be rejected. Tenders will be opened on 17 September 2010 at
12:10 in the presence of the Tenderers' representatives who choose to
attend.
