II.1.5) Short description of the contract or purchase(s):
The Delegation of the European Union to the Republic of Azerbaijan has the
intention to conclude a contract with a company specialised in the
security of persons and premises to which will be entrusted:
the surveillance/protection of the Delegation's office premises, the
Residence of the Head of Delegation as well as staff accommodation as
required.
The company commits itself, by means of the employed personnel, to ensure:
— the surveillance and patrolling of the premises' perimeter to avoid any
intrusion and attack on persons or their belongings; and control visitors'
— pedestrian and vehicle — access to premises,
— the protection of the designated premises by means of a 24/7 emergency
response team that will respond immediately in the event of an incident at
any of the designated premises,
— that the personnel assigned to the contract hold no other additional
job, respect the frequency of requested patrol services, receive
appropriate training and have all relevant equipment for the performance
of the contract,
— that the personnel assigned to the contract is fluent in the
Azerbaijani, Russian and English languages,
— the management and proper and continuous training of the designated and
future guards, as well as the implementation of guarding procedures and
follow-up,
— to limit the work period per day and per month as well as weekly rest
days and other legislation applicable to this type of work to be in
compliance with local legislation,
— the proper functioning and operation of a future EU Delegation VHF radio
communication network linking the designated premises,
— summary reporting of all incidences to the EU Delegation and to assure
that appropriate recordings of all incidents and actions taken by the
company are properly kept and will be responsible for the quality control
of the services provided,
— immediate replacement in case of requested removal of an assigned person
from the contract by the EU Delegation and prior approval before new
deployments,
— that all posts are permanently manned and that, upon request by the EU
Delegation, services provided under this contract can be extended to new
locations or reduced.

Exclusion criteria:
candidates and tenderers shall provide a declaration on their honour, duly
signed and dated, stating that they are not in one of the situations
referred to in Articles 93 and 94 of the Financial Regulation. The
selected tenderer shall provide documentation, as soon as possible and at
the latest when notified of the results of the award decision, attesting
that they are not in one of the positions described in Articles 93 and 94.
Article 93
1. Candidates or tenderers shall be excluded from participation in
procurement procedures if:
(a) they are bankrupt or being wound up, are having their affairs
administered by the courts, have entered into an arrangement with
creditors, have suspended business activities, are the subject of
proceedings concerning those matters, or are in any analogous situation
arising from a similar procedure provided for in national legislation or
regulations;
(b) they have been convicted of an offence concerning their professional
conduct by a judgment which has the force of 'res judicata';
(c) they have been guilty of grave professional misconduct proven by any
means which the contracting authority can justify;
(d) they have not fulfilled obligations relating to the payment of social
security contributions or the payment of taxes in accordance with the
legal provisions of the country in which they are established or with
those of the country of the contracting authority or those of the country
where the contract is to be performed;
(e) they have been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the European Union's financial
interests;
(f ) they are currently subject to an administrative penalty referred to
in Article 96(1).
Points (a) to (d) of the first subparagraph shall not apply in the case of
purchase of supplies on particularly advantageous terms from a supplier
which is definitively winding up its business activities, or from the
receivers or liquidators of a bankruptcy, through an arrangement with
creditors, or through a similar procedure under national law.
2. Candidates or tenderers shall certify that they are not in one of the
situations listed in paragraph 1.
Article 94
A contract shall not be awarded to candidates or tenderers who, during the
procurement procedure for this contract:
(a) are subject to a conflict of interest;
(b) are guilty of misrepresentation in supplying the information required
by the contracting authority as a condition of participation in the
procurement procedure or fail to supply this information;
(c) find themselves in one of the situations of exclusion, referred to in
Article 93(1), for this procurement procedure.
III.2.2) Economic and financial capacity:
Information and formalities necessary for evaluating if requirements are
met:
— copy of documents showing the companies' financial capability: its
overall annual turnover and annual turnover relating to the services to
which this notice relates, realised over the past 3 financial years, as
well as the balance sheets and trading accounts covering this period,
— proof of an annual turnover of at least 400 000 EUR that guarantees the
continuity of the service subject of the tender,
— certificates issued by authorised bodies or solemn declarations
attesting that taxes, duties and social security contributions have been
paid,
— copy of the insurance certificate covering the risks of its activities
(recent receipt for professional risk insurance).
III.2.3) Technical capacity:
Information and formalities necessary for evaluating if requirements are
met:
— the companies' references: name, legal status, address, telephone, telex
and fax numbers, names and functions of members of the managerial bodies
or of the person authorised to represent the company,
— certificates of enrolment in the trade register, in the appropriate
professional register or proof of legal constitution of the company as a
security company for persons and of premises in the country where the
services will be delivered,
— declaration on honour that all personnel assigned to the contract are
holders of a certificate of good conduct issued by the national
authorities,
— copy of the licence authorising the company to provide the requested
services,
— proven experience of the company in the field of security services
during the last 3 years,
— indication of the permanent number of employees of the company and of
the average number of employees over the past 3 years,
— human resources enough, in competence, quantity and professional
experience, to guarantee the quality and the continuity of the service
requested (at least 60 guards),
— average seniority for each category of personnel concerned with the
tender,
— experience and qualifications of the members of the managerial bodies
and of the technical managers and their seniority in the company,
— training given to the personnel in conformity with the objective of the
contract,
— confirmation that all personnel assigned to the contract are fluent in
Azerbaijani, Russian and English,
— experience in directing and training a team,
— experience and qualifications of the members of the managerial bodies
and of the technical managers guaranteeing the quality and the continuity
of the services requested,
— proven experience of services delivered to embassies and/or
international organisations during the past 3 years.

If self-adhesive envelopes are used, again they must be sealed with
adhesive tape and the sender must sign across the tape seal.
