  Recovery Action.  This is notice of the Department of Energy, Golden Field Office award of 15 time and material non-competitive purchase orders to various merit reviewers under various Data Universal Numbering System (DUNS) during the month of November 2009.  The total value of these awards was $68,176.00.  These awards were made under the authority of Federal Acquisition Regulation (FAR) Part 13 Simplified Acquisition Procedures and typically were awarded to small businesses.  These purchases were accomplished under North American Industry Classification System (NAICS) 541690.  The places of performance are typically at the merit reviewer's location and various conference meeting facilities.  The periods of performance are typically one to four months from the date of award.

 

These requirements are for non-personal commercial services and travel expenses for the merit reviewers.  Merit reviewer services are required by the Department of Energy to review proposals submitted in response to Funding Opportunity Announcements for various Alternative Energy Resource Technology Programs.  Merit reviewers also are required to participate in technical merit review meetings to discuss and document results of each individual proposal reviewed and to reach consensus for individual Financial Assistance awards.

 

Rational for using other than a competitive approach:  Merit reviewer services can only be provided from individuals with specialized expert professional experience in the Alternative Energy Resource Program Technology areas of Solar, Geothermal, Biomass, Hydrogen, Wind, Hydro and Industrial Technologies.  The available experts who can provide the required merit review technical services is very limited based on the unique qualifications and specific expertise of the Alternative Energy Resource Technology areas.  The merit review services ultimately lead to the selection of entities to receive Financial Assistance awards which will create new and innovative approaches pertaining to our countries energy needs.  Award to any other sources other than the individuals with specialized expert professional experience in the Alternative Energy Resource Program Technology areas would result in inadequate reviews and recommendations.  Additionally, services are required immediately to support the Department of Energy mission.

 Rational for using other than a Firm Fixed Price approach:

Time & Material (T&M) purchase orders were utilized because the uncertainties involved could not be identified and quantified with reasonable estimates.  A very large volume of financial assistance proposals were expected to be received in conjunction with several new solicitations this year and therefore it was impossible to estimate how many would actually be submitted.  A larger number of financial assistance proposals were received by the Department of Energy this year, many more than in any year prior.  The proposals were also much more involved.  As a result, there was no way to accurately estimate with any accuracy how many hours would be required to complete the individual merit reviews.  Therefore, sufficient factual information did not exist at the time of award to permit the use of a Firm Fixed Price contract.  No other contract type authorized by FAR 16.000 was suitable.  These contractual actions are justified IAW FAR 16.601 Time and Material Contracts.
