ADVANCE CONTRACT AWARD NOTICE (ACAN)

This procurement has been set-aside under the federal
government's procurement Strategy for Aboriginal Business
(PSAB). Only Aboriginal businesses as defined under PSAB are
eligible to challenge the proposed procurement strategy to award
the contract to the named Aboriginal business.

This procurement is set aside from the international
trade agreements under the provision each has for
set-asides for small and minority businesses.

Further to Article 1802 of the Agreement on Internal
Trade (AIT), AIT does not apply to this
procurement.

1. Definition of Requirements

A Regional Individual Standing Offer (RISO) is to be established
to:
Supply and deliver Heating Fuel Oil to CAN/CGSB 3.2-2007 (or
latest) to the Royal Canadian Mounted Police (RCMP) at their
compound located in Old Crow, YT. Delivery includes off-loading
into RCMP tanks.
Estimated usage is for approximately 50,000 litres of Heating
Fuel Oil annually for each of five (5) years starting April 1,
2010 through March 31, 2015. (Estimated total 250,000 Litres)
1.1 Sole source justification
Old Crow, YT is not accessible by road. The Vuntut Gwitchin
First Nation is the only known supplier in location with
capabilities to meet delivery requirement on
as-and-when-requested basis.
2. Exceptions to the Government Contracts Regulations
The following exceptions are being invoked:

April 01, 2010 through March 31, 2015.

4. Estimated Cost
Estimated value CDN $735,000.00 GST/HST included.

5. Contract Authority

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
