Metropolitan area, but there may be instances where this may be required
to be delivered outside of this area.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements

formalities necessary for evaluating if requirements are met: (a) is
bankrupt or is being wound up, where his affairs are being administered by
the court, where he has entered into an arrangement with creditors, where
he has suspended business activities or is in any analogous situation

which the contracting authorities can demonstrate;

accordance with the legal provisions of the country in which he is

organisation, as defined in Article 2(1) of Council Joint Action

Article 3 of the Council Act of 26.5.1972 and Article 3(1) of Council
Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10.6.1991 on prevention of
the use of the financial system for the purpose of money laundering.

III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
(c) an indication of the technicians or technical bodies involved, whether
or not belonging directly to the economic operator's undertaking,
especially those responsible for quality control and, in the case of
public works contracts, those upon whom the contractor can call in order
to carry out the work;
(d) a description of the technical facilities and measures used by the
supplier or service provider for ensuring quality and the undertaking's
study and research facilities;
(e) where the products or services to be supplied are complex or,
exceptionally, are required for a special purpose, a check carried out by
the contracting authorities or on their behalf by a competent official
body of the country in which the supplier or service provider is
established, subject to that body's agreement, on the production
capacities of the supplier or the technical capacity of the service

provider or contractor and/or those of the undertaking's managerial staff
and, in particular, those of the person or persons responsible for
providing the services or managing the work;

that the economic operator will be able to apply when performing the
contract;
(h) a statement of the average annual manpower of the service provider or
contractor and the number of managerial staff for the last three years;
(i) a statement of the tools, plant or technical equipment available to
the service provider or contractor for carrying out the contract;
(j) an indication of the proportion of the contract which the services
provider intends possibly to subcontract;
(k) with regard to the products to be supplied:
(i) samples, descriptions and/or photographs, the authenticity of which
must be certified if the contracting authority so requests;
(ii) certificates drawn up by official quality control institutes or
agencies of recognised competence attesting the conformity of products
clearly identified by references to specifications or standards.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The Council reserves the right not to award
any Contract as a result of the procurement process initiated by this
notice and will not be liable for any costs incurred by candidates.
Interested parties must submit a pre-qualification questionnaire by way of
Expression of Interest. The Council is using the e-business portal known
as The Chest. Applicants will need to register their details at the
following link https://www.thechest.nwce.gov.uk/procontract/supplier.nsf/
frm_home?openForm. Once registered, applicants will be emailed a log-in
and password which will allow applicants to gain access to the
pre-qualification questionnaire. Applicants will need to electronically
submit the completed questionnaire and accompanying documentation via the
on-line portal by 07:00 pm on Monday 19.4.2010, as referred to in IV.3.4.
Any clarification queries will also need to be submitted via the Chest
website. The contract period will be for 2 years with an option for the
Council to extend for a further 2 years.
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Council will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers.
This period allows unsuccessful tenderers to seek further debriefing from
the Council before the contract is entered into. Applicants have 2 working
days from notification of the award decision to request additional
debriefing and that information has to be provided a minimum of 3 working
days before expiry of the standstill period. Such additional information
should be requested from the address in section 1.1. If an appeal
regarding the award of a contract has not been successfully resolved the
Public Contracts Regulations 2006 (SI 2006. No 5) provide for aggrieved
parties who have been harmed or are at risk of harm by a breach of the
rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the court may order
setting aside of the award decision or order the authority to amend any
document and may award damages. If the contract has been entered into the
court may only award damages.
