Valuable Land & Premises Bearing Assessment No.18/4, Church Road, Thalangama South; Battaramulla In The Extent Of 26 Perches Suitable For Any Construction.
All that divided and defined allotment of Land marked Lot 14 depicted in Plan No. 3691 dated 17th September, 1996 made by D.S.S. Kuruppu, Licensed Surveyor of the land called Millagahawatta situated at Thalangama South in the Palle Pattu of Hewagam Korale in the District of Colombo, Western Province which said Lot 1 is bounded on the North by Lot No.11 in Plan No.1106, on the East by Lot No.30 in Plan No.1106 on the South by Lot No. C and Lot 22 in Plan No.1106 on the West by Lot 10 and 15 in Plan No.1106 and Containing in extent Twenty Six Perches (A00-R0-P26).
Under the Commission issued to me by the Commercial High Court of Colombo in Case No. H.C. (Civil) 389/07/MR filed by Seylan Bank Plc of Ceylinco Seylan Towers', No.90, Galle Road, Colombo 03 formerly of No.69, Janadhipathi Mawatha, Colombo 01 against 1) Kushan Rajapakshe carrying on business as a Sole Proprietor under the name, style and firm of Rajapakshe Associates, of No.f25/D, Pannipitiya Road, Battaramulla 2), Karunasena Rajapakse of No.125B, Pannipitiya Road, Battaramulla for the recovery of the sum of Rs. 3,515,307/56 and a sum of Rs. 2,492,302/67 together with interest thereon at the rate of 33% per annum from 01.05.2007 till the date, of Decree and thereafter legal interest on the aggregate amount of the Decree till payment in full and legal interest on sum of Rs. 1,111,825/69 together with legal interest thereon from the date of the Plaint till date of Decree and thereafter on the aggregate amount of the Decree till payment in full, Costs of suit and the Auctioneer's charges.
I shall sell by Public Auction the above property On 31 at day of March, 2010 at 10.30 am at the spot.
Access to the property:- From Battaramulla Town proceed along Pannipitiya Road approximately 2 kms. and turn right to Church road and proceed further approximately 200 metres and turn right to motorable 3rd Lane and proceed 50 metres to reach the property which is situated on the right side at the end of this road.
Mode of payments:- The prospective purchaser should pay the following money at the fall of the hammer:- (1) 25% of the purchase price, (2) 1% Local Authority Charges, (3) 2 1/2% Auctioneer's Charges, (4) Cost of the auction, (5) Clerk's and Crier's fee Rs. 1,500/=, (6) Notary's fee for attestation of Conditions of Sale Rs. 3000/= etc. The balance 75% should be deposited in Court to the credit of this case within 30 days from the date of the auction.
