SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Repairs & Maintenance Services to the Royal Botanic Gardens, Kew and
Wakehurst Place.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.
Service category: No 1.
Main place of performance: UKI2 and UKJ2.
II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): RBG Kew is
looking to procure a contractual solution for the delivery of a more
effective and efficient building maintenance and repair service to its
premises located at two geographically separated sites, Kew and Wakehurst
Place. The solution, which will have considered financial and
non-financial benefits and risks of the transfer of operational risks to
the supply side, may involve separate service providers being appointed
for each site.
The optimal solution will be developed through the one stage competitive
dialogue process and the options for a single contract or two separate
contracts will be explored.
Services currently envisaged to be required include:
M&E reactive and planned maintenance.
Building Fabric reactive and planned maintenance.
Helpdesk.
Responding to emergency call outs.
Premises Health and Safety.
Statutory testing and inspections & reporting.
Operating and configuring Building Management Systems.
Delivery of minor project works.
Sustainability & environmental compliance.
Support energy management strategies.
Expressions of interest are invited for the supply of these services.
RBG Kew is a World Heritage Site and illustrates 250 years of history. Its
built estate, set in over 300 acres, consists of approximately 200 mixed
use buildings of which 40 buildings and structures are listed as
architecturally and historically significant, forming part of the UK's
national heritage. These consist of 4 Grade 1 listed buildings and 36
Grade II listed buildings as well as a number of modern high specification
buildings.
Wakehurst Place, located in West Sussex, consists of approximately 10
mixed use buildings of which 2 are Grade 1 listed. The buildings, set in
550 acres, include the Millennium Seed Bank which holds over 1 billion
seeds representing 10 % of the world’s plant species and is critical to
Kew’s global conservation work.
The tender process is likely to involve the transfer of existing direct
employees and contractors, under the Transfer of Undertakings (Protection
of Employment) Regulations, 1981 as amended 2006 – generally referred to
as TUPE. For direct employees RBG, Kew will seek to discuss conditions
related to job security and location.
The NEC3 Term Service Contract will be used with specific client relevant
amendments.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The contract will cover a range of
building maintenance and repairs services across the premises in both Kew
and Wakehurst Place. The building maintenance and repairs services will
cover the following:
M&E reactive and planned maintenance.
Building Fabric reactive and planned maintenance.
Helpdesk.
Responding to emergency call outs.
Premises Health and Safety.
Statutory testing and inspections & reporting.
Operating and configuring Building Management Systems.
Delivery of minor project works.
Sustainability & environmental compliance.
Support energy management strategies.
II.2.2) Options: Yes.
Description of these options: The contract shall be for three years with
an option, if granted, subject to good performance, to extend by a further
period of one year and, subject to continued good performance, to extend
for a further one year, to a maximum overall period of five years, before
reprocuring.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 36 (from the award of the contract).

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Details are
set out in the Pre-Qualification Questionnaire (PQQ) document. All
interested parties are invited to complete a PQQ as the first stage in the
selection process .
The PQQ will assess the interested parties in terms of technical ability,
relevant experience, capacity, sustainability and environmental position
and policies, organisational and financial standing to meet the
requirements.
The PQQ returns will be assessed against the set of criteria below (IV.2)
and will employ a number of minimum threshold requirements, as set out in
the PQQ pack.
The highest scoring bidders will be invited to participate Competitive
Dialogue.

VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU

VI.3) ADDITIONAL INFORMATION: The successful contractor will be required
as a condition of contract to comply with all existing discrimination
legislation which will be consolidated into a single Equality Bill during
2010.
In addition to the legal framework relating to the Transfer of
Undertakings (Protection of Employment) Regulations (1981 as amended 2006)
the successful contractor will need to comply with the Statement of
Practice on Staff Transfers in the Public Sector (generally referred to as
COSOP), January 2000 (revised November 2007), which incorporates HM
Treasury’s Staff Transfers from Central Government; a Fair Deal for Staff
Pension (generally referred to as ‘Fair Deal’).

period at the point information on the award of the contract is

of 10 calendar days, provides time for unsuccessful tenderers to challenge
the award decision before the contract is entered into.
The Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved
parties who have been harmed or are at risk of harm by a breach of the
rules to take action in the High Court (England, Wales and Northern
Ireland).
