SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

supply of meter installation & maintenance services.

specified by the contracting entities.

several operators
Maximum number of participants to the framework agreement envisaged:4 per
lot.

II.1.5) Short description of the contract or purchase(s): Scottish Water
recently installed 40 000 water meters as part of the full business
metering initiative carried out during 2007/8. Together with 86 000
existing water meters this equates to approx. 126 000 metered customers
with revenue water meters throughout the country.
Scottish water now aims to replace a large quantity of its existing
revenue water meters on a cycle basis (meter change-out programme) whilst
continuing with its current faults and repairs process approach.
Scottish Water is therefore seeking to attract experienced Contractors to
provide meter maintenance and installation services across Scotland.
Scottish Waters operational area is divided into 4 geographical regions:
East, North, South and West.
The framework will be split into two lots:
Lot 1. Internal meter installation and maintenance.
Lot 2. External meter installation and maintenance. Where external work is
necessary this will include the excavation and subsequent reinstatement of
the meter apparatus.
Scottish Water reserves the right to split each lot by region (East,
North, South and West.) or award on a pan Scotland basis.
All meter exchange/repairs will require to be completed to manufacturers
guidelines.
Contractors will be expected to comply with:
1. New Roads and Street works Act 1991
2. Transport Scotland Act 2005
3. Compliance with the Water Scotland Act 1980 as amended by the Water
Industry (Scotland) Act 2002
4. H&SAWA 1974 and Water Regulations 2002
5. Compliance with the Water Byelaws 2004
6. Compliance with Scottish Waters Metering Policy in relation to sizing
and location or meters.
7. Compliance with BS 6700.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Where appropriate, parent
company guarantees/performance bond may be required. Further detail will
be available at tender stage.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: All prices quoted
shall be in Pounds Sterling and all payments shall be made in Pounds
Sterling. Payment shall be made on the basis of supplied equipment and
supporting services based on the agreed Framework agreement schedules.
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: In the event of a group submitting an
accepted offer it will be necessary for each member of the group to sign
an undertaking that each company in the group will be jointly and
severally liable for the satisfactory performance of the agreement.

contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION

formalities necessary for evaluating if requirements are met: Applicants
expressions of interest should be submitted by e-mail to

and should include the following information:
1. Confirmation that the interested party can participate in an electronic
tender process. the only specific requirement being having an e-mail
address. Any PQQ or tender associated with this Framework will be issued
using ESourcing Scotland electronic package.
2. Full postal address and contact details, inclusive of company
registration number are required to be included in your submission.
III.2.2) Economic and financial capacity: Applicants will be expected to
be of sufficient and economic standing to support an annual award of work
or part thereof for the framework. All applicants must complete the
financial questions within the PQQ / Tender documents. Financial standing
relevant to the anticipated value of work will be determined by Scottish
Water based on the response to the Pre-qualification questionnaire (PQQ)
and any further financial checks deemed necessary.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Scottish Water will incorporate a minimum of 10 calendar
day standstill period at the point of information on the award of the
contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
requested from the contact point quoted in Section 1.1 of this notice. The
Utilities Contracts (Scotland) Regulations (SSI 2006 No. 2) provide for
aggrieved parties who have been harmed or are at harm by a breach of the
rule to take action in the Sheriff Court or Court of Session. Any such
action must be brought promptly (generally within 3 months). Where a
contract has not been entered into the Court may order the setting aside
of the award decision or order the authority to amend any document and may
award damages. If the contract has been entered into the Court may only
award damages.
