SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Microsoft licenses for Tromsø municipality.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Supplies.
Purchase.
Main place of delivery: Tromsø, Norway.
II.1.3) The notice involves: The establishment of a framework agreement.
II.1.4) Information on framework agreement: Framework agreement with a
single operator.
Duration of the framework agreement: Duration in year(s): 2.
II.1.5) Short description of the contract or purchase(s): The "Select
agreement" and the "School agreement". The distributor shall be authorized
by Microsoft to sell licenses for these agreements. The Microsoft License
no. of the Select agreement is 64384932.
The agreement will also include all municipal schools sorted under the
Microsoft school license scheme. The schools have a school agreement (SA)
with Microsoft. This is School 3 placed under the County Agreement
(compare agreement no. 3712683{~19501877:1~}).
Reporting of licenses of the school agreement for 2010 has been executed.
Municipal enterprises, cultural buildings, cultural centers and other
municipal foundations will also be allowed to enter into the agreement.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The municipal administration requests
licenses for approx. 9 000 000 NOK for the next 5 years. The estimated
value for 2010 is 5 500 000 NOK. The purchase value for the schools is
approx. 3 000 000 NOK for the next 2 years. The annual software
maintenance (SA) for the administration is estimated to 900 000 NOK per
annum. Estimated value per annum is not binding for the Awarding
Authority. Dependent on the budget situation/technical development, the
Awarding Authority may purchase more or lesser than what is estimated.
II.2.2) Options: Yes.
Description of these options: Option for prolongation.
Provisional timetable for recourse to these options: in months: 24 (from
the award of the contract).

III.1) CONDITIONS RELATING TO THE CONTRACT

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Company
registration certificate.
Evidence of enrolment on the professional or trade register, as required
by national law, in the country where the company is established.
Value added tax certificate (National requirement).
Company tax certificate (National requirement).
Self-declaration in compliance with Appendix 2 (HSE) of the Norwegian
procurement regulations (National requirement).
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: The company’s (not the
group of companies) accounts for the previous 2 years, as well as sales
for the services included in the contract. The documents shall contain the
board’s report, profit and loss accounting, balance sheet, cash flow
analysis and notes. The Awarding Authority also request the auditor’s
report.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
Description of minimum 3 references from corresponding deliveries carried
out the previous 3 years, with values and dates, recipients and contacts.
The references should preferably be from public sector.

IV.2.1) Award criteria: The most economically advantageous tender in
