SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Provision of medical services for Fusion for Energy.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.
Service category: No 25.
Main place of performance: Mainly Fusion for Energy premises for Lot 2,
Barcelona. The contractor's premises at Barcelona, Spain, for Lot 1 and 3.

II.1.3) The notice involves: The establishment of a framework agreement.
II.1.4) Information on framework agreement: Framework agreement with a
single operator.

Frequency and value of the contracts to be awarded: Lot 1 depends on the
number of recruitments and number of family members, lot 2 is a recurrent
service of several hours per week, and lot 3 depends on the number of
absences and estimations of controls required by the doctor.
II.1.5) Short description of the contract or purchase(s): Lot 1:
provision of services of a medical center for mainly pre-recruitment
tests, annual checks and health screanings checks.
Lot 2: Provision of services of a medical advisor for Fusion for Energy,
providing advise on occupational health issues, on the application of the
Staff Regulation of the European Union (as representing the organisation
at the Inter-Institutional Medical College or in invalidity procedures).
Furthermore, the medical advise shall provide support to the Staff on
various medical issues.
Lot 3: provision of medical services for the management and control of
absences of staff in accordance with the regulations and proceed, if
required with the necessary checks.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: One contract will be signed for each lot
for an initial duration of one year and a possible extension up to a
maximum duration of 4 years. Estimated amount for the whole duration of
the services is: 400 000 EUR for lot 1, 450 000 EUR for lot 2 and 150 000
EUR for lot 3.
Estimated value excluding VAT:

II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in

INFORMATION ABOUT LOTS
LOT NO 1
TITLE: Provision of services offered by a medical centre to Fusion for
Energy
1) SHORT DESCRIPTION: Provision of services offered by a medical centre
on mainly pre-employment and annual medical tests for Fusion for Energy
Staff and health screaning examinations both for staff and for its family,
when applicable.
2) COMMON PROCUREMENT VOCABULARY (CPV): 85000000.
3) QUANTITY OR SCOPE: The quantity of the services will depend on the
number of staff recruited and to be recruited and the size or their
families. Bear in mind that the actual staff member size (215) and its
referent increase (300 at the end of 2010 and possible 400 at the end of
2011). The contract duration will be of one year with possible renewal up
to a maximum duration of 4 years.
Estimated cost excluding VAT: 400 000,00 EUR.
4) INDICATION ABOUT DIFFERENT DATE FOR DURATION OF CONTRACT OR
STARTING/COMPLETION: Duration in months: 48 (from the award of the
contract).
5) ADDITIONAL INFORMATION ABOUT LOTS: The procedure is divided into two
steps. First step is devoted to analyse the capacity of the company to
implement its tasks generally defined. Only preselected candidates will be
invited to submitt an offer and will receive, time in advance, a full
description of the services. Fusion for Energy will properly and in due
time inform the selected candidates on the scope of the contract.
Applications must be submitted using the appropriated forms.
LOT NO 2
TITLE: Provision of services offered by a medical advisor
1) SHORT DESCRIPTION: Provision of services offered by a medical advisor
on occupational health issues and further services related to applicable
health legislation and Staff Regulations. Provision of services on general
medicine advise.
2) COMMON PROCUREMENT VOCABULARY (CPV): 85000000.
3) QUANTITY OR SCOPE: The company responsible to provide the services of
medical advisor to Fusion for Energy will be requested to provide services
mainly at Fusion for Energy premises at least 8 hours per week plus
further specific demands (estimated 16 hours averache per week). The
contract will be of one year duration with possible extention up to four
years. For further information concerning the number of staff of Fusion
for Energy, please see "Quantity and scope" for LOT 1.
Estimated cost excluding VAT: 450 000,00 EUR.
4) INDICATION ABOUT DIFFERENT DATE FOR DURATION OF CONTRACT OR
STARTING/COMPLETION: Duration in months: 48 (from the award of the
contract).
5) ADDITIONAL INFORMATION ABOUT LOTS: Fusion for Energy will provide the
necessary supplies to the medical advisor to properly implement its tasks.
The procedure is divided into two steps. First step is devoted to analyse
the capacity of the company to implement its tasks generally defined. Only
preselected candidates will be invited to submitt an offer and will
receive, time in advance, a full description of the services. Fusion for
Energy will properly and in due time inform the candidates selected of the
scope of the contract.
Applications must be submitted using the appropriated forms.
LOT NO 3
TITLE: Provision of medical services related mainly to sickness and
control of absences
1) SHORT DESCRIPTION: Provision of medical services, up to demand, on the
application of the Staff Regualtions relative to sickness and associated
control of absences, as welll as other Staff Regulations functions linked
to this.
2) COMMON PROCUREMENT VOCABULARY (CPV): 85100000.
3) QUANTITY OR SCOPE: The quantity of the services will depend on the
number of staff sick or absent and the according planining of controls
made by the doctor in coordination with HR sector. The contractor shall
normally implement its tasks in its premises. Reimboursement will proceed
when travel is due. For further information concerning the number of staff
of Fusion for Energy, please see "Quantity and scope" for LOT 1.
Estimated cost excluding VAT: 150 000,00 EUR.
4) INDICATION ABOUT DIFFERENT DATE FOR DURATION OF CONTRACT OR
STARTING/COMPLETION: Duration in months: 48 (from the award of the
contract).
5) ADDITIONAL INFORMATION ABOUT LOTS: The procedure is divided into two

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: No, unless a prefinancing is
exercised (see general terms and conditions of the standard model
contracts for administrative procurements in the web page).

III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Invoicing is
normally carried out after the services have been completed and accepted
by Fusion for Energy, or per month (when applicable) for monthly services.
Payments will be made within 45 days of the date of which the invoice is
received and approved, unless otherways forseen in the special

III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Only companies with legal personality
are allowed to submit an application for this procurement procedure.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
Applications can be submitted for one or more lots, provided that the
functions implemented are clearly separated during its implementation.
Applicants must state in their applications for which lot they are
applying and send complete documentation for each lot. Applicants shall be
authorised to provide the services requested in accordance with the
applicable legislation in Spain. Applicants must fully respect the
applicable legislation on Data protection.
Certificates of conformity will be requested.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and

Applicants must meet all relevant legal requirements requested by the
relevant Spanish law in Sanitary matters in order to carry out the
services. The company and the medical staff employed must possess the
necessary qualifications in order to carry out the services and must be
authorised to practice medicine in Spain and Catalunya. This must be
accompaigned by the relevant official documents.
The candidates shall submit the proof of registration on the relevant
official professional registry enabling the execution of the service in
accordance with Spanish legislation.
III.2.2) Economic and financial capacity: Information and formalities

The applicant must submit the following documents:
— evidence to possess insurance coverage imposed by Spanish law in
sanitary matters,
— evidence of relevant professional risk indemnity insurance,
— balance-sheets of the last three financial years,
— Statement of overall turnover and turnover on the area covered by the
call for tender and its respective lot for the last three financial years
available.
If, for any valid reason, the candidate is unable to provide the
references, he may prove his economic and finacial standing by any other
document which the contracting authorituy considers appropiate.
In the event of a consortium submitting an offer or in the case of
subcontracting, balance sheets (for the previous three financial years) of
all proposed subcontractors or all individual consortium members should be
included in the offer.
Consequently, the tenderer, or the consortium of service providers, or the
tenderer together with the proposed subcontractors will demonstrate a
minimum annual turnover corresponding to at least ten times the annual
contract value.
Minimum level(s) of standards possibly required: Turnover for the last
three financial years, showing at least a turnover of more than 3 times
the annual price of the lot for which they are applying.
Balance sheets must show a solvable situation. The insurance coverage
shall be enough as to ensure the volume of services and the type of
activities covered.

Minimum level(s) of standards possibly required:
Lot 1: The company shall demonstrate at least three years of experience in
the provision of related services to public organisations or private
companies, ability to provide some of the examinations (as detailed in the
web page) internally without having to recurr to another centre, maximum
location of the medical centre at 30 km from Fusion for Energy, and good
comand of English language of the staff attributed to the implementation
of the contract.
Lot 2: The company shall demonstrate at least 5 years of experience in
providing medical services on occupational health issues , very good
comand of spoken and written English, good knowledge of the Spanish public
and private infraestructures, good knowledge of treatment of medical
urgencies and evaluation of corporal damages.
Lot 3: The company shall demonstrate at least 3 years of experience in
providing medical services related with management of absences and good
knowledge of evaluation of medical urgencies and corporal damages.

III.3) CONDITIONS SPECIFIC TO SERVICES CONTRACTS

Objective criteria for choosing the limited number of candidates: For Lot
1: Range of services provided internally (without subcontracting), number
of staff english speakers (basics), general infraestructure aspects (both
of the facilities of the building, parking, location), previous experience
with public organisations or private companies.
For Lot 2: Previous years of experience on the field, similar type of
clients and multicultural environment, range of services provided in the
field.
For Lot 3: Previous years of experience on the field, similar type of
clients and multicultural environment, range of services provided in the
field.

dialogue: Recourse to staged procedure to gradually reduce the number of
solutions to be discussed or tenders to be negotiated yes.

The information letter published in that page will detail the modalities
for submission of applications, and the contacts between the candidates
and Fusion for Energy. The request to participate must be submitted :
1) Either by registered post or express courier. In this case the post
office stamp or express courier stamp of the day on which it is sent will
constitute proof of compliance with the deadline given above. Candidates
are informed that all packages shall pass though a security control in the
building (opening hours are from 9 to 17.00 h from Monday to Friday,
Saturdays; Sundays and holidays being closed), or
2) by hand-delivery (direct or through any authorised representative of
the Candidate company) by 17:00 at the latest (this hour is binding for
reception at Fusion for Energy, referred department). In this case, in
order to establish a proof of the date of deposit, the depositor will
receive, from an official at the above-mentioned address, a receipt which
will be nominative, signed, dated and time-stamped. Please note that in
this case it is the date and time of reception at Fusion for Energy
premises that will count. Candidate companies are informed that all
packages shall be subject to a security control on the corner of the
Building which may take up to half an hour after which the receipt will be
issued (for opening hours see above).
Late delivery will lead to the exclusion from the pre-selection procedure
for this Contract.
Applicable rules: It sould be noted that the present procurement procedure
is governed by the rules laid down in Financial Regulation applicable to
the general budget of the European Union adopted on 25.6.2002 (Council
regulation No 1605/2002) as last amended on 13.12.2006 and the
implementing rules for its implementation adopted on 23.12.2002
(Commission Regulation No 2342/2002) as last amended on 23.4.2007. Fusion
for Energy may, before the contract is signed, either abandon or cancel
the award procedure or part thereof without the tenderers being entitiled
to claim any compensation.
