Outline of notice of a call for expressions of interest
1. Name, address, telephone and fax numbers, e-mail and Internet address

2. Type: notice of call for expressions of interest: Persons interested
are invited to submit an application in accordance with the rules set out
in this notice for the purpose specified.
The contracting authority will draw up a list of candidates who meet the
criteria set out at point 8 below. This list comprises sub-lists,
corresponding to each of the fields described in point 4.
Each time a specific contract is to be concluded relating to the field
described at point 4, the contracting authority will invite all the
candidates on the list (on the relevant sub-lists) or some of them,
selected on the basis of objective and non-discriminatory criteria, to
submit a tender.
The contracting authority will send the candidates invited to submit a
tender the call for tenders relating to the contract in question.
Inclusion on the list entails no obligation on the part of the Commission
concerning the award of the contract nor, in view of the preceding
paragraph, concerning an invitation to tender.
3. The list resulting from this notice will be used exclusively for
public contracts of the following type: Supply contracts worth less than
an estimated 125 000 EUR.
4. Full description of the field or fields covered by the call for
expressions of interest: The IRMM, part of the European Commission's Joint
Research Centre, intends to compile a list of suppliers interested in:
field 1: thin foils, microfoil, microleafs, discs that may be mounted as
self-supporting foils. Thicknesses ranging from the (sub)micrometre to the
millimetre scale;
field 2: wires, mesh, fabric, either insulated or not insulated.
Thicknesses ranging from the (sub)millimetre to the centimetre scale;
field 3: powder, granules, spheres, shot, lump, pieces, bar, ingot, plate,
rod, tubes;
field 4: single crystals;
field 5: sputtering targets.
Technical specifications will be provided together with the invitation to
tender.
Expressions of interest are invited for 1 or more lots.
5. Where appropriate, the place of delivery of supplies: At address
mentioned in point 1.
6. Expiry date of the list resulting from the call for expressions of
interest: The list of potential suppliers will remain valid for 3 years
from the date of publication of this notice. This validity period may be
extended following a further call for expressions of interest.
Any person interested may submit an application at any time during the
period of validity of the list, with the exception of the last 3 months.
7. Where applicable, the legal form to be assumed by the grouping of
suppliers, contractors or service providers to whom the contract will be
awarded: No special legal form is required from applicants. However,
groupings may, irrespective of their legal form, submit a tender, provided
each participant satisfies the requirements. Candidates who have formed a
grouping may submit a joint tender. Members of the grouping are to
designate the party to act as sole representative, on their behalf,
vis-à-vis the Commission.
8. Criteria for inclusion on the list (1 or more of the sub-lists)
8.1. Exclusion criteria: Any candidate may be excluded from the
procedure:
1. if he has been convicted of an offence concerning his professional
misconduct by a judgement which has the force of 'res judicata';
2. if he has been guilty of grave professional misconduct proven by any
means which the contracting authority can justify;
3. if he has been the subject of a judgment which has the force of 'res
judicata' for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
4. if he has, following another procurement procedure or grant award
procedure financed by the Commission budget, been declared to be in
serious breach of contract for failure to comply with his contractual
obligations;
5. if he has any conflict of interest with the contracting authority;
6. if he is guilty of serious misrepresentation in supplying the
information required by the authorising department.
7. An independent statement providing that the company is not bankrupt or
being wound up, that their affairs are not being administered by the
court, they have not entered into an arrangement with creditors, they have
not suspended business activities, or that they are not in any analogous
situation arising from a similar procedure under national laws and
regulations, or that they are not the subject of proceedings for a
declaration of bankruptcy, for an order for compulsory winding up or
administration by the court or for an arrangement with creditors, nor are
they the subject of any other similar proceedings under national laws and
regulations.
8. An independent statement from the appropriate authority in the country
in which he is established to the effect that he has fulfilled his
obligations relating to the payment of social security contributions in
accordance with the legal provisions of the said country.
9. An independent statement from the appropriate authority in the country
in which he is established to the effect that he has fulfilled his
obligations relating to the payment of taxes in accordance with the legal
provisions of the said country.
8.2. Selection criteria: Financial and economic standing:
10. a statement as to his overall turnover relating to similar supplies
provided over the past 3 financial years; this statement is to include
balance sheets or extracts therefrom, should their publication be provided
for under company law in the country in which he is established;
11. a banker's statement showing the company's financial situation.
Technical competence:
12. demonstration of experience in the field of supplying of high-purity
materials during the last 5 years.
Professional competence:
13. proof of his enrolment on the professional register (recent
certificate showing the enrolment and specifying the classification) in
accordance with the legislation of the Member State in which the tenderer
is established;
14. an identification sheet for the company detailing the corporate name,
legal status, legal representative, address, telephone and fax numbers,
VAT number and bank references.
Remarks:
The requested information selection criteria mentioned under points 7, 8,
9, 10, 11 and 13 concerning 'Legal position', 'Financial and economic
standing' and 'Professional competence' must not be provided for
governmental and public organisations like State hospitals, public
research organisation and State universities. However, those institutions
have to provide a proof of being a public entity.
The Commission reserves the right to discard applications which do not
provide all of the foregoing information.
9. Full list of information, formalities and documents to be supplied by
persons interested: See point 8.
Candidates should mandatorily provide proofs/documents/declarations
mentioned under point 8, Nos 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13,
and 14.
10.(a) Address to which applications must be sent: At address as in 1,
for the attention of Mr Ivan Celen, Contracts Officer, Management Support
Unit (MSU).
(b) Arrangements for submitting and presenting applications including all
the information, formalities and documents referred to at point 9: All
expressions of interest must quote the reference '2010-029-ic: Supply of
high-purity metals materials (noble metals, base metals, metallic alloys,
metallic compounds, graphite, silicon, germanium and plastics)' and be
sent to the address as in 1.
Applicants may elect to send their expressions of interest either:
— by registered post, as evidenced by the postmark,
— or by hand-delivering them to the abovementioned service (directly or by
any representative of the tenderer, including private courier services).
In this case delivery will be established by means of a receipt, signed
and dated by the official mentioned under 10(a) or his authorised
representative from the service mentioned in 10(a).
(c) If the list is divided into sub-lists, arrangements for candidates to
specify the field or fields they are interested in
11. Other information: The attention of interested parties is drawn to
the aim of this call, i.e. the drawing up of a list of candidates who
could be invited to respond to a specific invitation to tender. Therefore,
they are requested to send the information requested above to the
indicated address but not to ask for further information at this stage.
Candidates will be notified of the result of their application.
