This is a combined synopsis/solicitation for commercial items in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.   This announcement constitutes the only solicitation; a written solicitation will not be issued.  Solicitation IBM10Q0004 is being issued in a Request for Quotes format. 

This solicitation document and its incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-36.    

IBM10Q0004 is a total set-aside acquisition for small businesses.  The associated North American Industry Classification System (NAICS) code is 423810 for Construction and Mining (except Oil Well) Machinery and Equipment Merchant Wholesalers, with a corresponding small business standard of 100 employees.  Only offers from small businesses will be considered for this solicitation.   

The International Boundary and Water Commission (IBWC) is seeking price quotes on one (1) new Front End Wheel Loader of current year and shall meet or exceed specifications listed on attachment.  Please include year, manufacturer and model number in price quotes responding to this solicitation.

Delivery of the equipment shall be F.O.B. Destination within 120 days of contract award to the Amistad Dam Field Office, 670 Texas Spur 349, Del Rio, TX  78840-0425.        

The provision at 52.212-1, Instructions to Offerors-Commercial Items applies to this acquisition (FAR provisions and clauses are available for review at http://www.arnet.gov/far).  ADDENDA for 52.212-01 Elaboration of the paragraphs of the provision is as follows:  (b)  Submission of offers is expanded to include acceptance of facsimile proposals, reference the provision incorporated by reference, 52.215-05, Facsimile Proposals (Oct 1997).   

Provision 52.212-2, Evaluation-Commercial Items, applies to this acquisition.  Paragraph (a) of this provision is hereby replaced with the following:  Award will be made on the basis of the lowest evaluated price of quotation meeting or exceeding the acceptability standards for non-price evaluation factors.  The non-price evaluation factors and their acceptability standards are:  (1)  Technical capability of the item offered to meet the Government requirement; and (2) Past performance.  Past performance is a measure of the degree to which a contractor has satisfied its customers in the past. 

Interested vendors shall complete and return a copy of provision of  52.212-3 Offeror Representations and Certifications-Commercial Items or update and complete ORCA online.    

The clause at 52.212-4 Contract Terms and Conditions-Commercial Items applies to this acquisition.    

The clause at 52.212-5 Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items applies to this acquisition.  The following additional clauses cited in 52.212-5 are applicable to this acquisition:  52.203-6, 52.219-6, 52.219-14, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-36, 52.222-39, 52.223-9, 52.225-5, 52.225-13, 52.232-33.
