SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Contract for the provision of next generation broadband network services,
telephony and associated support and management.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.

II.1.3) The notice involves: The establishment of a framework agreement.
II.1.4) Information on framework agreement: Framework agreement with a
single operator.
Duration of the framework agreement: Duration in year(s): 10.
Justification for a framework agreement, the duration of which exceeds
four years: The Agreement duration is for an initial period of 5 years
with the option for the contracting authorities to extend.
For a further period of 5 years.
The Councils existing network comprises more than 600 sites - given that
when it was first built it took 3 years to connect all of these, the
Council considers that changing networks would require an even longer
period for connection and the Councils and the suppliers investment would
require a substantially longer period to realise a long term and strategic
investment, this investment would include not only capital investment in
infrastructure but could also include the transfer of staff via TUPE,
procurement and legal costs, project management costs.
This investment cost would be amplified with other purchasing bodies.
Estimated total value of purchases for the entire duration of the
framework agreement:

II.1.5) Short description of the contract or purchase(s): Note the
participation, process, prequalification and tender for this process will
only be via the electronic tendering.
Portal located at www.staffordshire.alito.co.uk, save to the extent that
while the responses to the PQQ must be submitted electronically, respones
in the dialogue phase will be in hard copy the contracting authority is
seeking to create the Public Sector communications network of choice in
the Staffordshire region and surrounding area in simple terms this will
provide network connectivity to Public Sector premises allowing staff to
gain access to IT applications and services hosted on or beyond the
network. For clarity Public Sector will include (but is not limited to)
sites such as Council offices, Schools, Libraries, National Health Service
premises and potentially the premises of other government agencies and
partner organisations accordingly, the contracting authority is acting as
a Central Purchasing Body which will enable the following categories of
organisation to benefit from the framework agreement awarded pursuant to
this procurement: District Councils, Borough Councils, City Councils,
Police, Fire and Rescue, Probation Services, Parish Councils, health
sector organisations, education establishments, government and/or
privately funded voluntary agencies, organisations delivering services on
behalf of or with the contracting authority. These organisations are
primarily located in Staffordshire, but it is intended that organisations
located within the West Midlands and counties adjacent to Staffordshire
can also benefit from the framework arrangement. Further details are
contained in the PQQ documentation. Please note that the framework
agreement will enable such organisations to benefit from this procurement
exercise; there is no obligation on them to do so. The nature of the
framework arrangement and potential range of beneficiaries (who may or may
not take advantage of the framework), together with the possibility of a 5
year extension to the initial 5 year term, accounts for the range in the
potential value of the framework Agreement. The contracting authority is
also seeking to review and refresh its telephony estate and it is
anticipated that this service will be delivered using the underlying
network. Potentially the telephony solution should also be available to
other partner organisations should they wish to take up the service moving
forwards the network and telephony service will be fully managed and
supported on a 7 x 24 basis throughout the contract term. The contracting
authority is seeking a primary partner that will design, test and deliver
the solution to agreed standards providing guaranteed availability and
quality of service and who will work with the contracting authority and
its partners to fully exploit services moving forwards.

Description of these options: The Agreement duration is for an initial
period of 5 years with the option for the contracting authorities to
extend.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: A parent company guarantee and
/ or performance bond or suitable financial deposit for due performance
will be required, details of which will appear in the tender documents.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Tender pricing must
be in pounds sterling. Other details to be included within the tender
documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: The contracting authority does not
require any unincorporated consortium to form a legal entity at this
stage, although it may be required to do so prior to awarding any
contract. If the successful bidder is an unincorporated consortium, one
member of the consortium (acceptable to the contracting authority) must be
identified as the lead and main contractor, who will accept responsibility
for all the obligations of all the consortium members.

I. 5 000 000 GBP Public Liability Insurance is required in respect of each

III. 5 000 000 GBP Professional Indemnity Insurance is required in respect
of each and every claim.

Objective criteria for choosing the limited number of candidates: On the
basis of the order of ranking candidates, with a specified minimum score,
at the PQQ stage, at which the criteria referred to in Part 4 of the
Public Contracts Regulations (implementing Articles 45-52 of Directive
2004/18/EC) will be assessed and marked.

VI.4.1) Body responsible for appeal procedures: Staffordshire County

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The contracting authority will incorporate a minimum 10
calendar day standstill period (or 15 days where non electronic or fax
methods are used) at the point that an award decision notice is
communicated to tenderers the award decision notice will specify the
criteria for the award of the framework agreement, the reasons for the
decision, including the characteristics and relative advantages, the name
and score of the successful tender; and will specify when the standstill
period is expected to end or the date before which the contracting
authority will not conclude the framework agreement. If an appeal
regarding the award of a contract has not been successfully resolved, the
Public Contracts (Amendment) Regulations 2009 provide for aggrieved
parties who have been harmed or are at risk of a breach of the rules to
take action in the High Court (England, Wales and Northern Ireland) any
such action must be brought promptly (generally within 3 months). The
Court may order the setting aside of the award decision or may order the
Contracting Authority to amend any document and may award damages. If the
framework agreement has been entered into the Court may make a declaration
of ineffectiveness or may order that the duration of any relevant specific
contract be shortened and additionally may award damages. The time limit
for seeking such a declaration is generally 30 days from notification of
the award (either by award decision notification or contract award notice
depending on the circumstances) or otherwise 6 months.
