SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The works
consist of the construction of 24 houses and 18 apartments to 4 storeys
complete with engineering services and external site development works at
North Rugby Club Site, Ormeau Road, Belfast. The contract will be for 18
months from date of the award and is scheduled to start in March 2010.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The works consist of the construction of
24 houses and 18 apartments to 4 storeys complete with engineering
services and external site development works at North Rugby Club Site,
Ormeau Road, Belfast. The contract will be for 18 months from date of the
award and is scheduled to start in March 2010. It is expected that all
homes built under this scheme will be Lifetime Homes compliant, achieve
Secure by Design and will achieve a minimum of Code for Sustainable Homes
Level 3.
Estimated value excluding VAT:
Range: between 3 800 000 and 4 300 000 GBP.
II.2.2) Options: No.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 18 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: The Contracting Authority may
require guarantees or other security acceptable to the contracting
authority from tenderers. See Contract documents.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: See Contract
documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Subject to the status and involvement
of the parties, the contracting authority may require parties to commit to
joint and several liability in respect of the contract. Alternatively the
contracting authority may expect the lead operator to take total
responsibility. The contracting authority may require collateral
warranties, parent company guarantees and/or performance bonds as
applicable to be entered into by other economic operators.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
Yes - as detailed in the Contract documentation. The project will be
subject to the Association obtaining Project Approval and grant funding
from NIHE (DPG) for the scheme.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: In
accordance with Regulation 23 Public Contracts Regulations 2006 available

required to submit a response to the Pre-Qualification Questionnaire in
the form issued by the Contracting Authority.

SECTION IV: PROCEDURE
IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Accelerated restricted.
Justification for the choice of accelerated procedure: The Association is
advertising in OJEU but will apply the accelerated restricted procedure as
the early execution of this contract would be of benefit to the
construction industry, as per OGCs Inforamtion Note 1/09 14.1.2009. In the
current economic climate a faster procurement process will benefit
economies by providing quicker distribution of public funds into markets.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged number of operators 6
Objective criteria for choosing the limited number of candidates:
“Compliance with Regulations 23 to 25 Public Contracts Regulations 2006
available at www.opsi.gov.uk/si/si20060005.htm (see contract documents),
including in particular technical skills, previous relevant experience,
resources and economic standing.
The objective criteria for choosing the limited number of candidates will
be detailed in the Information Memoranda and Pre-Qualification
Questionaire which will be provided to applicants following receipt of
written expressions of interest.

IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.

and participation in the project will be borne by each tenderer or the
successful tenderer (as appropriate). Until the Contract is formalised,
all discussions and correspondence will be deemed strictly subject to
contract. No formal agreement shall be binding until it has been signed by
duly authorised representatives of both parties”.
