Works procurement notice
1. Publication reference: EuropeAid/127297/C/WKS/XK.

Contract specifications
6. Description of the contract: The works to be carried out under this
contract shall include the complete construction of a new building of an
accommodation block for 50 persons and an administration building as shown
on the drawings and as described in the technical specification including:
(a) approach roads, parking place, playground, perimeter fencing and
landscape;
(b) installation of external electric power, telephone and computer
network cable installations, and a new prefabricated transformer station;
(c) installation of new external water supply, sewage and storm water
drainage;
(d) installation of HVAC including installation of solar panels.
7. Number and titles of lots: 1 lot.
Terms of participation
8. Eligibility and rules of origin: Participation is open to all legal
persons (participating either individually or in a grouping (consortium)
of tenderers) which are established in a Member State of the European
Union or in a country or territory of the regions covered and/or
authorised by the specific instruments applicable to the programme under
which the contract is financed (see also heading 22 below). All works,
supplies and services under this contract must originate in one or more of
these countries. Participation is also open to international
organisations. The participation of natural persons is directly governed
by the specific instruments applicable to the programme under which the
contract is financed.
9. Grounds for exclusion: Tenderers must submit a signed declaration,
included in the tender form for a works contract, to the effect that they
are not in any of the situations listed in point 2.3.3 of the 'Practical
Guide to contract procedures for EC external actions'.
Tenderers and, if they are legal entities, persons who have powers of
representation, decision-making or control over them, are informed that,
should they be in one of the situations mentioned in:
— the Commission Decision (2008/969/EC, Euratom) of 16.12.2008 on the
Early Warning System (EWS) for the use of authorising officers of the
Commission and the executive agencies (OJ L 344, 20.12.2008, p. 125), or
— the Commission Regulation (2008/1302/EC, Euratom) of 17.12.2008 on the
central exclusion database — CED (OJ L 344, 20.12.2008, p. 12),
their personal details (name, given name if natural person, address, legal
form and name and given name of the persons with powers of representation,
decision-making or control, if legal person) may be registered in the EWS
only or both in the EWS and CED, and communicated to the persons and
entities listed in the abovementioned Decision and Regulation, in relation
to the award or the execution of a procurement contract or a grant
agreement or decision.
10. Number of tenders: Tenderers may submit only 1 tender. Tenders for
parts of a lot will not be considered. Any tenderer may state in its
tender that it would offer a discount in the event that its tender is
accepted for more than 1 lot. Tenderers may not submit a tender for a
variant solution in addition to their tender for the works required in the
tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of 25 000
EUR when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
12. Performance guarantee: The successful tenderers will be asked to
provide a performance guarantee of 10 % of the contract amount at the
signing of the contract. This guarantee must be provided together with the
return of the countersigned contract no later than 30 days after the
tenderer receives the contract signed by the contracting authority. If the
selected tenderer fails to provide such a guarantee within this period,
the contract will be void and a new contract may be drawn up and sent to
the tenderer which has submitted the next cheapest compliant tender.
13. Information meeting and/or site visit: A mandatory information
meeting and site visit will be held on 16.12.2009 (11:00), CET, at
Lipjan/Lipljan (departure from the municipal assembly building).
Prospective tenderers must inform beforehand the task manager at the ECLO
by e-mail at xhelal.ibrahimi@ec.europa.eu if they are going to attend,
stating the name of their representative(s). Those attending must provide
their own means of transport for the site visit and arrange their own
parking.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of implementation of tasks: 365 calendar days from
commencement date (plus 365 days of defects liability period).
Selection and award criteria
16. Selection criteria: Economic and financial capacity:
Sole tenderer:
a) shall have an average annual value of construction work of at least 2
000 000 EUR over the past 3 years (2007, 2008, 2009).
Consortium/joint venture:
b) the lead partner shall have an average annual turnover of construction
work of at least 1 500 000 EUR over the past 3 years (2007, 2008, 2009).
The consortium/joint venture as a whole shall have an average annual
turnover of at least 2 000 000 EUR.
Professional capacity of candidate:
Sole tenderer:
a) shall be a registered firm or a natural person capable of carrying out
the specific works. In the case of a firm, it shall have been incorporated
in 2006 or earlier;
b) shall carry out at least 70 % of the contract works by his own
resources, which means that he shall have the equipment, materials, human
and financial resources necessary to enable him to carry out that
percentage of the contract;
c) key personnel:
— 1 project manager who shall be a qualified civil engineer with 10 or
more years of relevant experience related to building construction works,
— 1 site manager with 5 years or more of experience in management of
building construction works (site management, site supervision, etc.),
— 1 safety manager with 3 years or more of experience in safety management
and proven qualifications relevant to works of a similar nature.
Consortium/joint venture:
a) the lead partner shall be a registered firm or a natural person capable
of carrying out the specific works. In the case of a firm, it shall have
been incorporated in 2006 or earlier;
b) the lead partner in a joint venture/consortium shall have the ability
to carry out at least 50 % of the contract works by his own means;
c) the partner in a joint venture/consortium (i.e. not the lead partner)
shall have the ability to carry out at least 20 % of the contract works by
his own means;
d) key personnel:
— 1 project manager who shall be a qualified civil engineer with 10 or
more years of relevant experience related to building construction works,
— 1 site manager with 5 years or more of experience in management of
building construction works (site management, site supervision, etc.),
— 1 safety manager with 3 years or more of experience in safety management
and proven qualifications relevant to works of a similar nature.
Important: the proposed key personnel for this tender should have an
acceptable level of English and cannot be already employed in another
works contract financed by the contracting authority for the same period.
Technical capacity of candidate:
The sole tenderers and consortium/joint venture taken as a whole (that is
the lead partner or any other partner) shall have completed at least the
following schemes/projects in the last 5 years:
— construction of 1, but preferably 2 buildings comprising works of
similar nature to those requested in this tender with a (joint) value of
at least 1 500 000 EUR.
The sole tenderers and consortium/joint venture shall supply copies of the
respective certificates of final acceptance signed by the
supervisors/contracting authority of the projects concerned and/or written
letter of satisfaction from the employer of that contract.
