Housing currently have access to a framework for the delivery of
construction and associated services (including building design), in
respect of their development work. The current framework expires in 2010,
and Impact and Eden Housing are commencing a procurement exercise to
appoint new service partners to the framework.

INFORMATION ABOUT LOTS
LOT NO 1
TITLE: Contractor / Development Services
1) SHORT DESCRIPTION: Provision of works relating to construction,
predominantly of new build properties and other such requirements. The
Contractor shall be responsible for all building and installation works
relating to the structure, and should be suitable accredited and qualified
to undertake such works.
2) COMMON PROCUREMENT VOCABULARY (CPV): 45210000.
3) QUANTITY OR SCOPE: Works shall be required across Cumbria, subject to
landlords requirements.
Estimated cost excluding VAT:
Range: between 200 000 and 10 000 000 GBP.
LOT NO 2
TITLE: Architectural Services (including M&E)
1) SHORT DESCRIPTION: Applications are welcomed from organisations who
can provide Architectural Services for new build projects predominantly.
Organisations should note that they shall also be required to provide M&E
consultancy services in addition, however this element may be
sub-contracted if required. Responsibility for this element, where
sub-contracted, shall remain with the Architectural Service provider.

should note that the value of the works across the framework is subject to
the value of the construction works.
LOT NO 3
TITLE: Client Representative
1) SHORT DESCRIPTION: Applications are welcomed from organisations who
wish to act as Client Representative for the landlords. This role may
involve, but shall not be limited to acting on behalf of the Landlords as
the co-ordinator of other partners on this framework. This may include
working with the Contractor to develop quantity and pricing information,
undertaking initial appraisals on development site and providing advice to
the landlords on how to proceed.

3) QUANTITY OR SCOPE: Services are required across Cumbria. Applicants
should note that the value of the works across the framework is subject to
the value of the construction works.
LOT NO 4
TITLE: Construction Design Management Co-Ordinator
1) SHORT DESCRIPTION: Applications are invited from organisations who
wish to undertake the role of CDMC on behalf of the Landlords. Applicants
should note that if successful, they shall be responsible for effective
Health and Safety Management, in addition to other responsibilities, which
shall be identified within the Invitation to Tender.

3) QUANTITY OR SCOPE: Services are required across Cumbria. Applicants
should note that the value of the works across the framework is subject to
the value of the construction works.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Performance bonds, warranties,
deposits and / or parent company guarantee may be required.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: As detailed within
the invitation to tender documentation.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: In the event of a group of
organisations submitting an acceptable offer, it will be necessary for
them to provide an undertaking that each company shall be jointly and
severally responsible for the due performance of any contracts called off
and entered into between the landlords, and any other orgaisations under
the framework agreement.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
Applicants who satisfy any of the criteria for rejection as set out in
Regulation 23(1), Public Contracts Regulations 2006 shall be treated as
ineligible. Applicants may be requested to provide such evidence as is.
Reasonably necessary to allow Eden and Impact to establish that the
aforementioned criteria do not apply to them.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: In
accordance with Articles 45 to 50 of Directive 2004/18/EC and Regulations
23 to 25 of the Public Contracts Regulations 2006 and as set out in the
Pre Qualification Questionnaire (PQQ) available at
www.valueworks.co.uk/projects.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: The information and
formalities set out in Article 47 of Directive 2004/18/EC and Regulation
24 Public Contracts Regulations 2006. These requirements are set out in
the PQQ. A copy of the PQQ can be obtained from
www.valueworks.co.uk/projects. The PQQ must be completed and returned in
accordance with the instructions, by the deadline listed in Section IV.3.4
of this Contract Notice.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
The information and formalities set out in Article 48 of Directive
2004/18/EC and Regulation 25 Public Contracts Regulations 2006. These
requirements are set out in the PQQ. A copy of the PQQ can be obtained
from www.valueworks.co.uk/projects. The PQQ must be completed and returned
in accordance with the instructions, by the deadline listed in Section
IV.3.4 of this Contract Notice.

SECTION IV: PROCEDURE
IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Restricted.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged minimum number: 5. Maximum number: 8
Objective criteria for choosing the limited number of candidates: Eden and
Impact Housing shall select at least 5 and no more than 8 PQQ applications
to progress to tender stage, which shall be based on the criteria
identified within the PQQ documentation.
IV.2) AWARD CRITERIA
IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.
IV.2.2) An electronic auction will be used: No.

VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: Applicants are to note that this is a joint
sourcing exercise between Eden Housing Ltd and Impact Housing Ltd. Further
information on these organisations can be found on their websites:
www.edenha.org.uk and www.impacthousing.org.uk.
These partners currently have requirements spanning Cumbria.
Eden and Impact Housing are not bound to accept the lowest or any tender,
and confirms that the issue of the Invitation to Tender does not
constitute any form of instruction. As such, Eden and Impact Housing
accepts no responsibility for any costs in relation to preparation or
submission of tenders (and / or, for the avoidance of doubt, PQQ's).
VI.4) PROCEDURES FOR APPEAL

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Eden and Impact Housing will incorporate a minimum of 10
calendar day standstill period at the point where information on the award
of the framework is communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from Re:allies before
the framework is entered into. Applicants have 2 working days from the
notification of the award decision, to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
end of the standstill period. Such information should be requested from
the address in Part I.1.
Applicants must lodge an appeal before the close of the standstill period,
and in line with the Public Contracts Regulations 2006.
If an appeal regarding the award of the framework has not been
successfully resolved, the Public Contracts Regulations 2006 (SI 2006 No
5) provide for aggrieved parties who have been harmed, or are at risk of
harm by a breach of the rules, to take action in the High Court (England).
Any such action must be brought promptly (generally within 3 months).
Where a framework has not been entered into, the Court may order the
setting.
Aside of the award decision, or order the authority to amend any document
and may award damages. If the framework has been entered into, the Court
may only award damages.
