INVITATION TO BID

The Bangko Sentral ng Pilipinas (BSP), through its Bids and Awards Committee (BAC), invites bidders to apply for eligibility and to bid for the hereunder project:

Delivery Period: Within fifteen calendar days after receipt of a copy of the executed Purchase Order.


Prospective bidders should have undertaken a similar requirement awarded and completed from Y2004 to present amounting to at least 25% of the ABC. If bidding for more than one (1) item, the basis shall be the one with the higher/highest ABC. The Eligibility Check/ Screening as well as the Preliminary Examination of Bids shall use non-discretionary "pass/fail" criteria. Post-qualification of the lowest calculated bid shall be conducted.

All particulars relative to Eligibility Statement and Screening, Bid Security, Performance Security, Pre-bidding Conference(s), Evaluation of Bids, Post-qualification and Award of Contract shall be governed by the pertinent provisions of Republic Act No. 9184 and its revised Implementing Rules and Regulations (IRR).

The ITB and Checklist of Requirements for Bidders may be downloaded from the website of the Philippine Government Electronic Procurement System (PhilGEPS) and the BSP Website (www.bsp.gov.ph). The complete set of the Bidding Documents may be purchased
by interested bidders from the address stated above and upon payment of a non-refundable fee in the amount of P500.00.

The BSP assumes no responsibility whatsoever to compensate or indemnify bidders for any expenses incurred in the preparation of the bid.

The BSP reserves the right to accept or reject any bid, to declare the bidding a failure, not to award the contract, to annul the bidding process and to reject all bids at any time prior to contract award, without thereby incurring any liability to the affected bidders. Furthermore, the BSP reserves the right to waive any minor defects of formality and to accept the proposal most advantageous to the agency.

ENVELOPE NO. 1 - ELIGIBILITY AND TECHNICAL REQUIREMENTS ENVELOPE

I. ELIGIBILITY DOCUMENTS:

Class "A" Documents -

1. Registration certificate from: [ITB 12.1(a)(i)]
• Department of Trade and Industry (DTI) - for single proprietorship; or
• Securities and Exchange Commission (SEC) - for partnership/ corporation; or
• Cooperative Development Authority (CDA) - for cooperatives.

2. Y2009 Mayor's permit/municipal licenses [ITB 12.1(a)(ii)].

3. Notarized statement by the prospective bidder of all its ongoing and completed government and private contracts for the last twelve (12) months from date of bidding, including contracts awarded but not yet started, if any. The statement shall include, for each contract, the following (please use the appropriate prescribed form) [ITB/BDS 12.1 (a)(iii) and 24.6]

a. Name of the client and description of the project;
b. Date and status of the contract;
c. Amount of contract and value of outstanding contracts;
d. Date of delivery; and
e. End-user's acceptance or official receipt(s) issued for the contract, if completed


4. Prospective Bidder's single sale document [e.g., Sales Invoice, Delivery Receipt (acknowledged by the end-user), Official Receipt or Check Voucher] for similar requirement awarded and completed from Y2004 to present amounting to at least 25% of the ABC of the item to be bid. If bidding for both items, the basis shall be the ABC of Item 1. [ITB/BDS 5.4].

5. Additional requirement applicable only to prospective bidder which was a
previous supplier/contractor of the BSP [BDS 5.4]

a. Certificate of Completion and Acceptance issued by the end-user department for the most recent completed contract [BDS 5.4]

6. Y2007/Y2008 Audited Financial Statements, stamped "received" by the BIR or its duly accredited and authorized institutions [ITB12.1 (a) (iv)]

7. Any of the following [ITB 12.1 (a)(v)/BDS 5.5)]

a. Computation of Net Financial Contracting Capacity (NFCC) amounting to at least equal to the ABC of the item/s to be bid, duly signed by the prospective bidder's authorized signing official; or

b. A commitment from a universal or commercial bank to extend to the prospective bidder a credit line if awarded the contract of the project in an amount of at least equal to ten percent (10%) of the ABC of the item/s to be bid.

8. Certification from the BAC Secretariat that the prospective bidder has previously submitted the above-enumerated "Class A" documents (Items 1, 2, and 6) [ITB/BDS 24.4].

Class "B" Documents -

9. If bidding as Joint Venture (JV), Valid Joint Venture Agreement (JVA), in case the JV is already in existence. In the absence of a JVA, duly notarized statement(s) from each/all the potential JV partners stating that they will enter into and abide by the provisions of the JVA in the instance that their bid is successful [ITB 12.1 (a)(vi)].

II. TECHNICAL DOCUMENTS

1. Original Bid Security [ITB 12.1 (b)(i)/BDS 18.1]

2. Notarized certificate that the bidder, who may either be a pharmaceutical company, exclusive distributor or local representative of a drug manufacturer, has been in existence in the Philippines for the past five (5) years. [BDS 12.1b(ii)]

3. A certified true copy of the offered drug's expired patent or bidder's notarized certification that the pharmaceutical company/manufacturer is the original owner of the expired patent; for open patent, the bidder must submit the drug's Certificate of Analysis issued by the Philippine General Hospital (PGH) result/s of which was/were either duly verified/certified by the BSP Medical and Dental Clinic (MDC) to be presented during the bidding for verification/certification of the MDC. [BDS 12.1b(ii)]

6. Notarized omnibus statement of the prospective bidder containing the following

a. Bidder's Responsibilities [ITB 6.1(a)];
b. Non-Inclusion in the Blacklist [ITB 6.1(b)];
c. Authenticity of Submitted Documents [ITB 6.1(c)];
d. Authority to Validate Submitted Documents [ITB 6.1(d)];
e. Authority of the designated representative [ITB 6.1(e)]
f. Disclosure of No Relationship [ITB 6.1(f)]; and

DOCUMENTARY REQUIREMENTS THAT SHALL BE REQUIRED FROM THE LOWEST CALCULATED BIDDER/HIGHEST RATED BIDDER, WHICH THE PROSPECTIVE BIDDER/S MAY OPT TO SUBMIT ON BIDDING DATE:


1. Current Tax Clearance Certificate per Executive Order 398, Series of 2005 [ITB/BDS 29.2(a)].

2. a) Y2008 Income Tax Returns (ITR) duly filed thru Electronic Filing and Payment
System (eFPS) of the BIR, as provided for under E.O. 398 or RR 3-2005 together with the Filing and Payment References. If filed manually, prospective bidder should also submit proof of enrollment to eFPS [ITB/BDS 29.2(b)].

b) Business Tax Returns for the quarter ending September 2009, per Revenue Regulations 3-2005 [ITB/BDS 29.2(b)];

3. Current certificate of Philippine Government Electronic Procurement System (PhilGEPS) Registration [ITB/BDS 29.2(c)].

4. Company Profile indicating the following:

a) Current composition of the Board of Directors;
b) Principal Officers;
c) Principal Stockholders; and
d) Product Line




NOTE: In case of inconsistency between the Checklist of Requirements for Bidders (Checklist)/Bid Data Sheet (BDS) and the provisions in the Instructions to Bidders, the Checklist / BDS shall prevail.
