This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included with this notice. This announcement constitutes the only solicitation; proposals are being requested. The NAICS code is 531210. USDA, Natural Resources Conservation Service in North Dakota is seeking an independent real estate professional(s), such as an agent, broker or appraiser, licensed and registered in the State of North Dakota, to complete a market analysis of agricultural land sales in each of 53 counties within the State. The independent real estate professional(s) shall be experienced and knowledgeable of the dynamics of North Dakota agricultural lands. The market analysis will be based on a composite of comparable sales in the counties to be identified in the solicitation. Proposals may be submitted for completion of market analysis on all counties. Specific instructions for preparation and submission of quotes are provided in specifications attached. Award will be made to the offer or combination of offers by line item that is determined to be the best value to the Government based on the evaluation criteria. The anticipated award date is on or before December 16, 2010. Proposal due date is December 14, 2009 by 4:00pm CT. A fixed price contract(s) is anticipated with incentives/penalties possible. The analyses for all counties must be completed, delivered and accepted by the Government no later than February 1, 2010. A Delivery Incentive of 20% of the contracted price will be provided to the Contractor if performance requirements are met and deliverables are completed, delivered and accepted by the Government within 28 days of award date (approximately January 13, 2010). A delivery incentive of 15% of the contracted price will be provided to the Contractor if performance requirements are met and deliverables are completed, delivered and accepted by the Government within 37 days (approximately January 22, 2010) of award date. If Contractor fails to perform in accordance with the Contract, and produces late delivery of a completed and accepted product, this action will amount to a 5% reduction in the contract amount for every five (5) days Contractor fails to meet the required February 1, 2010 delivery and acceptance date. The Government will be allowed 5 business days to respond with requests, clarification needs, and recommendations regarding the final product. This Request for Proposals includes provisions and clauses in effect through Federal Acquisition Circular 2005-30. These include, but are not limited to (a) 52.212-1, Instructions to Offerors�Commercial; (b) 52.212-2, Evaluation�Commercial Items; (c) 52.212-3, Offeror Representations and Certifications�Commercial Items, which must be submitted with the offer; (d) 52.212-4, Contract Terms and Conditions�Commercial Items; and (e) 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders�Commercial Items. Additional Instructions for Preparing Proposals and Information on Evaluation of Proposals are also included.
