The Department of Commerce, The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 6.302-1 with The Thermo Electron Corporation, Madison, WI for a Maintenance/Service Contract for a NIST LTQ Linear Ion Trap Mass Spectrometer including the Surveyor M Pump, Surveyor Autosampler and Surveyor PDA, and another stand-alone NIST LTQ Linear Ion Trap Mass Spectrometer. This Essential Support Plan consist of unlimited on-site emergency visits with max 72 hour response; scheduled preventative maintenance visit; priority technical support with a 2-hour response time; non-consumable repair parts; and software updates. *****Sole source determination is based on the fact that Thermo Electron is the sole source equipment manufacturer and service provider for all Thermo Electron Spectrometers, parts, training, technical support, field service support and software. The LTQ Linear Ion Trap Mass Spectrometer (S/N LTQ10354) uses a technologically advanced method to analyze chemicals and to identify unknown samples. Thermo Electron has proprietary rights to the design and software utilized in this instrumentation. Thermo Electron is the only company with access to performance verified component parts, spare parts, software, technical support, upgrades and engineering resources to maintain the original operation specifications for the Thermo Election system. Thermo Election Field Services Engineers (FSE) for this instrumentation, are the only available certified and factory trained engineers. ***Delivery shall be FOB DESTINATION and be completed in accordance with the Contractor�s commercial schedule. *** *** As defined in the Federal Acquisition Regulation, (FAR), FOB Destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery. The contractor shall deliver all line items to NIST, Gaithersburg, Maryland, 20899-0001. *** *****The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 Employees. ******A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. *****No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by December 2, 2009 will be considered by the Government.
