BID BULLETIN NO. 01

2010 INTEGRATED CARGO HANDLING SERVICES (ICHS) FOR NFA CEBU

This Bid Bulletin No. 01 is issued to address matters relevant to the eligibility requirements and technical and financial components of the contract to be bid, raised during the Pre-Bidding Conference for the procurement of 2010 Integrated Cargo Handling Services (ICHS) on November 11, 2009 at the 3rd flr, NFA Regional Office, Banilad, Cebu City. This Bid Bulletin shall form an integral part of the bidding documents.

1.Posting of the Notice of Invitation to Apply for Eligibility and to Bid and the revised Bidding Documents in the PhilGeps and the NFA Website

a) The revised Bidding Documents was prepared on November 03, 2009 and posted on November 04, 2009.

2.Amendments to the following provisions in section III. Bid Data Sheet

a)ITB Clause # 1.2.2 No. 2 should read as: " Trucking of NFA cargoes within 10-kilometer radius - only to trucking services of NFA cargoes from area/warehouse/port of destination within 10-kilometer radius (services under this item does not include loading to and unloading of NFA cargoes from the truck)".

b)ITB Clause # 5.4 should read and state: " For the procurement of non expendable supplies: the Bidder must have a largest single contract that is completed and accomplished within the twelve month period between 2005 up to the present which is similar in nature and complexity to the contract to be bid and the value thereof must be at least fifty percent (50%) of the ABC. However, the bidder may submit the following in lieu of the largest single contract:

(1)At least two (2) completed contracts, similar in nature and complexity to the contract to be bid, the aggregate amount of which should be equivalent to at least 50% of the ABC for this project, and

(2)The largest of these similar contracts must be equivalent to at least half of the percentage of the ABC as required above.

Likewise, the phrase "similar in nature and complexity to the contract to be bid" shall mean a contract that involved the unloading of food in bags for human consumption from a foreign vessel to truck or to a ship sided local vessel, the hauling to/from a warehouse(s) and handling of said commodity(ies) to/from the truck and inside the warehouse(s).

c)ITB Clause # 8.1 should read as: " Sub contracting is permissible, but, except for the bid security and the requirements for NFCC and the 50% largest single contract, the sub contractor(s) shall submit the same eligibility documents required from the bidder, namely the legal, technical, and financial documents.

d)ITB Clause # 12.1(a)(iii) should read as: " The statement of all ongoing and completed government and private contracts shall include all such contracts from 2005 up to the present prior to the deadline for the submission and receipt of bids. The following additional documents shall be submitted:


(a)Contractor's Sworn Statement containing the following:

 List of trucks to be utilized with corresponding Official Receipt number and Certificate of Registration number;
 List of owned/leased equipments/facilities/supplies necessary to carry out ICHS in NFA Cebu.

(b)Copies of Official Receipt and Certificate of Registration of the listed trucks to be utilized;True copies of at least two completed contracts accomplished within the twelve month period between 2005 up to the present which are similar in nature and complexity to the contract to be bid and where the aggregate amount of which are equivalent to at least 50% of the ABC;
OR
True copies of the contract to be presented as the largest single contract that is completed and accomplished within the twelve month period between 2005 up to the present which is similar in nature and complexity to the contract to be bid and the value there of must be at least 50% of the ABC.

 Bidders must at least have a 3 -year - experience of handling and pierside unloading of food in bags for human consumption.

(c)Certified copies of registration/ownership/Deed of Sale showing ownership of the facilities/ equipments/supplies to be utilized;
OR
The Memorandum of Understanding/Contract of Lease between the Contractor and the Owner / Operator for the utilization/provision of facilities/equipments/supplies.

(d)Technical Specification - Section VII

(e) ITB Clause # 28.3 shall state: " Bid modification is not allowed."

e)ITB Clause # 29.2(d) the last phrase shall read: " other appropriate licenses and permits required by law ."

f)ITB Clause # 32.4(g) the last phrase shall read: "other contract documents that may be required by existing laws ".


3.Submission of all Bid Documents and affixing of the Bidder's initials on each page of the Bid Documents.

Considering that the following Bid Documents are part of the Contract, these shall likewise be part of the eligibility requirements and shall be submitted during the submission and opening of bids:

a)Section II - Instructions to Bidders
b)Section III - Bid Data Sheet
c)Section IV - General Conditions of the Contract
d)Section V - Special Conditions of the Contract
e)Section VI - Schedule of Requirements
f)Section VII - Technical Specifications (ibid item d.4) ]

 All pages of the above mentioned Bid Documents must be initialed by the Bidder or his/her authorized representative.
