SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Eurostar (UK)
Ltd requires the provision of a managed fleet of multi-functional
reprographic photocopiers connected to the company's LAN.
This fleet shall handle all the company's photocopying, printing, faxing
and scanning requirements. In the last 12 months over 5 million black and
white and over 360 000 colour pages have been handled by the current fleet
of devices.
The service provider shall be responsible for all ad-hoc as well as
planned preventative maintenance and a very high level of device
availability is demanded. We are looking to improve on the environmental
performance of this fleet - not only in the energy usage of each device
but also in the streamlining of the number of machines deployed and their
optimisation according to local demand for performance.
It is acknowledged that the company's print requirements might not be
completely met by this fleet so the option to offer an offsite printing
capability would be an advantage.
The locations where this fleet is deployed are, in London, St Pancras
International, Temple Mills Depot (E10) and Times House (N1) and, in Kent,
Ebbsfleet International, Ashford International and Kent House, Ashford.
It is probable that service provision will also be required in Calais,
Lille and Paris, France, and Brussels, Belgium.

VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: See Item VI.4.2 below.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Eurostar (UK) Ltd will incorporate a minimum of 10
calendar day standstill period at the point of information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
required from the Contracting Entity (see Item I.1 above).
If an appeal regarding the award of contract has not been successfully
resolved The Utilities Contracts (Scotland) Regulations 2006 (SSI 2006
No.2) provide for aggrieved parties who have been harmed or are at risk of
harm by a breach of the rule to take action in the Sheriff Court or Court
of Session. Any such action must be brought promptly (generally within 3
months).
Where a contract has not been entered into the Court may order the setting
aside of the award decision or order the authority to amend any document
and may award damages. If the contract has been entered into the Court may
only award damages. (The purpose of the standstill period referred to
above is to allow parties to apply to the Courts to set aside award
decision before the contract is entered into.).
