SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
UK-Leicester: provision of holiday playschemes (provision to fill gaps) -
2978b.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.
Service category: No 26.
Main place of performance: Locations in Leicester to be defined by
Leicester City Council.
II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): Leicester City
Council's aim is to maximise access to good quality community based
playschemes during all school holidays except Christmas, for children aged
between 3 and 13 years in the most deprived areas of the city. Further
information about the requirement and the Council's Holiday Playscheme
Strategy is provided within the Invitation to Tender document.
Following award of a number of contracts to a range of providers, the City
Council has identified a number of gaps in provision. The gaps are either
in terms of geographical area, age groups, or holidays.
A formal tender exercise will be conducted, by ESPO on the Council's
behalf, with the purpose of securing provision to fill gaps. The tender
will be divided into lots, based on Children's Centre neighbourhoods.
Providers will be invited to bid to supply one or more Playscheme,
dependent upon their capacity, and further instructions on this are given
in the Invitation to Tender. Providers already in receipt of three year
playscheme contracts may reapply to reach children of different age
groups, for different holidays or in different areas.
The Council wishes ideally to appoint suppliers by the end of March 2010,
with the expectation that provision will start from May half term 2010.
Please also note that an initial open meeting session for bidders is being
held on Friday 27th November 2009 (10:00am - 12:00pm) - this will be for
any interested parties to find out more about the gaps, the playschemes
required, and the procurement process itself. Anyone interested in

maximum of two people from any one organisation will be able to attend.

Description of these options: The contract has the option to extend for up
to a further 24 months. The total estimated value shown in section 11.2.1
includes the option period.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT

The Supplier agrees that there shall be no discrimination by it against
any person with respect to opportunity for employment or conditions of
employment, because of age, culture, disability, gender, marital status,
race, religion or sexual orientation. The Supplier shall in all matters
arising in the performance of the Agreement comply with the provisions of
the Sex Discrimination act 1975 and the Disability Discrimination Act 1995
and any regulations made there under. The Supplier shall in all matters
arising in the performance of the Agreement comply with the provisions of
the Employment Equality (Age) Regulations 2006. The Supplier must comply
with the provisions of the Race Relations Act 1976 and the Race Relations
(Amendment) Act 2002 and shall ensure that they perform their
responsibilities under this Agreement with due regard to the need to
eliminate unlawful racial discrimination, and to promote equality of
opportunity and good relationships between different racial groups.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: ESPO, on behalf of Leicester City Council will
incorporate a minimum 10 calendar day standstill period at the point
information on the award of contract is communicated to tenderers. This
period allows unsuccessful tenderers to seek further debriefing from the
contracting authority before the contract is entered into. Applicants have
two working days from the notification of the award decision to request
additional debriefing and that information has to be provided a minimum of
3 working days before the expiry of the standstill period. Such
information should be required from the address stated in section 1.1. If
an appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No 5)provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the Court may order
the setting aside of the award decision or order the authority to amend
any document and may award damages. If the contract has been entered into
the Court may only award damages.
