Conditions for Participation

The Department will exclude a Tender from further consideration if the Department considers that the Tenderer does not meet any one or more of the following conditions for participation. 

a. The Tenderer or any proposed Sub-Contractor must not have been named in Parliament as not complying with the Equal Opportunity for Women in the Workplace Act 1999 (Cth).


b. The Tenderer must not have a judicial decision against them (not including decisions under appeal) relating to employee entitlements and have not paid the claim.


c. The Tenderer must be compliant with the Fair Work Act 2009 (Cth) and, if requested be willing to provide information about how they promote fair, cooperative and productive workplace relations and their commitment to supporting apprentices and education and training in the workplace.
