II.1.4) Short description of the contract or purchase(s): The Contracting
Authority has procured a framework of modular accommodation contactors.
The scope of the framework will enable the Contracting Authority to call
off all or some of the following: design, supply, install, outfit to
specification, maintain and eventually remove a number of temporary
construction modular buildings. The buildings are required for a variety
of uses during the construction phase of the London 2012 Olympic and
Paralympic Games. Buildings may be required for the running of the London
2012 Olympic and Paralympic Games.
The anticipated timescales for the framework are as follows:
1. Design / supply / installation / maintenance: 2009 – 2012;
2. Legacy Removal period: 2012 - 2013.
Furthermore, the Contractors will need to interface and coordinate with
other works package contractors including (but not limited to) seating
works, structural frame and cladding works, general builder and common
site services, building services and civil engineering works.
The Contracting Authority may make this framework available to other
entities, including (but not limited to) LOCOG. However, no commitment of
any sort is given in relation to the amount of work albeit that if these
other entities do decide to use this framework (or the Contracting
Authority does on their behalf), then the amount of works available to the
Contractors could be greater than currently envisaged.

Contract Regulations 2006 (implementing Title 2 Chapter 7 section 2 of the
2004/18/EC Directive) at any stage during the procurement process,
— the Applicant is guilty of serious misrepresentation or fraud in
relation to its application and/or any aspect of this procurement process,
— there is a change in identity, control, financial standing or other
factor impacting on the procurement process and affecting the Applicant;
and/or,
— there is an actual or potential commercial, professional, financial or
other conflict of interest arising between the interests of the
Contracting Authority and the Applicant.
All Applicants are solely responsible for all their costs and expenses
incurred in connection with the preparation and submission of their
responses at all stages of the procurement process. Under no circumstances
will the Contracting Authority be liable for any costs or expenses borne
by or on behalf of the Applicant.
All persons wishing to respond to an Olympic Delivery Authority’s
procurement opportunity must register on the London 2012 e-Tendering
Service at https://etenders.london2012.com It is the Olympic Delivery
Authority’s intention to administer all procurement opportunities through
the London 2012 e-Tendering Service. As part of the registration process
you will be asked to read and confirm your understanding and acceptance of
the terms and conditions governing use of the London 2012 e-Tendering
Service ("User Agreement"). A fundamental aspect of the User Agreement is
your acceptance of the confidentiality, no marketing rights and
restrictions on publicity which are specifically designed to protect the
Olympic related rights of the Olympic Delivery Authority, LOCOG and other
Games Bodies. Any person who does not accept all the terms of the User
Agreement will not be permitted to access the London 2012 e-Tendering
Service.
There will be a short listing of respondents to receive the tender
documents and associated documentation. It is a condition that all
participants submitting a PQQ response must sign and return a hard copy of
the Mandatory Undertaking included within this PQQ, in line with the
instructions contained within Part 2 of this PQQ.
The ODA expressly reserves the right:
(i) not to award any contract as a result of the procurement process
commenced by publication of this notice;
(ii) to make whatever changes it may see fit to the content and structure
of the tendering competition;
(iii) to award a contract or contracts in relation to part only of the
requirements covered by this notice; and in no circumstances will the ODA
be liable for any costs incurred by candidates.
VI.3) PROCEDURES FOR APPEAL:
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Public Contracts Regulations 2006 (SI 2006 No. 5)
provide for aggrieved parties who have been harmed or are at risk of harm
by a breach of the rules to take action in the High Court (England, Wales
and Northern Ireland). Any such action must be brought promptly (generally
within three months). Where a contract has not been entered into, the
Court may order the setting aside of the award decision or order the
authority to amend any document and may award damages. If the contract has
been entered into the Court may only award damages.
