SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting entity: Fuel
farm management and into-plane services agreement.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): George Best
Belfast City Airport ("GBBCA") is seeking to appoint an operator to
provide services and operate facilities for the purposes of aviation fuel
distribution, into-plane and refuelling operations at the airport
throughout normal hours of operation (as detailed at section 3 of the
Project Information Memorandum available from the address detailed at
section I.1 above). It is currently anticipated that the key role of the
appointed party will be to assist GBBCA in its objective to provide at
GBBCA:
— a safe, cost efficient and operationally effective system for receipt,
storage and distribution of jet fuel to operating aircraft; and,
— at all times ensure that an adequate stock of fuel is available in order
to provide uninterrupted service to operating aircraft.
The operator will assume full management responsibility for the operation
and maintenance of the fuel facility. In doing so, his role may include:
— ensuring product quality assurance,
— providing stock management services,
— performing into-plane operations in line with all appropriate industry
standards,
— maintaining equipment and facilities in accordance with the required
industry or manufacturer standards and,
— implementing a management system for Health, Safety and Environmental
matters (including issuing risk assessments where appropriate).
The operator will be responsible for the overall management of and
provision of the services in accordance with principles of open and fair
access to all fuel suppliers. It is envisaged that the operator will
assist GBBCA with the management of the financial and operational aspects
of the relationship with operating airlines, including calculation and
collection of fees in respect of services.
It is currently anticipated that the operator will be required to transfer
into their employment the staff currently employed by the incumbent
operator and in doing so, abide by all relevant TUPE Regulations.
The operator will be afforded the opportunity to utilise a broad range of
GBBCA's equipment likely to be necessary to provide the services and
operate the fuel facilities, including refuelling bowsers. Full details of
the available equipment can be found at section 2 of the Project
Information Memorandum. It is envisaged that GBBCA will retain ownership
of the fuelling facilities, associated equipment and infrastructure at
GBBCA.
Throughout the course of the contract the operator will be expected to:
— provide and maintain manuals, procedures and processes for the safe and
efficient operation of the facility in line with industry standards; and,
— provide as appropriate, technical support linked to any development of
fuelling facilities, including demand forecasting, and any ongoing
maintenance of the facilities.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Estimated value (excluding VAT) between
400 000 and 500 000 GBP per annum.
II.2.2) Options: Yes.
Description of these options: Initial agreement will be for up to 36
months with an option (exercisable at Belfast City Airport Limited's
discretion) to extend for 2 consecutive periods of 12 months. This option
to extend may apply to all the services or to any specific services.

II.3) DURATION OF THE CONTRACT OR TIME LIMIT FOR COMPLETION: Duration in
months: 36 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Parent company guarantee(s)
and/or performance bond may be required as a condition of the award of the
contract.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: The main terms will
be detailed in the form of contract which will be provided to all bidders
invited to negotiate.
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: No specific legal form is required but
one member of a consortia may be required to accept responsibility for the
other member(s), and a consortium may be required to form a legal entity
with appropriate parent company guarantees as a condition of award of
contract.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
It is intended that the operator will contract with GBBCA for provision of
the services identified in section II.1.5 and that GBBCA shall collect
charges in respect of such services from airline customers. The operator
may also be required to commit to the following:
— A storage and into plane agreement detailing the terms and operational
requirements to be provided on behalf of all fuel suppliers; and,
— An aviation fuel indemnity agreement (between GBBCA, the operator and
all fuel suppliers).

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: (1) All
candidates will be required to produce a certificate or declaration
demonstrating that they are not bankrupt or the subject of an
administration order, are not being wound-up, have not granted a trust
deed, are not the subject of a petition presented for sequestration of
their estate, have not had a receiver, manager or administrator appointed
and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or
declaration demonstrating that the candidate, their directors, or any
other person who has powers of representation, decision or control of the
candidate has not been convicted of conspiracy, corruption, bribery, or
money laundering. Failure to provide such a declaration will result in the
candidate being declared ineligible and they will not be selected to
participate in this procurement process.
(3) All candidates will be required to produce a certificate or
declaration demonstrating that they have not been convicted of a criminal
offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or
declaration demonstrating that they have not committed an act of grave
misconduct in the course of their business or profession.
(5) Any candidate found to be guilty of serious misrepresentation in
providing any information required, may be declared ineligible and not
selected to continue with this procurement process.
III.2.2) Economic and financial capacity: All candidates will be required
to comply with economic and financial capacity requirements identified in
the Pre-Qualification Questionnaire (which is available from the address
set out at section I.1) above).
