tender or to participate: Envisaged minimum number: 7. Maximum number: 8
Objective criteria for choosing the limited number of candidates: If more
than the required number of qualified candidates meet the conditions of
participation (as set out in section III), the qualified candidates will
be ranked by Dounreay Site Restoration Limited using a marking scale based
on primarily on the aforementioned selection criteria in order to find
those candidates which will be invited to tender.
IV.1.3) Reduction of the number of operators during the negotiation or
dialogue: Recourse to staged procedure to gradually reduce the number of
solutions to be discussed or tenders to be negotiated no.

IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to

Cost of tendering - Dounreay Site Restoration Limited reserves the right
not to award a contract. The costs of tendering shall be the
responsibility of tenderers.
English Law - The contract shall be considered as a contract made in
England and shall be governed by, and construed in accordance with, the
provisions of English Law.
Annul - Dounreay Site Restoration Limited reserve the right to annul the
tendering process and not award a contract.
Sub-contract - Dounreay Site Restoration Limited work within strict
guidelines and you will be required to specify and justify any proposals
to subcontract.
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Dounreay Site Restoration Limited will incorporate a
minimum 10 calendar day standstill period at the point information on the
award of the contract is communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from Dounreay Site
Restoration Limited before a contract is entered into. Applicants have 2
working days from the notification of the award decision to request
additional debriefing and that information has to be provided a minimum of
3 working days before the expiry of the standstill period. Such additional
information should be sought from the contact named in this notice.
If an appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 no 5, which apply to
England, Wales and Northern Ireland, and the Public Contracts (Scotland)
Regulations 2006 no 1, which apply to Scotland, provide for aggrieved
parties who have been harmed or are at risk of harm by a breach of the
rules to take action in the sheriff court, the Court of Session,
(Scotland) or in England and Wales and Northern Ireland, the High Court.
Any such action must be brought promptly (generally within 3 months).
Where a contract has not been entered into the Court may order the setting
aside of the award decision or order the authority to amend any document
and may award damages. If the contract has been entered into the Court may
only award damages.
