SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Thurrock Thames
Gateway Development Corporation ("TTGDC") wishes to procure a private
sector partner to bring forward the Purfleet Centre regeneration project
in Purfleet, Essex.
The Purfleet Centre regeneration project represents an exciting
opportunity to make a real difference to Purfleet by delivering a
sustainable mixed-use regeneration and development programme. TTGDC's
vision is to create a vibrant and attractive community in which to live
and work.
Purfleet has suffered in the past due to the post-industrial nature of
much of the area, which has been a barrier to the development of a focal
point for the community. This project is seeking to remove that barrier
through significant public sector financial support so that the full
potential of Purfleet's location and its excellent transport links can be
unlocked.
TTGDC is seeking to build a partnership that shares our vision for
Purfleet’s future. Following extensive public consultation showing over 75
% local public support, TTGDC, as the local planning authority, has
approved the Purfleet Centre Development Framework as its planning policy
document for the area. This articulates in planning terms the Purfleet
Centre regeneration project.
TTGDC is assembling a strong portfolio of assets providing an excellent
opportunity for investment in this area and currently owns the freehold
interest of approximately 49 acres of land to be included in the project.
These sites provide an incredible opportunity to revitalise this promising
community. TTGDC continues to progress with negotiations to acquire
further land interests for development under the project.
Purfleet benefits from its close proximity to Central London, the frontage
on the River Thames and its location in the centre of the wider Thames
Gateway and its excellent transport links. It has an existing railway
station on the site to London Fenchurch Street (to the City in 25 minutes)
with ready access to Canary Wharf (35 minutes) and Stratford/Olympics site
(35 minutes). Purfleet also has easy access to the primary highway
network, including the M25 and A13.
TTGDC possesses compulsory purchase powers to enable them to secure land
and interests to deliver their projects. Given the strategic importance of
the project, TTGDC has already resolved to support the principle of the
use of its powers of compulsory purchase for acquiring all outstanding
land and interests to ensure that the project is delivered.
The scheme as envisaged will contain an appropriate level of affordable
and social units and comprise a mix of family houses and apartments of
various sizes. The aim is to build a sustainable, prosperous community
which includes improving the provision of local transportation and
generating a strong, dynamic community. TTGDC is seeking to raise quality
in the area by planning for new and better quality housing, improved
transport infrastructure and new higher value job opportunities within
Purfleet. It is envisaged that the Purfleet Centre project will contribute
a vibrant and compact local centre which will function as the civic heart
for Purfleet and an expanded, more sustainable community.
TTGDC's requirements of its private sector partner is a party who shares
in its vision for the regeneration of Purfleet through the delivery of the
planned implementation of the objectives contained within the Purfleet
Centre Development Framework and the Purfleet Design Codes document. TTGDC
is committed to unlocking the immense potential of this area through the
successful delivery of a currently envisaged development programme
encompassing a balanced mix of approximately 3,500 homes (subject to
variation in any resulting Development Agreement) in conjunction with the
provision of new health care, education, retail, and commercial
development, together with employment opportunities and high quality open
spaces including public realm on the River Thames waterfront.
The selected partner will be expected to give financial support to TTGDC
towards the costs of land acquisition, remediation and infrastructure
provision in order to facilitate the delivery of the project. The quantum
and phasing of such financial contributions are to be determined through
the competitive dialogue process.
The successful partner will need to demonstrate to TTGDC that they have
the experience, skills and resources to deliver a project of this scale
and complexity. The selected partner will be expected to take a lead role
in the shaping and refinement of the emerging vision for the Purfleet
Centre regeneration project. The partner will be responsible for leading
the development and taking full management responsibility for the scheme.
TTGDC's Main Board has sanctioned streamlined governance arrangements
which are in place to facilitate the expedient and successful delivery of
this innovative project. The Chief Executive Officer has delegated
authority to undertake the necessary actions through the competitive
dialogue process in order to identify the most economically advantageous
partner for TTGDC. Furthermore, a Member Forum has been put in place
(comprising Chair of TTGDC Main Board; Chair of TTGDC Resources &
Co-Ordination Committee and Chair of TTGDC Projects Committee) with the
necessary delegated authority of the Main Board to issue approvals on
behalf of TTGDC at key milestones in the competitive dialogue process.
Such a structure is designed to facilitate expedient decisions to be taken
by TTGDC without the need to await pre-determined board meeting dates.
The competitive dialogue process will be supported by an online data room
which will contain significant technical, geo-technical and environmental
reports and data. This data room is designed to enhance the quantum and
quality of information available from the outset of the bidding process in
order to inform bidders and de-risk the overall project.

this notice.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The currently envisaged total
development cost, including land, remediation, infrastructure and
development costs is estimated to be in the region of GBP 750 000 000
(subject to the precise scope of the agreed contract). The currently
envisaged duration of the contract is approximately 15 years from the date
of contract award, subject to the provisions for extension and early
termination in any resulting contract.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The regeneration of Purfleet is the TTGDC’s
largest, most exciting and ambitious project. TTGDC is committed to a well
structured and planned competitive dialogue procurement timetable, and
will use successive stages in the dialogue to reduce the numbers of
bidders in the process. It is envisaged that this PQQ stage will result in
a maximum number of six prospective partners being invited to participate
in dialogue. Thereafter, TTGDC intends to utilise the competitive dialogue
process to down select prospective partners to a maximum of three bidders
being invited to detailed commercial negotiations, prior to the submission
of final tenders. The overall process is structured such that financial
and managerial investment in the bidding process is limited in the earlier
procurement stages.
The procurement process may include a potential capped financial
contribution from TTGDC towards the reasonable third party expenses of the
unsuccessful bidders which are invited to submit a final tender. Further
information will be available to those invited into the competitive
dialogue.
TTGDC reserves the right to change without notice the procedure for
awarding the contract, to reject any or all bids for the contract, to
terminate discussions with any or all interested bidders and/or to stop
the process and not award a contract at any time without any liability on
its part.
TTGDC is not, save for the potential capped financial contribution towards
the third party expenses of bidders who are invited to submit a final
tender and are unsuccessful at final tender stage, liable for any costs,
expenses, fees or charges howsoever incurred by those expressing an
interest or tendering for this contract opportunity.
TTGDC has duties under the Freedom Of Information Act 2000 and related
legislation and may disclose information to a person making a request
unless the information is covered by an exemption in the Act; and TTGDC
considers that the public interest in withholding the disclosure outweighs
the public interest in disclosing it. Bidders should state in their
submissions whether the information, if disclosed, would prejudice their
commercial concerns and if so, their reasons. Any decision in relation to
any disclosure will be made at the sole discretion of TTGDC.
TTGDC is supported in delivering the project by PricewaterhouseCoopers
LLP, Eversheds LLP, Capita Symonds, Urban Initiatives, CB Richard Ellis,
Atkins and Supporta Terraquest.
Any subsequent contract will be subject to English Law.
VI.4) PROCEDURES FOR APPEAL

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: In accordance with Regulation 32 of the Public Contracts
Regulations 2006. TTGDC will incorporate a minimum 10 calendar day
standstill period starting from the date when the award decision
notification is dispatched to bidders. This is to permit unsuccessful
bidders to seek further de-briefing from TTGDC before the contract is
entered into.
Bidders have until midnight of the second working day of the standstill
period for their additional debriefing requests to reach TTGDC.
A response to such a request must be provided to the bidder by a minimum
of 3 working days before the expiry of the standstill period.
If an appeal regarding the award of the contract has not been successfully
resolved, Regulation 47 of the Public Contracts Regulations 2006 provides
for the aggrieved parties who have been harmed, or are at risk of harm as
a consequence of a breach of the procurement rules to bring an action in
the High Court.
