Series of 2009

RESOLUTION RECOMMENDING THE USE OF NEGOTIATED MODE
AS ALTERNATIVE METHOD OF PROCUREMENT

WHEREAS, various departments and offices submitted their respective Purchase Requests for the acquisition of the following:

WHEREAS, Purchase Request Nos. 28087, 27895 and 27924 were initially scheduled for public bidding on 08 September 2009, while Purchase Request Nos. 28275 and 27014 were also scheduled for public bidding on 15 September 2009, and Purchase Request Nos. 28477, 28411, 28326 and 28372 were likewise slated for public bidding on 06 October 2009;

WHEREAS, no bids were received on the aforesaid projects during bid opening and thus the re-bidding for the goods was scheduled on 20 October 2009. Again, no bids were received during bidding date;

WHEREAS, Purchase Request No. 27719 was primarily scheduled for public bidding on 11 August 2009; however no bids were received. Thus, the re-bidding for the goods was scheduled on 15 September 2009, however, the prospective bidder was declared ineligible;

WHEREAS, Section 48 of RA 9184 states among others that subject to the prior approval of the head of the procuring entity or his duly authorized representative, and whenever justified by the conditions provided in this Act, the procuring entity may, in order to promote economy and efficiency, resort to any of the alternative methods of procurement;

WHEREAS, Section 53 (a) of RA 9184 states that negotiated procurement may be resorted to where there has been failure of public bidding for the second time as provided in Section 35;

WHEREAS, the Bids and Awards Committee (BAC), in its evaluation, considered all the factual circumstances of the foregoing and the immediate need for the acquisition of the goods which warrants and necessitates the use and employment of alternative method of procurement specifically through negotiated mode;

NOW, THEREFORE, it is resolved, as it is hereby resolved, that the use of alternative method of procurement for the aforesaid Purchase Requests, specifically by way of Negotiated Procurement, is justified and is recommended for approval of the Head of the Procuring Entity by reason of the existence of the conditions as set forth by The Act and in line with the promotion of economy and efficiency in the procurement system.
