SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:

performance: Supplies.
Purchase.
Main place of delivery: All 62 Universities and Colleges in Scotland and
their subsidiary and associated bodies. The Scottish Ministers (including
Agencies), Scottish Non-Departmental Public Bodies, offices in the
Scottish Administration which are not ministerial offices, cross-border
public authorities within the meaning of section 88(5) of the Scotland Act
1998, any public body established by or under the Scotland Act 1998 or any
Act of the Scottish Parliament, any association of or formed by one or
more of the above, bodies financed wholly or mainly by one or more of the
above, bodies subject to management supervision by one or more of the
above bodies more than half of the board of directors of which, or, in the
case of a group of individuals, more than half of these individuals, being
appointed by one or more of the above, the Scottish Parliamentary
Corporate Body, the Scotland Office, Special Health Boards, the Forestry
Commission, Scottish Futures Trust, the Seafish Industry Authority, the
Student Loans Company Ltd and the Northern Lighthouse Board.

of mains fed water and wastewater services, and all associated services
including, but not restricted to, metering services, new connections and
disconnections, cost reduction analysis, surveys and leakage detection and
trade effluent.
Participation in the tender process is limited to companies who are either
Licensed Providers under the Water Services etc. (Scotland) Act 2005, or
have submitted an application to become a Licensed Provider, pending grant
of licenses from the Water Industry Commission for Scotland.

II.2.1) Total quantity or scope: Values are estimated between 1 000 0000
GBP and 56 000 000 GBP. The value will likely build up over time as
existing contracts end and institutions migrate across to the new
agreement.
No business whatsoever is guaranteed under any resulting Framework
Agreement or contract and there is no guarantee that any Framework
Agreement or contract will be put in place in relation to this notice. No
compensation etc will be paid if a tender or resulting Framework Agreement
is withdrawn for any reason. Bidders should take part in this process only
on the basis that they fully understand and accept this position.
Estimated value excluding VAT:
Range: between 1 000 000 and 56 000 000 GBP.
II.2.2) Options: Yes.
Description of these options: There will be the option of one 12 month
extension.
Provisional timetable for recourse to these options: in months: 36 (from
the award of the contract).

TITLE: Central Government
1) SHORT DESCRIPTION: This lot is for the provision of water, wastewater
and associated services.
2) COMMON PROCUREMENT VOCABULARY (CPV): 41110000, 41120000.
3) QUANTITY OR SCOPE: The Scottish Ministers (including Agencies),

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: (1) All
candidates will be required to produce a certificate or declaration
demonstrating that they have not been convicted of a criminal offence
relating to the conduct of their business or profession.
(2) Any candidate found to be guilty of serious misrepresentation in
providing any information required, may be declared ineligible and not
selected to continue with this procurement process.
(3) All candidates will be required to be a Licensed Provider of water and
wastewater services under the Water Services etc. (Scotland) Act 2005, or
have submitted an application to become a Licensed Provider, pending grant
of licenses from the Water Industry Commission for Scotland, with award of
licensed expected prior to award of the Framework Agreement, and in any
case no later than the commencement of the Framework Agreement on
1.4.2010.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: (1) All candidates will
be required to provide statements of accounts or extracts from those
accounts relating to their business.
Suppliers must meet minimum standards of economic and financial standing
to take part in the competition.
To be considered suppliers must include recent accounts, which APUC Ltd
will use to assess whether the business is financially viable.
Where a business is established and is required to have its accounts
audited, the last two years audited accounts must be provided;
Or.
If a business is exempt from the audit requirement, the last two years
annual accounts must be provided and certified by an independent Chartered
Accountant or accompanied by a positive bankers reference for the bidder;
Or.
If a business was recently set up and not audited, annual or endorsed
accounts have been produced, unaudited or management accounts for the 3
months prior to the application date must be provided and certified by an
independent Chartered Accountant or accompanied by a positive bankers
reference for the bidder;
And:
If a business is part of a group, you will need to include similar
accounts for the parent and ultimate holding companies.
Non-provision of such evidence to a satisfactory standard will be deemed
to be a failure to meet minimum standards of economic and financial
standing.
Where information is available to APUC that points to concerns over
financial viability, further information may be requested to evidence
financial viability and non-availability of, or refusal to provide such
evidence will be deemed to be a failure to meet minimum standards of
economic and financial standing.

IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.

VI.1) THIS IS A RECURRENT PROCUREMENT: Yes.
Estimated timing for further notices to be published: 30 to 42 months from
contract commencement.
VI.3) ADDITIONAL INFORMATION: Invitations to Tender (ITT) will be issued
and should be returned via APUC Ltd's electronic tendering system (ETS).
Details regarding the operation of ETS are contained within the ITT.
Collabarative arrangements:
The contract will be available for use by all 62 universities and colleges
(Institutions) and affiliated bodies in Scotland, including any new and
successor institutions, the Scottish Ministers (including Agencies),
Scottish Non-Departmental Public Bodies, offices in the Scottish
Administration which are not ministerial offices, cross-border public
authorities within the meaning of section 88(5) of the Scotland Act 1998,
any public body established by or under the Scotland Act 1998 or any Act
of the Scottish Parliament, any association of or formed by one or more of
the above, bodies financed wholly or mainly by one or more of the above,
bodies subject to management supervision by one or more of the above
bodies more than half of the board of directors of which, or, in the case
of a group of individuals, more than half of these individuals, being
appointed by one or more of the above, the Scottish Parliamentary
Corporate Body, the Scotland Office, Special Health Boards, the Forestry
Commission, Scottish Futures Trust, the Seafish Industry Authority, the

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: APUC Ltd will incorporate a minimum 10 calendar days
Standstill Period after notification to unsuccessful applicants of the
award decision. The period allows unsuccessful suppliers to seek a
debriefing from APUC Ltd before the Framework Agreement is entered into
and to provide an opportunity to seek to challenge the award decision
before it is implemented. A request for a debriefing made before midnight
on the second working day after the date of dispatch of the notification
of the award decision must be fulfilled at least 3 working days before the
expiry of the Standstill Period. A nominated contract point to request a
debriefing will be detailed in the notification letter.
The Public Contracts (Scotland) Regulations 2006 (SSI 2006 No. 1) provide
for remedies through the Scottish courts to be sought by economic
operators who suffer (or risk suffering) loss or damage as a consequence
of a failure by APUC Ltd to comply with certain provisions of those
regulations and/or certain EU Community obligations relating to
procurement. In summary, proceedings must be brought promptly and in any
event within 3 months of the date on which grounds for bringing
proceedings first arise. The relevant court will have discretion to extend
the deadline if it considers there is a good reason for doing so.
