II.1) DESCRIPTION

is for the construction of a new 1 815 m² visitor centre at The Giant’s
Causeway and Causeway Coast World Heritage Site. The contract is for
construction works including full engineering services, external and site
development works.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: This contract is for the construction of
a new 1 815 m² visitor centre at The Giant’s Causeway and Causeway Coast
World Heritage Site. This contract is for construction works including
full engineering services, external and site development works.
Estimated value excluding VAT:
Range: between 11 500 000,00 and 12 500 000,00 GBP.

II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 18 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: The Contracting Authority may
require the sucessful Economic Operator to take out a performance bond for
up to 10 % of the value of the contract from an A rated Bank or Financial
Institution.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: The commission will
be procured using the NEC3 Standard form of contract for construction
option A as amended by the Contracting Authority.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Will be detailed in the Information
Memoranda and Pre qualification questionnaire which will be provided to
applicants following receipt of written expressions of interest.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
The project will be subject to the National Trust sucessfully obtaining
finance applied for from government departments and sucessful application
for Heritage Lottery Fund Grant.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and

which will be provided to applicants following receipt of written

SECTION IV: PROCEDURE
IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Restricted.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged minimum number: 5. Maximum number: 6
Objective criteria for choosing the limited number of candidates: The
objective criteria for choosing the limited number of candidates will be
detailed in the Information Memoranda and Pre Qualification questionnaire
which will be provided to applicants following receipt of written
expressions of interest. There is an anomoly in the current OJEU Notice
formatting which does not permit the adjustment of the number of operators
to be shortlisted. There is no set maximum number of Operators whom will
be shortlisted for this project. The minimum number of Operators to be
shortlisted will be 5. Where there is a tie for 5th place, then all
Operators in 5th place will be invited to tender. For the purposes of this
exercise a tie for 5th place is deemed to occur where two or more
Operators have identical scores or any score is within 2 points of the 5th
place score.
IV.2) AWARD CRITERIA
IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The contracting authority will incorporate a minimum of
10 calendar days standstill period at the point information on the award
of the contract is communicated to tenderers. This period allows
unsuccessful tenderers to seek debriefing from the contracting authority
before the contract is entered into. Applicants may request an accelerated
debrief, provided it is received by the contracting authority, in writing,
by midnight of the second working day of the standstill period. The
contracting authority must provide this debriefing at least 3 full working
days before the end of the standstill period. Where this is not possible,
the standstill period will be extended to allow at least 3 working days
between the provision of the feedback, and the date at which the
contracting authority proposes to enter into the contract. Such
information should be requested from the address in section I.1. If an
appeal regarding the award of the contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (This shall be sought in the
High Court of Northern Ireland). Any such action must be brought promptly
(generally within three months). Where a contract has not been entered
into the court may order the setting aside of the award decision or order
the contracting authority to amend any document and may award damages. If
the contract has been entered into the court may only award damages.
