SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): The European
Commission acting through the Delegation to Russia intends to equip the
residences of its diplomatic and administrative-technical personnel with
alarm systems featuring panic buttons and smoke detectors — the latter
will be supplied by the Commission.
The Delegation expects to sign with the successful candidate a contract,
which will cover:
supply (except smoke detectors);
installation;
maintenance;
service and repair;
support by a quick response team.

twice at the discretion of the Commission.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: The Commission shall
pay for the alarm systems and ancillary services as follows:
— 100 % of the price of the systems shall be paid within 30 days of
installation of the systems or delivery of the relevant invoice, whichever
comes last,
— payments for services shall be made quarterly, in arrears, within 30
days of submission by the service provider of the corresponding invoice to
the Delegation. In this respect, duly established invoices should be sent
in duplicate to the address mentioned in the contract.
The Commission's obligation to pay shall be deemed duly performed on the
date on which the Commission bank account is debited.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Exclusion,
selection and award criteria:
A. Declaration that there are no conflicts of interest:
Tenderers should declare:
— that they do not have any conflict of interest in connection with the
contract; a conflict of interest could arise in particular as a result of
economic interests, political or national affinities, family or emotional
ties, or any other relevant connection or shared interest,
— that they will inform the contracting authority, without delay, of any
situation constituting a conflict of interest or which could give rise to
a conflict of interest,
— that they have not made and will not make any offer of any type
whatsoever from which an advantage can be derived under the contract,
— that they have not granted and will not grant, have not sought and will
not seek, have not attempted and will not attempt to obtain, and have not
accepted and will not accept, any advantage, financial or in kind, to or
from any party whatsoever, constituting an illegal practice or involving
corruption, either directly or indirectly, as an incentive or reward
relating to the award of the contract.
B. Exclusion criteria:
Tenderers shall be excluded from participation in the procurement
procedure if:
— they are bankrupt or being wound up, are having their affairs
administered by the courts, have entered into an arrangement with
creditors, have suspended business activities, are the subject of
proceedings concerning those matters, or are in any analogous situation
arising from a similar procedure provided for in national legislation or
regulations,
— they have been convicted of an offence concerning their professional
conduct by a judgment which has the force of 'res judicata',
— they have been guilty of grave professional misconduct proven by any
means which the contracting authority can justify,
— they have not fulfilled obligations relating to the payment of social
security contributions or the payment of taxes in accordance with the
legal provisions of the country in which they are established or with
those of the country of the contracting authority or those of the country
where the contract is to be performed,
— they have been the subject of a judgment which has the force of 'res
judicata' for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests,
— they are currently subject to an administrative penalty referred to in
Article 96(1) of the Financial Regulation applicable to the general budget
of the European Communities (http://www.cc.cec/budg/leg/finreg/
leg-020-20_finreg2002_en.html#96).
Please note: a contract shall not be awarded to candidates or tenderers
who, during the procurement procedure for this contract:
(a) are subject to a conflict of interest;
(b) are guilty of misrepresentation in supplying the information required
by the contracting authority as a condition of participation in the
procurement procedure or fail to supply this information;
(c) find themselves in one of the situations of exclusion, referred to in
the 'Exclusion criteria' above, for this procurement procedure.
The tenderers shall certify in writing that they are in none of the
situations described above. Likewise, the tenderers shall immediately
inform the European Commission if one of the above situations occur. The
certificates shall be signed by the person authorised to represent the
tenderer in this call for tenders.
Tenderers must also provide:
— tenderer's information: name of the company, legal status, address,
telephone, telex and fax numbers, names and functions of members of the
management or person authorised to sign and represent the company,
— certificates evidencing registration on the trade register or
appropriate professional register; a proof of the legal status of the
company,
— documentary evidence of registration in the Russian Federation.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: Tenderers must provide
the following documents and information:
— certificates issued by the authorised bodies or declarations certifying
the payment of taxes and social security contributions, and the INN
(individual taxpayer's number),
— statement showing the applicant's financial capacity: total annual
turnover of at least 500 000 EUR for the last year, together with the
balance sheets for the last 3 years certified as accepted by the tax
authorities and operating accounts for this period, bankers' statements,
— information on experience in implementation of at least 5 similar
contracts (scope, nature) under similar conditions (preferably with
embassies, international organisations and major foreign companies) for
the last 3 years specifying the dates of contract, client, scope of the
contract and references if any.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
Tenderers must provide the following documents and information:
evidence of quality assurance measures: ISO 9000 certificate or
equivalent; if such certificate is not available, then a statement by the
tenderer specifying quality-control measures taken;
licences for performing contractor's obligations under the proposed
contract, where required.
