SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Consultancy Support - calculation of the fixed costs of a new entrant
peaking plant 2011/12.

II.1.5) Short description of the contract or purchase(s): The Commission
for Energy Regulation (‘the Commission’) and the Northern Ireland
Authority for Utility Regulation (‘the Authority’), collectively ‘the
Regulatory Authorities (RAs)’, worked together to deliver the Single
Electricity Market (‘SEM’) which commenced operation on 1st November 2007.
Part of this work included the development of a Capacity Payment Mechanism
(‘CPM’) , which takes the form of a fixed annual sum of money (the ‘Annual
Capacity Payment Sum’ (ACPS)), calculated prior to the commencement of the
Trading Year (which runs from January to December).
The Regulatory Authorities (RAs) now invite tenders for Consultancy
Support in the Calculation of the Fixed Costs of a New Entrant Peaking
Plant for the Capacity Payment Mechanism in the SEM Trading Year 2011 &
2012. The services to be provided are:
1. Analysis of costs and recommendation of BNE Peaker for 2011 & 2012. The
RAs expect that the selected consultants will utilize data and information
from varied sources and, if applicable, recognised data base or software
sources when making their recommendations.
2. Responses to adhoc queries from RAs and industry parties and attending
meetings with industry participants as required.
3. Review and advise on the responses from industry.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The scope below details the requirements
for the calculation of the costs for the Best New Entrant’ in the SEM in
2011. The RAs intend to retain the successful candidate to repeat the
process for the calculation of the costs for the Best New Entrant’ in the
SEM in 2012.
II.2.2) Options: No.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Tenderers should
note that the Commission and the Authority will bear the costs of the
consultancy in the proportions: 50 % to the Commission and 50 % to the
Authority.
All fees and expenses shall have to be invoiced separately to the
Commission and the Authority in these proportions.
All invoices issued to the Commission will be in Euro and subject to Irish
VAT and Withholding Tax.
All invoices issued to the Authority will be in Sterling and subject to
Northern Ireland VAT.
The liability of the Commission and the Authority for the payment of all
fees and expenses shall be severable, not joint and severable. On no
account will either the Commission or the Authority be accountable for any
fees and expenses incurred by the other.

whom the contract is to be awarded: A grouping if successful must be
prepared to contract as a single entity having joint and several
liability.

be responsible for costs, charges or expenses incurred by candidates
whether or not the final contract is awarded.
2. Formal award of contract will be subject to the approval of the
Comnmission and the Authority.
3. Any conflicts of interest involving a tenderer must be fully disclosed
to the Commission and Authority particularly where there is a conflict of
interest in relation to any recommendations or proposals put forward by
the tenderer.
4. Tenderers should be aware that national legislation applies in other
matters such as Official Secrets, Data Protection and Health and Safety.
5. Information supplied by tenderers will be treated as contractually
binding. However, the Commission and the Authority reserves the right to
seek clarification or verification of any such information.
6. Any items and conditions in the proposed contract does not imply
acceptance by the Commission or the Authority.
7. All works carried out shall be governed by the Laws of Ireland and
subject to the exclusive jurisdiction of the Courts of Ireland.
8. The Commission or the Authority may cancel the tender process at any
time prior to a contract being entered into.
9. Candidates should note that the Commission and the Authority will bear
