II.1.5) Short description of the contract or purchase(s): The requirement
here is for suitable consultants, with a demonstrable track record of
working on the investigation of land contamination and adequate resources
and capacity for the work and who are qualified to undertake a specialist
study relating to the requirement for local authorities to undertake the
inspection of their area as described in Part IIa of the Environmental
Protection Act 1990 and The Contaminated Land (Scotland) Regulations 2005.
The individual sites of interest are currently housing areas that were
previously commercial or industrial, and are either in private ownership
or housing associations.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: A parent company guarantee may
be required.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: The Purchase Price
will be paid in stages upon satisfactory completion and as set out in the
Specification of Requirements towards full delivery of the Service as
follows:
(a) Interim payments can be made to cover sub-contractor fees and outlays
if necessary prior to submission of the final report;
(b) Supply of final report – 90 % of the Contract Price (or the balance
thereof);
(c) 3 month settling period – 10 % of the Contract Price (this will
include correspondence with interested parties regarding reinstatement
etc).
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Where the Offer is made as part of a
consortium the Consultant understands that all members of the consortium
will require to submit compliant and consistent offers as part of a
unitary whole and that all constituent members of the consortium, if
successful, would be liable for performance of the Contract jointly and
severally.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
1. The Consultant has examined the Tender Documents incorporating the
Instructions for Tendering, the Specification of Requirements and the
Conditions of Contract and is fully satisfied as to its abilities and
experience in all respects to fulfil all the requirements of the Contract;
2. The Consultant offers to make the above supply to the Client in
accordance with the terms and conditions contained in the said Tender
Documents on the inclusive prices and rates (net of VAT) specified in the
Pricing Schedule signed as relative to this Offer of Tender and the
solution to the Client’s requirements set out in the Consultant’s Method
Statement(s) also signed as relative to this Offer of Tender;
3. The Consultant confirms that this offer is open for acceptance for the
period of 60 days from the latest date of Tender Return, namely Wednesday
2.12.2009;
4. The Consultant makes this offer on the basis of and under warranty as
to the accuracy of the Certificate of Bona Fide Tender, Non-Collusion and
Compliance with Invitation to Tender signed as relative to this Offer of
Tender.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: (1) All
candidates will be required to produce a certificate or declaration
demonstrating that they are not bankrupt or the subject of an
administration order, are not being wound-up, have not granted a trust
deed, are not the subject of a petition presented for sequestration of
their estate, have not had a receiver, manager or administrator appointed
and are not otherwise apparently insolvent;
(2) All candidates will be required to produce a certificate or
declaration demonstrating that the candidate, their directors, or any
other person who has powers of representation, decision or control of the
candidate has not been convicted of conspiracy, corruption, bribery, or
money laundering. Failure to provide such a declaration will result in the
candidate being declared ineligible and they will not be selected to
participate in this procurement process;
(3) All candidates will be required to produce a certificate or
declaration demonstrating that they have not been convicted of a criminal
offence relating to the conduct of their business or profession;
(4) All candidates will be required to produce a certificate or
declaration demonstrating that they have not committed an act of grave
misconduct in the course of their business or profession;
(5) All candidates must comply with the requirements of the State in which
they are established, regarding registration on the professional or trade
register;
(6) Any candidate found to be guilty of serious misrepresentation in
providing any information required, may be declared ineligible and not
selected to continue with this procurement process.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: (1) All candidates will
be required to provide a reference from their bank;
(2) All candidates will be required to provide evidence of relevant
professional risk indemnity insurance;
(3) All candidates will be required to provide a statement, covering the 3
previous financial years including the overall turnover of the candidate
and the turnover in respect of the activities which are of a similar type
to the subject matter of this notice.
Minimum level(s) of standards possibly required: 1. The Consultant must
demonstrate an average annual turnover of no less than 360 000 GBP when
considered over the 3 full years’ data which will be available from the 2
years’ audited accounts provided;
2. The Consultant must also demonstrate that it has revenue reserves at
the close of their most recent audited accounts of no less than 30 000
GBP;
3. The Consultant must certify and produce evidence that it holds or will
hold prior to the date of contract award insurances of the minimum values
stated within the Tender Documents.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
(1) Details of the educational and professional qualifications of their
managerial staff; and those of the person(s) who would be responsible for
providing the services or carrying out the work or works under the
contract;
Minimum level(s) of standards possibly required:
1. Consultants should be able to provide a list of contaminated land
investigation projects which have been undertaken in the last 3 years;
2. Consultants must have a track record of working on investigations of
Contaminated Land (ideally within a residential setting) – minimum of 3
years;
3. Each driller should be a BDA accredited “environmental” driller (or
equivalent) as defined by Site Investigation in Construction 4, Guidelines
for the Safe Investigation by Drilling of Landfills and Contaminated Land,
1993, Clause 8;
4. Alternatively, uncertified drillers may be employed providing each
drilling rig is supervised by a qualified engineer/geologist having at
least 3 years relevant experience.

SECTION VI: COMPLEMENTARY INFORMATION
VI.3) ADDITIONAL INFORMATION: This notice replaces the previously
published Contract OCT070212 due to the incorrect contract values stated.
Please also note that Section 1 Paragraph 13 text has been amended to
refer to the envelope label which has been supplied in electronic form in
the Additonal Documents Section (this be upload as soon as possible once
an electronic version is available).
The following questions were noted at the point of cancellation and are
answered below.
Q1 Your ITT document states: The laboratory used for chemical analysis
shall preferably have full and current UKAS accreditation. Would you
accept a European Lab with ISO 17025 certification?
A1 Alternative equivalent accreditation will be accepted. However, this
must represent an independent verification of the laboratory and
processes, and not just a self-certification. The requirement for UKAS
Accreditation (as listed in the ITT Document) is Desirable rather than
Essential. This represents our desire to have a laboratory used which is
assessed against internationally recognised standards to demonstrate their
competence, impartiality and performance capability.
Q2 Is the ITT available in a word format in order that Section 8, the
questionnaire, can be completed electronically?
A2 Yes - A word version of the ITT will be available on the Additional
Documents Section.

VI.4) PROCEDURES FOR APPEAL

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Council will incorporate a minimum of 10 calendar
days standstill period at the point that information on the award of the
contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
required from the contact details given in part I.1 of this Contract
Notice. If the tenderer remains aggrieved after seeking such debriefing
information, the Public Contracts (Scotland) Regulations 2006 (SSI 2006
No.1) provide for aggrieved parties who have been harmed or are at risk of
harm by a breach of the rule to take action in the local Sheriff Court or
Court of Session in Scotland. Any such action must be brought promptly
(generally within 3 months at the latest). Suitably qualified independent
legal advice on Scots Law court procedures should be sought immediately by
any aggrieved tenderer contemplating such action. Where a contract has not
been entered into the Court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the Court may only award
damages. The purpose of the standstill period referred to above is also to
allow parties to apply to the Court to set aside an unlawful award
decision before the contract is entered into.
