II.1.5) Short description of the contract or purchase(s): The Riverside
Group Limited are developing a partnering approach to the delivery of
responsive repairs and maintenance requirements. Following a pilot in
Mersey North (Zone 1), the second phase was the implementation of this
strategy within the South East of England (Zone 2), and has progressed to
Zone 3 in the North East of England.
In order to assist in the delivery of the above strategy Riverside wish to
establish an EU compliant material merchants model, to supply materials
across England to those contractors appointed to carry out responsive
repairs and maintenance works. The framework may include other procurement
activity for example new build and asset management works. Note: The award
of the framework agreement will not constitute any guarantee of work.
Merchants should note that the day-to-day operational and transactional
relationship will remain between the contractor(s) and the appointed
merchant(s). The Riverside Group also wish to integrate the Fusion21
National Framework Solution within the stores model. Additional
information can be found within the tender documentation.

III.1) CONDITIONS RELATING TO THE CONTRACT

whom the contract is to be awarded: In the event of a group of
organisations submitting an acceptable offer, it will be necessary for
them to provide an undertaking that each company shall be jointly and
severally responsible for the due performance of any contracts called off
and entered into between The Riverside Group, it's partners, members,
customers, and such orgaisations under the framework agreement.

contract is subject: Yes.
Applicants who satisfy any of the criteria for rejection as set out in
Regulation 23(1), Public Contracts Regulations 2006 shall be treated as
ineligible. Applicants may be requested to provide such evidence as is
reasonably necessary to The Riverside Group to establish that the
aforementioned criteria do not apply to them.
III.2) CONDITIONS FOR PARTICIPATION

accordance with Articles 45 to 50 of Directive 2004/18/EC and Regulations
23 to 25 of the Public Contracts Regulations 2006 and as set out in the

formalities set out in Article 47 of Directive 2004/18/EC and Regulation

VI.3) ADDITIONAL INFORMATION: The Riverside Group Limited is a Charitable
Industrial and Provident Society, which owns and/or manages approximately
50 000 houses across England with divisions in Mersey North, Mersey South,
Pennine, Carlise, the North East, the Midlands and the South East. Group
subsidiaries include English Churches Housing Group (ECHG), Prospect (GB)
Ltd and Wave Homes. The ensuing arrangements may be used by both current
and future.
Members of The Riverside Group Limited, partners of The Riverside Group
Limited and other organisations with similar interests to The Riverside
Group Limited. In this regard, the Riverside Group should be regarded as a
"Central Purchasing Body." In this respect, it should also be noted that
Riverside is a founder member of Fusion21.
Fusion21 is a collaborative partnership of several landlords with stock
located predominantly across Merseyside but also nationally, who have
achieved substantial efficiency gains in planned maintenance, resulting in
the award of a Housing Corporation Gold Award.
VI.4) PROCEDURES FOR APPEAL

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Riverside Group Limited will incorporate a standstill
period, following award of the contract. The period shall commence on the
day following award notification, and shall be in accordance with The
Public Contracts Regulations 2006, and all subsequent amendments and
directives. At present, this standstill period shall be no less than 10
calendar days, however this is subject to change, in accordance with
impending legislation. This period allows unsuccessful tenderers to seek
further debriefing from The Riverside Group Limited before the contract is
entered into.
Tenderers have 2 working days from the notification of the award decision
to request additional debriefing and that information has to be provided a
minimum of 3 working days before the expiry of the standstill period. Such
information should be requested from the address in part I.1.
Tenderers should lodge any appeal before the close of the standstill
period and in line with the Public Contracts Regulations 2006. If an
appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England). Any such action
must be brought promptly (generally within 3 months). Where a contract has
not been entered into the Court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the Court may only award
damages.
