formalities necessary for evaluating if requirements are met: Applicants
are requested to provide with their letter of application an overveiw of
services provided to the public sector over the past three years.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: Applicants are requested
to provide with their letter of application details of financial standing.
Potential suppliers may be asked to provide a copy of their annual report
and accounts for the last three years.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
Service providers will be authorised to write the class of insurance
listed within EU member states subject to English law and jurisdiction of
English courts. Potential suppliers may be asked to produce a certificate
issued by the appropriate insurance regulatory authority indicating the
types of insurance the Insurer is authorised to provide. Potential
suppliers must also comply with the UK Department for Business Enterprise
and Regulatory Reform Regulations.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: Wiltshire Council are supported by its
appointed Insurance Broker, Willis Limited in the conduct of this tender.
The following Insurers have been pre-selected - Zurich Municipal, Royal &
Sun Alliance Insurance plc., Travelers Insurance Co Ltd and Risk
Management Partners Ltd.
VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: See VI.4.2.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Wiltshire Council will incorporate a minimum 10 calendar
day standstill period at the point information on the award of the
contract is communciated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
required from Wiltshire Council - see part I.1).
If an appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Couurt (England, Wales and
Northern Ireland). Any such action must be brought promptyly (generally
within 3 months). Where a contract has not been entered into the Court may
order the setting aside of the award decision or order the authority to
amend any document and may award damages.
