SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
UK-Glasgow: 2010 onwards investment - common area improvements.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Works.
Realisation, by whatever means of work, corresponding to the requirements
specified by the contracting authorities.
Main site or location of works: The main site or location of works is the
area contained within the Glasgow City Local Authority boundary. Section
I.2.2 of this Notice confirms that the contracting authority is purchasing
on behalf of other contracting authorities. The main site or location of
works for the other contracting authorities is the area contained within
the Glasgow City Local Authority boundary but may also include the area
contained within the boundaries of the 6 adjoining Local Authorities, viz.
East Dunbartonshire, West Dunbartonshire, Renfrewshire, East Renfrewshire,
North Lanarkshire, and South Lanarkshire.

II.1.3) The notice involves: The establishment of a framework agreement.

II.1.5) Short description of the contract or purchase(s): The contracting
authority proposes to enter into arrangements through which it will
deliver improvements to its housing stock. The arrangements follow on from
a programme established in 2003.
The envisaged framework for common area improvements forms part of a wider
programme of improvement initiatives including: external fabric
improvements to low rise properties, internal improvements, and
environmental improvements. The quantity and scope of the common area
improvements are as set out in Section II.2.1 of this Notice.
The object of this contract is to deliver a programme of common area
improvements which will bring the contracting authority's housing stock to
a condition which meets or exceeds the Scottish Housing Quality Standard
and may include similar improvements to non-housing properties in its
portfolio.
The main elements of the common area improvements are expected to involve
controlled door entry system installation; timber or steel front and rear
close doors; improvements to or complete replacement of stair lighting
installations; close redecoration of walls ceilings, stair soffits and
floors; window replacement; and erection of handrails.
All work associated with each property is to be carried out in a single
continuous operation without gaps in the delivery of individual elements
of the improvements.
Properties to be improved will, for the most part be semi-detached,
terraced or four-in-a-block houses and pre-1919, inter war and post 1946
tenements. Some improvements may be required to deck access type
properties and some non-housing properties of seven stories in height or
less.
The contract documents will establish the contracting authority's
technical and other requirements relating to the improvements however it
is intended that the contractor shall develop the aesthetic and technical
design solutions to satisfy the contracting authority's requirements and
the contractor shall have sole responsibility for those aesthetic and
technical design solutions.
It is envisaged that the primary contract will be a framework agreement
between the contracting authority and each of three framework contractors.
It is anticipated that a call-off contract to a single contractor will be
awarded annually. The contract documents will set out the terms upon which
an annual award and any other call-offs will be made.
The contracting authority is acting where agreed as a central purchasing
body for local housing organisations (LHOs) and for other bodies involved
in providing or managing social housing within the Local Authority
boundaries of Glasgow City, East Dunbartonshire, West Dunbartonshire,
Renfrewshire, East Renfrewshire, North Lanarkshire, and South Lanarkshire;
It is also acting as a central purchasing body for GHA (Management)
Limited and any of its other subsidiaries and any other body providing
factoring services as agreed with the contracting authority. It is
envisaged that contract awards by other contracting authorities on whose
behalf the contracting authority is purchasing will be at the discretion
of those other contracting authorities.
The contracting authority makes no representation or guarantee that it
will instruct works falling within the above scope by means of the
framework contract referred to, and will reserve the absolute right to
award any of such works to such other providers as it chooses. Additional
information is set out in Section VI.3 of this Notice.

II.2.1) Total quantity or scope: As set out at II.1.4.2 above, it is
estimated that the likely total value of the works may be approximately 16
000 000 to 18 000 000 GBP.

II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 48 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Details will be set out in the
contract documents.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Details will be set
out in the contract documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Joint and several liability.
If a successful economic operator is a consortium, the contracting
authority shall require each consortium member to be jointly and severally
liable for all obligations under the framework contract and each call-off
contract.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
The contractor(s) and their supply chains will be required to actively
participate in the achievement of the contracting authority's social and
environmental objectives. Accordingly, potential contractors should be
aware that contract performance conditions and evaluation criteria may
include social and environmental considerations. Details will be set out
in the contract documents.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: In
accordance with Articles 45 to 50 of Directive 2004/18/EC and Regulations
23 to 26 of the Public Contracts (Scotland) Regulations 2006 and as set
out in the contracting authority's prequalification questionnaire which
will be provided to applicants who submit a request to participate.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: Details will be set out
in the prequalification questionnaire which will be provided to applicants
who submit a request to participate.
Minimum level(s) of standards possibly required: Applicants will require
to meet minimum standards of economic and financial standing which will be
described in detail in the prequalification questionnaire. A scoring
evaluation leading to a pass/fail assessment will be made in respect of 4
categories, viz turnover, profitability, balance sheet strength and
stability, and liquidity. Applicants will be marked out of 10 in respect
of each category and a score of less than 5 in any individual category
will result in a failure overall.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
Details will be set out in the prequalification questionnaire which will
be provided to applicants who submit a request to participate. See Section
VI.3.

deliver work of the nature covered by the framework with an annual value
of 4 800 000 GBP.

Objective criteria for choosing the limited number of candidates: The
following objective criteria with their relative weightings in respect of
technical or professional ability will be used to select those to be
invited to tender in accordance with Regulation 16(9): Experience and
Resources 70 %; Health and Safety 15 %; Quality Assurance 15 %. The
contracting authority will score responses to the pre-qualification
questionnaire in accordance with the methodology set out therein in order
to identify the ranking of applicants. It is envisaged that the eight
applicants who achieve the eight highest scores will be selected to be
invited to tender. Further details will be set out in the prequalification
questionnaire.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: All or part of the contracting authority's
housing stock may transfer during the course of the contract(s) to LHOs
through a process known as Second Stage Transfer (SST). The contract(s)
may therefore provide a mechanism for the obligations of the contractor in
respect of any such transferred housing stock to continue, where the
relevant LHO continues with participation in the arrangements under the
framework. This may, without limitation, be by means of the contracting
authority continuing to contract on behalf of the relevant LHOs or by
means of a partial novation or assignation to the LHOs. Details of the
chosen mechanism will be set out in the contract documents. If an LHO does
not continue to participate in the framework following SST, this may
reduce the volume of housing stock to which the framework applies.
The contracting authority intends to establish a framework of contractors
with the financial standing and technical capacity to deliver the proposed
common area improvement programme. It is envisaged that the framework will
have a duration of 4 years.
The contract documents will specify the criteria and weighting which will
determine the appointment of contractors to the framework.
The contract documents will set out the specification and detailed terms
and conditions of the underlying contracts proposed by the contracting
authority, and the basis on which awards will be made under call-offs.
Other organisations on whose behalf the contracting authority is acting as
a Central Purchasing Body may revert to mini-competition in order to
call-off from the framework but the contracts to be awarded by other
organisations will have no substantive change to the specification or the
terms and conditions.

VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: See VI.4.2 below.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The contracting authority will incorporate a minimum
10-calendar-day standstill period at the point information on the award of
the contract(s) is (are) communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the contracting
authority before the contracts are entered into. Applicants have 2 working
days from the notification of the award decision to request additional
debriefing and such information has to be provided a minimum of 3 working
days before the end of the standstill period. Such additional information
should be requested from the contracting authority as detailed in point
I.1 of this notice. If an appeal regarding the award of a contract has not
been successfully resolved, the Public Contracts (Scotland) regulations
2006 provide for aggrieved parties who have been harmed or who are at risk
from harm by breach of the rules to take action in the Sherriff Court or
Court of Session. Any such action must be brought promptly and within
three months. Where a contract has not been entered into in accordance
with the Regulations the court may award the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into in accordance with the
Regulations the court may only award damages, (the purpose of the
standstill period referred to above is to allow parties to apply to the
Courts to set aside the award decision before the contract is entered
into.).

receipt of expressions of interest regarding contract notice 2009/S
