SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Nottinghamshire
County Council is looking to appoint a contractor (or contractors) to
undertake cleaning and maintenance of bus shelters and bus stop poles
throughout the County. Repair and maintenance services. Bus shelters.
Bus-stop posts.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The County Council seeks to appoint a
single contractor to be responsible for the cleaning and maintenance of
approximately 900 bus shelters, 4 000 bus stop posts, 4 electronic kiosks
(15 by 2011) and 30 real-time displays (100 by 2011), at specified
locations across the County.
Estimated value excluding VAT: 450 000 GBP.
II.2.2) Options: Yes.
Description of these options: There is an option to extend the contract
(at the sole discretion of the County Council) for a further 12 month
period.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Starting:
1.4.2010. Completion: 31.3.2013.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Not applicable.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Tender pricing must
be in pounds sterling (GBP) and payments under this contract will be in
GBP.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Joint and several liability.
In the event of a consortium bid, then one member of the consortium must
be identified as the lead and the main contractor who will accept
responsibility for all the obligations of the consortium members.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Participants
will be required to complete a contract questionnaire included in the
Invitation to Tender and unequivocally confirm that none of the
circumstances set out in the Public Contracts Regulations 2006 Part IV
Regulation 23 apply to your company.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: Suppliers will be
required to complete details of and confirm if they hold the relevant
minimum levels of Employer Liability Insurance and Public Liability
Insurance in the Contract Questionnaire included in the tender documents.
Minimum level(s) of standards possibly required (if applicable) Minimum
levels of insurance required are as follows: Employers Liability Insurance
- 10 000 000 GBP or greater, covering any liability for any one claim
arising under the contract. Public Liability Insurance - 5 000 000 GBP or
greater, covering any liability for any one claim arising under the
contract.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
Tenderers will be required to answer questions in the contract
questionnaire contained within the tender documents on the matters set out
in this Part III.2 of the notice. Tenders will not be evaluated unless
tenderers unequivocally confirm compliance with the requirements, set out
in this section III.2 for information, and repeated in the contract
questionnaire for completion.
In addition to the other matters set out in this Section III.2, all
tenderers:
1. Must comply with the Construction, Design and Management (CDM)
Regulations 2007 and must submit a statement of competence as part of
their tender.
2. Must successfully complete a Contractor Approval Assessment by the
County Council's Health & Safety Team.
3. Shall consider all works to be street works and carry them out to the
corresponding requirements of NRSWA, and undertake to arrange and submit
relevant notices and searches on behalf of the Authority.
4. Identify and make available to the County Council, key personnel to be
available for site visits, contribute any difficulty they foresee,
continue discussions and resolve any problems.
5. Be mindful of nesting birds when locating shelters near to trees and
hedgerows in the Spring and early Summer months.
Minimum level(s) of standards possibly required:
In addition to the other matters set out in this Section III.2, all
tenderers:

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Authority will incorporate a minimum 10 calendar day
standstill period at the point information on the award of contract is
communicated to Tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have two working days from the notification of
the award decision to request additional debriefing and that information
has to be provided a minimum of 3 working days before expiry of the
standstill period. Such information should be required from the address
stated in Section I.1.2.
If an appeal regarding the award of a contract has not been successfully
resolved, the Public Contracts Regulations 2006 (SI 2006 No.5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into, the Court may order
the setting aside of the award decision or order the Authority to amend
any document and may award damages. If the contract has been entered into,
the Court may only award damages.
